Defending White Space, Addie C. Rolnick Apr 2019

Defending White Space, Addie C. Rolnick

Cardozo Law Review

Police violence against minorities has generated a great deal of scholarly and public attention. Proposed solutions-ranging from body cameras to greater federal oversight to anti-bias training for police-likewise focus on violence as a problem of policing. Amid this national conversation, however, insufficient attention has been paid to private violence. This Article examines the relationship between race, self-defense laws, and modern residential segregation. The goal is to sketch the contours of an important but undertheorized relationship between residential segregation, private violence, and state criminal law. By describing the interplay between residential segregation and modern self-defense law, this Article reveals how criminal …

Re-Examining Custody And Incarceration Requirements In Postconviction Dna Testing Statutes, Ian J. Postman Apr 2019

Re-Examining Custody And Incarceration Requirements In Postconviction Dna Testing Statutes, Ian J. Postman

Cardozo Law Review

Part I describes the history of custody and incarceration requirements in PC DNA testing statutes, as well as the interaction between those requirements and state sex offender registration acts. Part II analyzes a number of custody and incarceration requirements across various states. Part III proposes the elimination of custody requirements from PC DNA testing statutes and rebuts concerns about removing these requirements. Ultimately, this Note argues that custody and incarceration requirements specifically harm those who have been wrongly convicted of sex offenses, and the requirements' fundamental incongruity with the goals of PC DNA testing support their complete elimination from PC …

Sexual Ageplay In Virtual Reality: Practicing Free Speech Or Producing Child Pornography?, Lillian Esposito Apr 2019

Sexual Ageplay In Virtual Reality: Practicing Free Speech Or Producing Child Pornography?, Lillian Esposito

Cardozo Law Review

A man's thoughts are his own; he may sit in his armchair and think salacious thoughts, murderous thoughts, discriminatory thoughts, whatever thoughts he chooses, free from the "thought police." It is only when the man gets out of his armchair and acts upon his thoughts that the law may intervene

In my ignorance, I have to accept the possibility that if we had to decide today just what the First Amendment should mean in cyberspace, we would get it fundamentally wrong.

When Sharing Is Not Caring: Creating An Effective Criminal Framework Free From Specific Intent Provisions To Better Achieve Justice For Victims Of Revenge Pornography, Ava Schein Apr 2019

When Sharing Is Not Caring: Creating An Effective Criminal Framework Free From Specific Intent Provisions To Better Achieve Justice For Victims Of Revenge Pornography, Ava Schein

Cardozo Law Review

Part I of this Note lays out the elements and effects of the perpetration of revenge porn. Part I additionally highlights the inadequacies of civil and copyright channels for remedying revenge porn perpetration and sets up the preconditions and justifications for the criminalization of revenge porn. Part II presents an overview of the current state of the criminal revenge porn scheme and analyzes the shortcomings of statutes employing specific intent provisions. Part II posits that vindictive motive clauses do more to hinder victims' access to justice than they do to facilitate it, as they are problematically narrowing, duplicative, and even …

Lgbtqia+ Campus Climate At A Small Liberal Arts University: An Exploratory Study With The Aim Of Improving The Environment For Queer Students, Mary Amanda Breeden Apr 2019

Lgbtqia+ Campus Climate At A Small Liberal Arts University: An Exploratory Study With The Aim Of Improving The Environment For Queer Students, Mary Amanda Breeden

Honors Projects

Research suggests that a significant portion of LGBTQIA+ individuals report that their sexual orientation and/or gender identity play a substantial role in choosing which postsecondary institution to attend; thus, it is incumbent upon institutions for higher education to assess their respective campus climates. This project evaluates LGBTQIA+ campus climate at a small, private, Midwestern liberal arts university. Utilizing a grounded theory approach, I interviewed my queer-identified classmates – selected via a combination of strategic and snowball sampling – about their experiences on campus. Through these discussions, I gained a better understanding of queer students’ experiences within the classroom, extracurricular activities, …

Absolutely Free?: Frank Zappa’S Musical Assault On American Conformity, 1966-1968, Brandon Chopp

