An Environmental History Of Fairfield/Wagner Point, Philip Diamond
An Environmental History Of Fairfield/Wagner Point, Philip Diamond
Legal History Publications
This paper traces the history of the Fairfield/Wagner Point peninsula from the beginning of the European settlement to the present, observing the ambitions and dreams of developers and industrial entrepeneurs, the significant contribution the area made to our nation's wartime production in World War II, the rise and fall of the tight-knit workers' communities, the struggles of outside activists and community leaders to better the living conditions of these neighborhoods, and the environmental devastation of the area followed by the attempt to redevelop the area with “green" industry. The Effects Of Inadequate Mental Health Resources On The Operation Of The Mental Disorder Provisions, Giuseppa Bentivegna
The Effects Of Inadequate Mental Health Resources On The Operation Of The Mental Disorder Provisions, Giuseppa Bentivegna
LLM Theses
In this thesis, I focus on whether adequate mental health resources exist and are available to a category of persons in the forensic mental health system--those found not criminally responsible on account of mental disorder of an offence under the mental disorder provisions, Part XX.1, of the 'Criminal Code '. I argue that adequate mental health services which address the needs of accused persons are necessary for the proper functioning of the mental disorder provisions of the 'Code'. I argue that these provisions were designed to foster the release and re-integration into society of persons within this system as quickly …

Constitutional Law - Criminal Procedure - Fourth Amendment - Ordering Passengers Out Of Vehicle During Traffic Stop, Brian M. Silver
Constitutional Law - Criminal Procedure - Fourth Amendment - Ordering Passengers Out Of Vehicle During Traffic Stop, Brian M. Silver
Duquesne Law Review
The Supreme Court of the United States held that a police officer who orders passengers to exit a vehicle until completion of a traffic stop does not violate the Fourth Amendment to the United States Constitution because the public interest in the safety of law enforcement personnel outweighs an individual's right to be free from arbitrary interference.

The World Trade Organization And States' Rights: Will Foreign Threats Over Massachusetts' Burma Law Lead To A Domsetic Backlash Against International Trade Agreements, Brian Owens
UC Law SF International Law Review
This Note argues that the WTO's current dispute resolution system creates sovereignty tensions between member nations that are afforded a host of protections and their sub-national entities which do not have comparable protections. For example, states and other sub-national governments do not have standing before the WTO. They can neither bring a dispute before the WTO nor defend themselves against an attack on their domestic laws from WTO member nations.
This lose of state sovereignty to binding international agreements is exemplified by Massachusetts, which recently passed a law barring public agencies from doing business with any companies investing in Burma. …
