The Impact Of Management Control Systems On Innovation Performance In Healthcare Organizations, Abdel-Haleem Iyad Al-Kade
The Impact Of Management Control Systems On Innovation Performance In Healthcare Organizations, Abdel-Haleem Iyad Al-Kade
Dissertations
The healthcare sector is one of the largest industries in the world, at close to 10 percent of global GDP. Healthcare providers are facing complex challenges arising from advances in medical treatment, an increase in patients’ demands, and decreasing resources to fund and support their activities. Healthcare organizations have resorted to innovation as a means to achieving a balance between cost containment and healthcare quality. While innovation is believed to be a critical element of business productivity and competitive survival, its implementation comes with risk. A systematic approach to managing and controlling the innovation process is therefore required in order …

Enhancement Of Vegetative Growth And Nutrient Concentration Of Date Palm After Inoculation With An Isolate From Uae Of The Arbuscular Mycorrhizal Fungus Rhizoglomus Intraradices, Khuloud Nasser Mohammed Al Kayyoomi
Theses
The date palm (Phoenix dactylifera) is considered the main agricultural crop in many dry regions of the world, including the United Arab Emirates (UAE). It has been demonstrated that the date palm forms a beneficial symbiotic association with arbuscular mycorrhizal (AM) fungi. AM fungi are known to improve plant growth, increase nutrient uptake and assist plant growth under biotic and abiotic stress conditions. The main aim of the present study was to evaluate the efficiency at which an isolate of the AM fungus Rhizoglomus intraradices improves the vegetative growth and nutrient content of two date palm varieties in …

Ultra-Wideband Microstrip Antenna Enhanced Performance Using Metamaterial, Elham K. A Serria
Theses
Antenna engineering is very important in the development of communication systems and the requirements for low profile antennas that cover a wide spectrum of frequencies increase the number of researches in this field. Accordingly, scientists have focused on UWB microstrip antennas that cover the range from 3.1 GHz to 10.6 GHz but others concentrate on enhancing its performance using a special type of materials called metamaterials.
The main objective of this work is to enhance frequency bandwidth, antenna gain, and radiation pattern for the UWB circular microstrip antenna by employing the Split Ring Resonator (SRR) technique, which is one type …
Development Of Biodegradable -Polylactic Acid - Date Palm Waste Composite As Thermal Insulation Material, Mohamed Saeed Barkhad
Development Of Biodegradable -Polylactic Acid - Date Palm Waste Composite As Thermal Insulation Material, Mohamed Saeed Barkhad
Theses
This study aims to develop a green polymer composite from local natural waste, such as date pit powder (DPP) and date palm wood powder (DPWP), as an insulating material. The recycling and reuse of natural waste as filler for green insulation materials has many significant benefits for the environment of the UAE.
Date palm waste was mixed with a polylactic acid (PLA) polymer with various proportions in a melt extruder. The mixtures produced were then shaped differently after testing in a thermal compression machine. These composites were tested to evaluate their physical (water absorption, chemical resistance, and bulk density), thermal …

Functionality Assessment Of The Newly Discovered Arbuscular Mycorrhizal (Am) Fungus From Uae, Dominikia Emiratia, Laila Ahmed Al Dhaheri
Theses
Arbuscular mycorrhizal (AM) fungal species form symbiotic associations with the vast majority of terrestrial plants. These associations help plants to improve their water and nutrient uptake. In return, plants provide a suitable habitat for the fungi to flourish. From across the globe, approximately 300 AM fungal species have been described to date. Most recently, Dominikia emirate from UAE joined the list of known AM fungal species. It was found in Sweyhan, Abu Dhabi, associated with several plants within two different types of farming systems, namely organic and conventional. The discovery of the new species provides an opportunity for applied and …

The Ecological Impacts Of Climate Change In Hot Regions – Are Hawksbill Turtles Living Above Their Optimum Temperature In The Uae?, Obaid Ali Alshamsi
Theses
It is getting warmer throughout the world but it is not getting warmer by the same amount in all regions, leading to speculations that the biggest impact will be the impact on species living in the hot regions is widely assumed to be slight in comparison to the temperate and higher latitude regions. Temperature changes in hot regions are smaller, but it may be that the species in those regions have reached their optimum temperatures. In which case the effects of even a small temperature increase could be steeply negative. To test this thoroughly in terms of demographic parameters I …