Honors Projects, History

Throughout his career, American composer Frank Zappa (1940-1993) expounded the potency of music in regard to the medium’s inherent ability to enact critical assessments of society. Zappa’s music exemplified many new possibilities in popular music that have influenced generations of musicians to push the boundaries of the media format. In the context of the Counterculture of the 1960s, Zappa utilized his initial, experimental rock albums, Freak Out! (1966), Absolutely Free (1967), and We’re Only in It for the Money (1968), with his band, The Mothers of Invention, to demonstrate his vision for the United States during the 1960s and beyond. …

Effects Of Weighted Blankets On College Students’ Anxiety, Amy Clapp Apr 2019

Effects Of Weighted Blankets On College Students’ Anxiety, Amy Clapp

Honors Projects

Background: Many mental health disorders, including anxiety, are identified during young adulthood when students are beginning college. Therapies such as weighted blankets may provide anxiety relief, but information about the use of weighted blankets for students is lacking.

Purpose: To compare the effect of weighted versus regular blankets on anxiety, sleep, and GPA in a sample of undergraduate students.

Conceptual framework: Measurements were operationalized through the Overall Anxiety Severity and Impairment Scale (OASIS).

Methods: A pilot study using a convenience sample with random assignment was conducted. Participants (N = 32) self-identified as belonging to one of …

An Exploration Of How Early Years Managers And Staff Are Responding To The Needs Of Children Experiencing Homelessness, Jacinta Corcoran Apr 2019

An Exploration Of How Early Years Managers And Staff Are Responding To The Needs Of Children Experiencing Homelessness, Jacinta Corcoran

Dissertations

Homelessness in Ireland has increased rapidly over recent years with children and families making up increasing proportions of the numbers recorded whilst single parent families are representing a disproportionate number of families experiencing homelessness. Consequently many early years services are supporting unprecedented numbers of children who are experiencing homelessness to engage and fully participate in early education programmes. The experience of homelessness can permeate many levels and various aspects of a child’s life particularly when historical risks and adversities are to be factored. Within this context this study guided by an ecological framework explores the range of influences on the …

Toward Quality Preceptorship: A Dyad Sudy, Laurie Ann Kunkel-Jordan Apr 2019

Toward Quality Preceptorship: A Dyad Sudy, Laurie Ann Kunkel-Jordan

Dissertations (1934 -)

Problem: Approximately 70% of newly graduated nurses work in hospital settings, but their turnover rates are high, costly to employers, and due, in part, to lack of satisfaction with job orientation processes. Effective preceptorship is widely regarded as pivotal to newly graduated nurses’ successful transition to the professional nurse role; yet, the critical elements of preceptorship have not been empirically determined. Numerous researchers proffer the preceptor - newly graduated nurse interpersonal relationship as key, but preceptorship research has not been focused on this dyadic interaction. Consequently, its true impact remains unknown. Accordingly, this study addressed the following research question, “Are …

How Much Of A Therapy Session Must Be Viewed To Judge Interpersonal Qualities Of The Therapist?, Rivian Kenyan Lewin Apr 2019

How Much Of A Therapy Session Must Be Viewed To Judge Interpersonal Qualities Of The Therapist?, Rivian Kenyan Lewin

Electronic Theses and Dissertations Archive

Common factors, elements of therapy not related to a specific theoretical orientation, are often measured through observer ratings of video-recorded therapy sessions that vary in length. Researchers have shown that judgments based on short interactions—called "thin slices"—are highly predictive of judgments based on longer or the entirety of these interactions. This study investigated the amount of a psychotherapy interaction observers must view to judge psychotherapy constructs—therapeutic alliance, empathy, and treatment expectations—and the semantic dimensions of evaluation, potency, and activity. Subjects included 48 therapists, each observed in a therapy session with a unique client. Observers rated the therapist after viewing either …

A Phenomenological Study Of Elementary Principal Experiences With School Improvement In The Age Of Accountability, Leigh Ann Bramlett Sears Apr 2019

A Phenomenological Study Of Elementary Principal Experiences With School Improvement In The Age Of Accountability, Leigh Ann Bramlett Sears

