Censorship In Chinese Cinema, Mary Lynne Calkins Jan 1998

Censorship In Chinese Cinema, Mary Lynne Calkins

UC Law SF Communications and Entertainment Journal

With any film or play produced in China receiving close government scrutiny at each step of production, this article examines censorship in Chinese cinema in an attempt to make sense of a tradition of sometimes seemingly arbitrary decisions by the authorities. Film, as a particularly visible and communicative media, is particularly subject to governmental interference, and the Chinese government has exploited that vulnerability to the fullest. This article attempts to demonstrate that China takes a similar approach to film censorship as it does to contracts, in the sense that censorship involves continual "negotiations" rather than binding agreement, and in the …

Tribute, Jeffrey L. Salinger Jan 1998

I remember sitting in the law auditorium late in our first semester of law school. Listening to a handful of professors, we heard about the electives offered for second semester. I am not sure how I felt prior to entering the auditorium that day. I do remember how I felt afterwards -- I was going to get into Professor Clark’s class. From what I’ve heard, her legal history seminar was by far the most highly coveted of the first-year electives. That’s no surprise, though -- you could almost feel her excitement as she spoke about the course. On hearing that …

Tribute, Bridget J. Crawford

Tributes

I spent my third year of law school in 1995-1996 at Boston University as a visiting student from the University of Pennsylvania Law School. Although personal reasons brought me to Boston that year, one reason brought me to B.U. -- Betsy Clark, a scholar whose work I had long admired and who had agreed to take me on as her student. I knew what a top-notch historian Betsy was, but I could not have known when I arrived at B.U. what a great teacher, generous mentor, and kind friend she would be.

"The Boys'll Listen To Me": The Labor Career Of William Blizzard, Shae Ronald Davidson Jan 1998

"The Boys'll Listen To Me": The Labor Career Of William Blizzard, Shae Ronald Davidson

Theses, Dissertations and Capstones

In the Fall of 1892, Timothy and Sarah Blizzard gave birth to a son. Timothy and Sarah began their family during a transitional period in West Virginia’s history. The couple started their lives as farmers. However, the potential income from West Virginia’s coal industry encouraged them to abandon this lifestyle and to plunge into the new industrial economy. Timothy became a miner, while Sarah took on the role of a mother living in a company town. Both became involved in the earliest organization drives of United Mine Workers of America (UMWA), whose efforts to organize the state had started only …

International Legal Careers: Paths And Directions, James R. Maxeiner Jan 1998

International Legal Careers: Paths And Directions, James R. Maxeiner

Syracuse Journal of International Law and Commerce

This contribution first advances the hypothesis that there is no acknowledged path to a career in international legal practice. It then considers the value of international credentials in general in the light of that hypothesis. Finally, it discusses certain education and employment decisions one must make early in one's career.

The European Intergovernmental Conference: An American Perspective, George A. Bermann Jan 1998

The European Intergovernmental Conference: An American Perspective, George A. Bermann

Syracuse Journal of International Law and Commerce

the European IGCs invariably also hold interest from a comparative constitutional law perspective. Judged in these terms, the IGC is a highly curious phenomenon. This article seeks to sketch what appear to be the most salient characteristics of the intergovernmental conference as a general instrument of constitutional reform. In so doing, it also examines the fruits of the latest intergovernmental conference-the IGC that opened in Turin, Italy, in March 1996 and culminated in the Amsterdam Treaty of 1997. Finally, it implies some of the ways in which the intergovernmental conference, as a vehicle for constitutional reform, might in the future …

The Presidency Of The Council Of The European Union, Bernhard Schloh Jan 1998

The Presidency Of The Council Of The European Union, Bernhard Schloh

Syracuse Journal of International Law and Commerce

There are five distinctive functions of the Presidency of the Council. They are: as manager of Council business; as a source of political initiatives; as a package-broker in negotiations; as a point of contact with other Community institutions; and as a representative of the Community in external relations. In the following pages, the first three of these functions will be grouped under the heading "The Presidency of the Council, internally," with two subheadings: General considerations, and; Specific comments respectively. The fourth will be enlarged to allow a discussion of the presidency of the European Council, and the fifth has obviously …

U.S. Income Taxation Of Foreign Parties: A Primer, Ernest R. Larkins Jan 1998

U.S. Income Taxation Of Foreign Parties: A Primer, Ernest R. Larkins

Syracuse Journal of International Law and Commerce

Over the last five years for which data are available, the number of foreign corporations showing net income on Form 1120F, U.S. Income Tax Return of a Foreign Corporation, has increased 36.5 percent. [1] In addition, the number of individuals granted temporary stays in the United States as non-immigrants has steadily increased from 9.5 million in 1985 to 24.8 million in 1996, an average annual increase of 9.1 percent. [2] These increases evidence growing opportunities to serve international clients and suggest that tax professionals must have a fundamental working knowledge of the way the U.S. tax system treats foreign parties. …

Free Lunch Or Cheap Fix?: The Emissions Trading Idea And The Climate Change Convention, David M. Driesen Jan 1998

Free Lunch Or Cheap Fix?: The Emissions Trading Idea And The Climate Change Convention, David M. Driesen

College of Law - Faculty Scholarship

Emissions trading has become a key component of U.S. environmental legal regimes. The U.S. has successfully lobbied to make international environmental benefit trading, an expanded form of emissions trading, a part of international efforts to address the threat of global climate change through the Framework Convention on Climate Change and the Kyoto Protocol to that Convention. Legal scholars have lauded emissions trading as a "free lunch" that will encourage innovation, enhance democratic accountability, and reduce the cost of environmental cleanup. This article argues that emissions trading functions as a cheap fix, reducing short-term costs while tending to lessen innovation and …

Public Schools' Pyrrhic Victories Over Parental Rights, Michael Farris, Bradley P. Jacob Jan 1998

Public Schools' Pyrrhic Victories Over Parental Rights, Michael Farris, Bradley P. Jacob

Richmond Journal of Law and the Public Interest

This article explores the historical roots of parental rights in education, and then demonstrates that Professors Uerling and Strope are quite correct when they declare parental rights in public education to be "almost extinct." Next, it examines the stark contrasts between the rights of public school parents and those of parents who choose private and home schooling. Finally, this article suggests that since the constitutionality of educational choice, including choices involving religious schools, has been established beyond any legitimate question, public school advocates and courts should rethink their position concerning parental rights within public education lest they contribute to the …