If people avoid alternatives they dislike, a negative evaluative bias emerges because errorsof under-evaluation are unlikely to be corrected. Prior work that analyzed this mechanismhas shown that when the social environment exposes people to avoided alternatives (i.e. itmakes them resample them), then evaluations can become systematically more positive. In this paper, we clarify the conditions under which this happens. By analyzing a simple learning model, we show that whether additional exposures induced by the social environment lead to more positive or more negative evaluations depends on how prior evaluations and the social environment interact in driving resampling. We apply these …
Mr. Try-It Goes To Washington: Law And Policy At The Agricultural Adjustment Administration, Daniel R. Ernst
Mr. Try-It Goes To Washington: Law And Policy At The Agricultural Adjustment Administration, Daniel R. Ernst
Fordham Law Review
In December 1933, Jerome Frank, the general counsel of the Agricultural Adjustment Administration (AAA) but better known for writing Law and the Modern Mind (1930), a sensational attack on legal formalism, told an audience at the Association of American Law Schools a parable about two lawyers in the New Deal, each required to interpret the same ambiguous language of a statute. The first lawyer, “Mr. Absolute,” reasoned from the text and canons of statutory interpretation without regard for the desirability of the outcome. “Mr. Try-It,” in contrast, began with the outcome he thought desirable. He then said to himself, “The …
May Federal Prosecutors Take Direction From The President?, Bruce A. Green, Rebecca Roiphe
May Federal Prosecutors Take Direction From The President?, Bruce A. Green, Rebecca Roiphe
Fordham Law Review
Suppose the president sought to serve as prosecutor-in-chief, telling prosecutors when to initiate or dismiss criminal charges in individual cases and making other discretionary decisions that are normally reserved to trained professionals familiar with the facts, law, and traditions of the U.S. Department of Justice. To what extent may prosecutors follow the president’s direction? In recent presidential administrations, the president has respected prosecutorial independence; while making policy decisions, the president deferred to the Attorney General and subordinate federal prosecutors to conduct individual criminal cases. In a recent article, we argued that this is as it should be because the president …
Hidden Nondefense: Partisanship In State Attorneys General Amicus Briefs And The Need For Transparency, Lisa F. Grumet
Hidden Nondefense: Partisanship In State Attorneys General Amicus Briefs And The Need For Transparency, Lisa F. Grumet
Fordham Law Review
In all fifty states, the State Attorney General (SAG)—as the state’s chief legal officer—is charged with defending state laws that are challenged in court. If an SAG declines to defend or challenges a state law on the ground that it is unconstitutional—an action scholars describe as “nondefense”— the SAG ordinarily will disclose this decision to the public. This Essay discusses a hidden form of nondefense that can occur when SAGs file amicus curiae briefs on behalf of their states in matters before the U.S. Supreme Court. Surprisingly, some SAGs have joined multistate amicus briefs that support invalidating other states’ laws …

All Watched Over By Machines Of Loving Grace: Border Searches Of Electronic Devices In The Digital Age, Sean O'Grady
All Watched Over By Machines Of Loving Grace: Border Searches Of Electronic Devices In The Digital Age, Sean O'Grady
Fordham Law Review
The border search exception to the Fourth Amendment has historically given the U.S. government the right to conduct suspicionless searches of the belongings of any individual crossing the border. The federal government relies on the border search exception to search and detain travelers’ electronic devices at the border without a warrant or individualized suspicion. The government’s justification for suspicionless searches of electronic devices under the traditional border search exception for travelers’ property has recently been called into question in a series of federal court decisions. In March 2013, the Ninth Circuit in United States v. Cotterman became the first federal …
Differentiating Legislative From Nonlegislative Rules: An Empirical And Qualitative Analysis, Nadav D. Ben Zur
Differentiating Legislative From Nonlegislative Rules: An Empirical And Qualitative Analysis, Nadav D. Ben Zur
Fordham Law Review
The elusive distinction between legislative rules and nonlegislative rules has frustrated courts, motivated voluminous scholarly debate, and ushered in a flood of litigation against administrative agencies. In the absence of U.S. Supreme Court guidance on the proper demarcating line, circuit courts have adopted various tests to ascertain a rule’s proper classification. This Note analyzes all 241 cases in which a circuit court has used one or more of the enunciated tests to differentiate legislative from nonlegislative rules. These opinions come from every one of the thirteen circuits and span the period of the early 1950s through 2018. This Note identifies …