Doctoral Dissertations and Projects

The purpose of this transcendental phenomenological study was to describe elementary principals’ experiences with school improvement in Northeast Georgia Title I schools. The theory guiding this study was Bandura’s (1977) social learning theory, which explains a triadic view of behavioral, environmental, and personal factors. Reciprocal interactions between factors contribute to self-efficacy beliefs associated with future action to achieve goals such as those in a Title I School Improvement Plan. Triadic reciprocal determinism was defined as cooperative, interdependent components shaping principals’ knowledge, skill, and direction to lead changing federal and state mandated school improvement initiatives. This study attempted to answer the …

Incorporating A Pedagogy Of Worship In The Community Group Ministry Of Grace Bible Church, Jeremy G. Sauskojus Apr 2019

Incorporating A Pedagogy Of Worship In The Community Group Ministry Of Grace Bible Church, Jeremy G. Sauskojus

Doctoral Dissertations and Projects

Many local church fellowships have embraced small groups (life groups, community groups) as a means of connecting people with one another from within the larger church body. These small groups are a means of building community. Furthermore, many churches testify to the importance of pursuing worship as much more than music in the corporate worship gathering that takes place once a week. However, very little has been done to connect these two components together in the small group ministry environment. As will be presented, people have written concerning each one of these important elements of church body life. Yet, connecting …

An Alcohol Questionnaire And Referral Tool For Baptist Churches, Rita D. Moore Apr 2019

An Alcohol Questionnaire And Referral Tool For Baptist Churches, Rita D. Moore

Doctoral Dissertations and Projects

Alcohol addiction is a pervasive ill within our society with detrimental bio-psycho-social outcomes. Unfortunately, the Baptist churches or more specifically those churches who are members of the Baptist General Association of Virginia (BGVA) are not immune to seeing the devastation of this disease, including the spiritual impact. Pastors may find themselves in the role of “first responder” unprepared to fully address this issue. This study explored, through a web-based questionnaire, how those churches associated with the BGVA are currently addressing alcoholism and if pastors would find a referral tool helpful to connect members with professional therapists. It is widely accepted …

Using Groundwater Modeling To Assess Groundwater And Stream Connectivity In A River Restoration Application, John Joseph Lunzer Apr 2019

Using Groundwater Modeling To Assess Groundwater And Stream Connectivity In A River Restoration Application, John Joseph Lunzer

Graduate Theses & Non-Theses

Historic placer mining operations along the Middle Fork John Day River (MFJD) north of Galena, Oregon have left the MFJD channel straightened, incised and lacking in riverbed structure. This lack of riverbed structure makes this stretch of the MFJD poor habitat for trout and migrating salmon. In order to restore this stretch of the MFJD to better serve aquatic species, Inter-Fluve Inc. (IF), United States Forest Service (USFS) and The Freshwater Trust (TFT) will be performing restoration to both the MFJD channel as well as Bear Creek, a tributary of the MFJD. The proposed restoration work will consist of re-routing …

Horizontal Flow Loop Design For The Study Of Drill String Rotation Effects On Cuttings Transport, David C. Rathgeber Apr 2019

Horizontal Flow Loop Design For The Study Of Drill String Rotation Effects On Cuttings Transport, David C. Rathgeber

Graduate Theses & Non-Theses

Exploration and Production companies are continually focusing more time, energy and resources into Extended Reach Drilling in order to maximize reservoir production while minimizing both environmental impact and development costs. These long laterals (2:1 Measured Depth: True Vertical Depth) are often more difficult to drill and can be severely impacted by inadequate drilling practices. Cuttings transport efficiency is a critical parameter of Extended Reach Drilling operations, and poor wellbore cleaning can lead to excessive torque, drag, and several other serious downhole problems.

Although many studies have been performed that identify the importance of drill string rotation on cuttings movement, there …

Checking In, Concussions Out: Body Checking As A Way Of Reducing Concussion Rates, Griffin Germond Apr 2019

Checking In, Concussions Out: Body Checking As A Way Of Reducing Concussion Rates, Griffin Germond

All Student Scholarship

Women’s college ice hockey, according to a study released by the NCAA in 2014, has the highest rate of self-reported concussions of any collegiate sport, men’s or women’s. This is shocking, considering the fact that body checking is illegal in women's ice hockey. Why are these rates so high when there isn't body checking? This investigative research project aims to realize a novel approach at reducing concussion rates in women’s ice hockey by doing the unexpected: Allowing body checking. If body checking were allowed, this would reduce the rate of concussions if it were to be implemented and taught under …
