This study offers an explanation of the relationship between the inclusion of parents/guardians and teachers in Michigan K-12 public school decision-making processes, perceptions of school quality, and subsequent parent/guardian and teacher retention by the school. Decision-making structures and participation in those structures, participants’ own childhood experiences, trust, agency, relatedness (belonging), and usefulness were considered in constructing a model of best fit to explain the relationships between decision-making inclusion, perceptions of quality, and retention. What emerged from this 225-participant (121 parents/guardians and 104 teacher) survey was a model that affirms that professional learning communities (PLCs) are a structure that supports greater …

Cost-benefit analysis is at the core of regulatory impact analysis for every proposed rule or regulation and is designed to be a structural constraint on the administrative state. The challenge is ex ante cost-benefit analysis necessarily rests on many assumptions, and much more information is available about a regulation’s impact after it has been implemented. But ex post cost-benefit analysis is ad hoc and infrequent in spite of efforts by numerous presidential administrations to promote regulatory lookbacks.
I propose institutionalizing “contingent regulatory sunsets” to ensure that rules and regulations have the positive impact in practice that administrative agencies intended. I …

The last decade has brought many technological advances to genetic testing. Increasingly, genetic testing, which was previously reserved for clinical or medical settings, has made its way to other spaces. Most significantly, we are now seeing the re-introduction of genetic testing to the workplace. Although the Genetic Information Nondiscrimination Act (GINA), which became law in 2009, would seemingly prohibit genetic testing in the workplace, genetic testing, as part of workplace wellness programs, is lawful under the aegis of the Affordable Care Act (ACA). That judges follow what the law is, and not what they wish it was, is a requirement of the rule of law. At the same time, scholars, lawyers, and judges often say that judges’ values influence their decisions. Connecting these two ideas has generated a conversation about the relationship between law, ideology, and politics.
Recently, part of this conversation has focused on a theory called cultural cognition. The theory offers an account of how people’s values shape how they interpret things without their noticing. This Essay considers the future of public-private collaboration in the wake of the Murthy v. Missouri litigation, which cast doubt on the constitutionality of information sharing between federal agencies and social media companies. The litigation has been a good and a bad teacher. On one hand, the lower court decisions made legible the risks to free expression, accountability, transparency, and intimate privacy posed by government-industry collaborations. Emergency towing vessels are a vital component of maritime safety. This study works to improve on previous works in the area of automating the towing of disabled ships. In doing so control methods for transient three degree of freedom dynamics of a tug and tow system which is connected with a finite element cable are evaluated. There are few Supreme Court cases that enjoy as much widespread support as the unanimous decision in United States v. Nixon. The recent pitched battles between Congress and the executive branch have made apparent the vast disagreement between the two branches over access to information. But that disagreement does not extend to Nixon, the unquestioned jurisprudential foundation for the doctrine of executive privilege. Closer inspection shows, however, that this foundation is not a stable one, but one constructed from unnecessary, ill-considered dicta.

Expungement has an uptake problem. A recent explosion of state-level rights allows people with felony convictions to expunge their criminal record, but only one to six percent of eligible people avail themselves of the remedy. Expungement is a powerful policy tool that promotes social and economic reintegration. It also serves a dignitary purpose, allowing people with criminal records to unshackle themselves from past mistakes. One might assume people would rush to court to clear their records. That the opposite is occurring—and new laws are idling on the books—suggests that rights-creation in this space has not been efficacious. This demands a …

Travel rights and travel restrictions shape nearly every part of society, moderating where and how we go about our daily lives. Yet a central aspect of travel has gone largely unnoticed in the legal literature. Oppressive governments have routinely restricted free movement as a principal means of effectuating discrimination. And travel rights, as a result, have always had a strong anti-discriminatory valence. From the Magna Carta to Blackstone’s Commentaries to the Constitution itself, rights to travel have consistently emerged from struggles against discrimination.

Negative Trading In Congress, Peter Molk, Frank Partnoy

We investigate negative trading, such as short selling, by members of Congress. We find, based on a new comprehensive dataset of trades by members of Congress, that negative trading not only is common, but also is associated with positive abnormal financial returns. Simply put, members of Congress make money when they bet on stock price drops.
In contrast, we do not find a similar association for long positions taken by members of Congress. In other words, there is an asymmetry between “positive” versus “negative” congressional trading. This asymmetry has multiple implications for public policy.

The Officers’ Union of International Seamen (OUIS) commissioned the World Maritime University (WMU) to conduct the Work & Health Balance at Sea (WHEAB) project to examine some dimensions of seafarers’ working lives.
Building on exploratory interviews, a survey was designed and administered. The current report presents findings on work patterns (onboard and home periods), working hours, work-related stress, safety management system, shore leave, mental well-being, and career intention.
The survey gathered responses from 4,372 seafarers, mainly from India (n=1,098; 25.1%), the Philippines (n=690; 15.8%), the United States (U.S.) (n=501; 11.5%), and other worldwide regions (n=2,083; 47.6%). The overrepresentation of U.S. …