Dignity And Social Meaning: Obergefell, Windsor, And Lawrence As Constitutional Dialogue, Steve Sanders
Fordham Law Review
The U.S. Supreme Court’s three most important gay and lesbian rights decisions—Obergefell v. Hodges, United States v. Windsor, and Lawrence v. Texas—are united by the principle that gays and lesbians are entitled to dignity. Beyond their tangible consequences, the common constitutional evil of state bans on same-sex marriage, the federal Defense of Marriage Act, and sodomy laws was that they imposed dignitary harm. This Article explores how the gay and lesbian dignity cases exemplify the process by which constitutional law emerges from a social and cultural dialogue in which the Supreme Court actively participates. In doing …
Legal Dilemmas Facing White House Counsel In The Trump Administration: The Costs Of Public Disclosure Of Fisa Requests, Peter Margulies
Legal Dilemmas Facing White House Counsel In The Trump Administration: The Costs Of Public Disclosure Of Fisa Requests, Peter Margulies
Fordham Law Review
Not every presidential administration can forge a new brand of government lawyering. Historically, government lawyering has swung between two poles: (1) dialogic lawyering, which stresses reasoned elaboration, respect for institutions, and continuity with unwritten norms embodied in past practice; and (2) insular lawyering, which entails opaque definitions, disregard of other institutions, and departures from unwritten norms. Because President Trump regularly signals his disdain for institutions, such as the intelligence community, and unwritten norms, such as prosecutorial independence, senior lawyers in the White House have added a new mode of legal representation that entails ad hoc adjustments to President Trump’s mercurial …

Professionals, Politicos, And Crony Attorneys General: A Historical Sketch Of The U.S. Attorney General As A Case For Structural Independence, Jed Handelsman Shugerman
Fordham Law Review
Historically, the office of the U.S. Attorney General has been identified as “quasi-judicial” or having “quasi-judicial” aspects. Other parts of the Department of Justice (DOJ) have also been described as quasi-judicial, such as the Office of Legal Counsel and the Solicitor General. A glance at a list of past attorneys general seems to confirm this judicial aspiration in practice. Nine attorneys general became U.S. Supreme Court justices, and others were notably judicious and professional in their tenure in the office. Of course, there are some infamous examples of unprofessional cronyism—the appointment of friends or associates to positions of authority, without …
Disagreeing Over Agreements: A Cross-Sectional Analysis Of No-Poaching Agreements In The Franchise Sector, Catherine E. Schaefer
Disagreeing Over Agreements: A Cross-Sectional Analysis Of No-Poaching Agreements In The Franchise Sector, Catherine E. Schaefer
Fordham Law Review
In October 2016, the Department of Justice Antitrust Division announced its intent to proceed criminally against parties to no-poaching agreements, or agreements between or among employers not to hire each other’s workers. Consequently, a wave of class action antitrust lawsuits has raised questions about the legality of no-poaching or no-hire provisions that certain franchised food businesses use. Fast-food restaurant chains, including McDonald’s, Carl’s Jr., and Pizza Hut, have recently found themselves embroiled in such litigation. This Note examines prior antitrust litigation involving no-poaching agreements between companies and discusses the differences and similarities between these cases and the cases involving franchised …
Reevaluating School Searches Following School-To-Prison Pipeline Reforms, Josh Gupta-Kagan
Reevaluating School Searches Following School-To-Prison Pipeline Reforms, Josh Gupta-Kagan
Fordham Law Review
The U.S. Supreme Court held in New Jersey v. T.L.O. that school officials could search students without a warrant and with only reasonable suspicion, not probable cause, because of schools’ need for discipline and the relationship between educators and students. That case belongs to a body of Fourth Amendment cases involving, in T.L.O.’s terms, “special needs, beyond the normal need for law enforcement.” What Fourth Amendment standard, then, governs searches involving one of the roughly 20,000 school resource officers (SROs) in American schools? Most state courts to decide the issue in the 1990s and 2000s found that T.L.O. applied to …

