Evidence Struggles: Legality, Legitimacy, And Social Mobilizations In The Catalan Political Conflict, Susana Narotzky

Different kinds of evidence are put forward to make an argument and justify political action by agents situated in diverse social, cultural, and power positions. The Catalan political conflict is a case in point. The central Spanish government's arguments are mostly of a juridical nature and rest on the anti-constitutionality of the Catalan government and other civil society organizations' actions. Instead, most arguments of Catalan supporters of independence are based on historical interpretations of grievances referring to national institutions and identity. Rising Authoritarianism(S) And The Globalization Of Law: An Initial Exploration, Z. Umut Türem

This article explores the question "what does the future hold for the globalization of law?" In analyzing the future of legal globalization, I suggest that analyzing the recent rise of authoritarianism, both at the national as well as transnational plane, offers significant insights. I make three related observations regarding the rise of authoritarian politics. First, the rise of authoritarian and semi-authoritarian regimes and the blend of populism with authoritarianism at the national contexts seems to obstruct globalization of law. During the spring of 2015, thousands of migrants began to arrive daily on the shores of Lesvos, Greece, from nearby Turkey. As the Greek government and the European Union (EU) monitored the unfolding situation, diverse ad hoc humanitarian projects flourished on the island. These projects enacted a field of action grounded in intersecting, concerning effects and values of care. This essay considers the challenges these projects posed to the local, national, and transnational humanitarian apparatus that eventually moved in and attempted to regulate these players. This study examines why courts made sense to those who established them and how the courts' authority is being utilized. For relatively powerless and resource-poor litigants, barriers to litigation may be many, but when these barriers are overcome, administrative courts exercise extraordinary influence, even when they fail to render a decision fully vindicating a plaintiffs legal rights. Countless lives were transformed by the war that split the nation, and many stories are yet to be revealed about how the Civil War and the Reconstruction era affected Kentuckians. One such narrative is that of Sandy Holt, who, in the summer of 1864, joined tens of thousands of former slaves and enlisted in the United States Colored Troops. He put his life on the line to secure the Union's survival and the end of slavery. The People’s Guide to the Queens International was a collaborative art project organized by Brian Droitcour and Christine Wong Yap. We invited the public to write reviews of artworks in the Queens International 2018 exhibition. We offered many writing prompts, available in a purpose-built writing desk in our installation, prompts available in three Queens Museum galleries, and prompts housed in miniature kiosks with submission boxes at Queens Public Libraries at Flushing, Le Frak City, and at the Central branch in Jamaica. Prompts were available in Chinese, Spanish, and Russian. We also facilitated writing workshops at the museum and libraries.

Secession seems like a concept of the past. In our increasingly globalizing world, nationalism was growing archaic and halting progress. But secession has seen a surge in the last ten years. Kosovo declared independence from Serbia in 2008. The United Kingdom seceded from the European Union in the infamous "Brexit." The U.S.A. P.A.T.R.I.O.T. Act is legislation that simultaneously brings into being very particular notions of the American 'national' and, as its counterpart, a post-9/11 "global." Through a study of the Patriot Act, my paper unpacks the co-constitutions of national/global and a related series of binaries: domestic/foreign; patriot/terrorist; us/them; and innocence/evil. By exploring the structuring logics and language of these binaries in the Act, my paper scrutinizes the global role of U.S. legislative text in our world: a world in which "a global society has come into being but possesses as yet, no institutions proper to its name."1 In the context …

This Paper addresses the legal consequences that surface when a consumer uses a product in a manner not specifically intended by that product’s designer or manufacturer. If a product is used in a reasonably foreseeable manner, the fact that the use is at odds with a manufacturer’s intention should not be a basis to deny tort liability or limit the regulatory options of the Consumer Product Safety Commission. This Article examines and analyzes the law of consignments from the common law through Revised Article 9 with a goal towards identifying and analyzing the uncertainties and confusion that have persisted throughout the transition from the common law to the UCC. The law of consignments has abounded with uncertainty since its genesis under common law. In an attempt to clarify the persistent confusion and disarray surrounding the law, the UCC enacted section 2-326; but the statute was not a model of clarity, engendering increased uncertainty and confusion. For those who suffer from the most serious mental illnesses, access to mental healthcare is critically important, but often frustrated by a Byzantine insurance system. The goal of this Note is to sift through the various mental health insurance parity laws, both nationally and statewide, and determine where this system breaks down. The Note will argue that lack of enforcement of parity laws plays a critical role in much of the dysfunction in the marketplace.

Reforming The Charitable Contribution Tax Deduction: Accounting For Random Acts Of Charity, Janene R. Finley

Concern for the tax treatment of charitable contributions has increased as a result of the Tax Cuts and Jobs Act of 2017. Although the new law increased the limitation of deductible charitable contributions to 60 percent of adjusted gross income, the standard deduction was also increased. Increasing the standard deduction is expected to reduce the number of taxpayers who are able to itemize their deductions in the next tax year, which is expected to reduce charitable giving in the future. Systems Science Friday Noon Seminar Series

Inspired by Latour's work in social studies of science and technology, Callon, MacKenzie and others developed a performativity critique of economics. Building on this, Healy (2015) recently discussed the performativity of network models. While useful, I move away from French continental philosophy to avoid unavoidable comparisons with Foucauldian conceptions of performativity. Instead, I use ideas from vanilla historical sociology of science and technology and cognitive science to understand performativity.

I first discuss Healy's critique of network models. Keeping with the worst traditions in systems science, I greedily apply this concept to all models in science and engineering by first critiquing …

Heightened anxiety can increase a child′s experience of post-operative pain. An evidence-based, non-pharmacologic method of anxiety and pain management was implemented for children with lower extremity trauma of a 3-month period. Pain medication use, pain ratings, length of stay, and number of physical therapy sessions will be compared.