ประเทศประชาธิปไตยทั้งหลายถือว่า บทบาทของรัฐสภาในการจัดทำและควบคุมงบประมาณของรัฐเป็นเรื่องสำคัญและไม่อาจทดแทนด้วยกลไกอื่นได้ แต่ในช่วงกว่าหนึ่งศตวรรษที่ผ่านมา ฝ่ายบริหารมีบทบาทนำในการจัดทำงบประมาณของรัฐ เมื่อไม่นานมานี้เองที่รัฐสภาในประเทศต่าง ๆ รวมทั้งรัฐสภาไทย เริ่มตื่นตัว และปรับปรุงกระบวนการงบประมาณของรัฐสภา เพื่อกระชับอำนาจของรัฐสภาในการควบคุมงบประมาณให้มากขึ้น หนึ่งในเครื่องมือที่ฝ่ายนิติบัญญัติในประเทศต่าง ๆ นำมาใช้ในการเสริมสร้างความเข้มแข็งในทำหน้าที่ควบคุมงบประมาณของรัฐ คือ การจัดตั้งสำนักงบประมาณของรัฐสภาขึ้น บทความวิจัยนี้ต้องการศึกษาบทบาทของสำนักงบประมาณของรัฐสภาไทย ตลอดจนถึงผลสืบเนื่องที่เกิดจากการจัดตั้งสำนักงบประมาณของรัฐสภาต่อการกระชับอำนาจในการควบคุมงบประมาณของรัฐสภา ผู้วิจัยได้สำรวจเอกสารสัมภาษณ์ บุคลากรของสำนักงบประมาณของรัฐสภา สมาชิกสภาผู้แทนราษฎร ข้าราชการฝ่ายบริหาร และจัดประชุมเชิงปฏิบัติการและการสัมมนา เพื่อสอบทานข้อมูลและแปลความหมายข้อมูลร่วมกับผู้ให้ข้อมูลหลักที่เกี่ยวข้องกับกระบวนการงบประมาณของรัฐสภา บทความวิจัยนี้บ่งชี้ว่า สำนักงบประมาณของรัฐสภามีส่วนสนับสนุนให้กระบวนการงบประมาณของฝ่ายนิติบัญญัติมีความเข้มแข็งมากขึ้น และมีส่วนช่วยให้รัฐสภาควบคุมงบประมาณของรัฐได้เพิ่มขึ้นระดับหนึ่ง น่าสังเกตว่า สำนักงบประมาณของรัฐสภาได้ใช้ความสามารถของหน่วยงานในการทำหน้าที่จนถึงขีดจำกัดสูงสุดที่สามารถทำได้ แต่ก็ยังไม่สามารถทำหน้าที่ที่ได้รับมอบหมายได้ครอบคลุมครบถ้วนทุกด้าน รัฐสภาจึงควรแสวงหาแนวทางในการพัฒนาขีดความสามารถของสำนักงบประมาณของรัฐสภาให้เพิ่มขึ้น

Recent advances in hyperpolarization, particularly Signal Amplification by Reversible Exchange (SABRE), have enhanced molecular magnetic resonance imaging (MRI) for in vivo applications. This study investigates [15N3]metronidazole, a tri-nitrogen-labeled derivative of an FDA-approved antibiotic, as a hypoxia-sensitive imaging agent. Under hypoxic conditions, the nitroimidazole group undergoes stepwise reduction to an amino group, inducing significant 15N chemical shift changes (30–600 ppm). We aim to develop an iridium catalyst-free, biocompatible hyperpolarized (HP) [15N3]metronidazole formulation exhibiting robust polarization (up to 15%) and extended T1 lifetimes (~10 min). Arthritis is a leading cause of activity limitation and chronic pain worldwide. Particularly in cases of knee osteoarthritis, mobility impairments are largely due to pain at the arthritic joint. During normal gait, forces across the knee joint peak during the weight acceptance and early midstance phases. Hence, providing damping at the knee joint during this period of the gait cycle may be effective in decreasing the joint forces and pain experienced by osteoarthritis patients while walking. This thesis focuses on the presence of Western historical music in contemporary video games. Through a combination of music-theoretical analysis, iconography, and Peircean semiotics, the author demonstrates that the nondiegetic soundtracks of fantasy role-playing video games utilize elements of major style periods in music history—including the Middle Ages, Renaissance, Baroque, and Classical eras—to enhance existing representations of time and place in their visual environments. This phenomenon is particularly apparent in three games, which serve as case studies: Baldur’s Gate 3 (2023), The Legend of Zelda: Breath of the Wild (2017), and Elden Ring (2022). Urban soil contaminated with anthropogenic sources of Pb is a major contributor to child Pb exposure. To assess the Pb risk in urban areas, composite samples were collected from 142 voluntary privately owned 142 residential parcels in Detroit, Hamtramck, and Highland Park, Michigan. Samples were collected at two time periods, before and after treatment applied for those denoted as treatment sites. Samples were collected from areas covered with turf grass on the parcels from the front, middle and rear sections. Shore leave for seafarers is generally accepted as a custom, if not a right, essential for well- being and pressure relief from the responsibilities of life on board. However, it is clear that the ability of seafarers to take shore leave has been seriously eroded and may even be facing extinction.
The combination of workload on board and limited time in port make it virtually impossible for seafarers to make time for shore leave. Commercial pressures have increased, and there is a serious risk that facilities available for seafarers will decline due to a lack of demand.

This report presents the outcomes of a cross-disciplinary Round Table hosted by the World Maritime University (WMU) from May 13-15, 2024, in Malmö, Sweden. The event brought together 51 experts from academia, industry, NGOs, and international organizations, including the IMO, to explore shipping’s role at the biodiversity-climate nexus. The Round Table had a particular focus on the impacts of shipping that are currently unregulated or under-regulated, and opportunities to address biodiversity loss and pollution as the sector decarbonizes. This Essay comes in response to the comments of Professors Margaret Chon, Cathay Smith, and David Taylor as part of the Texas A&M Journal of Property Law’s Symposium featuring a discussion on my book Intellectual Property and Immorality: Against Protecting Harmful Creations of the Mind.