Elevated blood pressure (BP) is a growing burden worldwide, leading to over 10 million deaths each year. May Measurement Month (MMM) is a global initiative aimed at raising awareness of high BP and to act as a temporary solution to the lack of screening programs worldwide. Hypertension is a global health concern for developing countries. In Pakistan, apart from few population-based studies which evaluated the prevalence of hypertension, there is no current nationally representative study (the latest nationwide survey was conducted more than two decades ago). Pakistan Hypertension League, in accordance with the International Society of Hypertension directive under the …

Deciphering The Molecular Mechanism Through Which Rhus Coriaria Exerts Its Anti-Cancer Activity, Khawlah Najib Saeed Athamneh
Dissertations
Cancer remains a major health problem around the globe. Among various types of treatments, plants have been shown to have great capacity in cancer treatment, one of which is Rhus coriaria. Commonly known as sumac, Rhus coriaria is a culinary herb that is known to possess different therapeutic values including anti-oxidant and anti-microbial activities.
In this Ph.D. project, we tested the effect of Rhus coriaria extract (RCE) on the migration, invasion, and metastasis of MDA-MB-231 human breast cancer cells. We showed that non-cytotoxic concentrations of RCE inhibited migration and invasion, blocked adhesion to fibronectin, and downregulated MMP-9. Additionally, we found …

In line with Vision 2021, the UAE’s National Agenda has six pillars: providing world-class healthcare is one of them. It is hence not surprising that the UAE healthcare industry is allocating substantial weight to the element of quality. Patient-centered care is internationally becoming part of the quality domain. Patient-centered quality may be defined as “providing the care that the patient needs in the manner the patient desires at the time the patient desires”. This requires substantially more attention to learning about patients’ preferences. One of the main dimensions of patient-centered quality is timely access to care, which includes shorter waiting …

Are Police Obsolete? Breaking Cycles Of Violence Through Abolition Democracy, V. Noah Gimbel, Craig Muhammad
Cardozo Law Review
On February 5, 2018, Baltimore activists organized a successful "cease-fire weekend," during which no one was killed-and the cops were not to thank. Indeed, as community anti-violence organizers worked to cool hot feuds in order to prove that endless violence was not their destiny, the Baltimore Police Department was sinking ever-deeper into perhaps the most shocking police corruption scandal of the twenty-first century.
The stark contrast between ordinary city residents risking their safety to fight against violence in their community and a corrupt police force committing and propagating acts of violence in the microcosmic streets of Baltimore raises what may …

On April 4, 2015, Police Officer Michael Slager gunned down Walter Scott in North Charleston, South Carolina with a cool that resembled target practice. Scott's name joined a heartbreaking list of men of color killed by unjustified police violence. The video of the incident also broadcast to the world the spectacular violence always lurking beneath the surface of daily interactions between police and men of color.
The "Black Lives Matter" movement has fiercely insisted Scott's death not be viewed as an isolated incident but understood as woven into the fabric of American policing. American policing harms individual people of color, …
Defending White Space, Addie C. Rolnick
Defending White Space, Addie C. Rolnick
Cardozo Law Review
Police violence against minorities has generated a great deal of scholarly and public attention. Proposed solutions-ranging from body cameras to greater federal oversight to anti-bias training for police-likewise focus on violence as a problem of policing. Amid this national conversation, however, insufficient attention has been paid to private violence. This Article examines the relationship between race, self-defense laws, and modern residential segregation. The goal is to sketch the contours of an important but undertheorized relationship between residential segregation, private violence, and state criminal law. By describing the interplay between residential segregation and modern self-defense law, this Article reveals how criminal …
Re-Examining Custody And Incarceration Requirements In Postconviction Dna Testing Statutes, Ian J. Postman
Re-Examining Custody And Incarceration Requirements In Postconviction Dna Testing Statutes, Ian J. Postman
Cardozo Law Review
Part I describes the history of custody and incarceration requirements in PC DNA testing statutes, as well as the interaction between those requirements and state sex offender registration acts. Part II analyzes a number of custody and incarceration requirements across various states. Part III proposes the elimination of custody requirements from PC DNA testing statutes and rebuts concerns about removing these requirements. Ultimately, this Note argues that custody and incarceration requirements specifically harm those who have been wrongly convicted of sex offenses, and the requirements' fundamental incongruity with the goals of PC DNA testing support their complete elimination from PC …
