Cumming V. Richmond County Board Of Education: The Great Dissenter's Great Betrayal, Mark Dorosin
Cumming V. Richmond County Board Of Education: The Great Dissenter's Great Betrayal, Mark Dorosin
Duquesne Law Review
Justice John Marshall Harlan's place in legal history was established by his impassioned and eloquent dissents defending the civil rights of Black Americans in The Civil Rights Cases1 and Plessy v. Ferguson.2 The former slave owner's powerful and solitary dissents in those cases, and in several others regarding the Equal Protection Clause and the rights of Black Americans, established Harlan's reputation as a radical champion of civil rights. Those opinions are also credited with establishing the analytical foundation upon which the legal strategy to challenge segregation would eventually be built.

Dobbs Demands Education: Education As A Fundamental Right Through Substantive Due Process, Wendy Salazar Galvan
Duquesne Law Review
The importance of education cannot be overstated.
Today, education is perhaps the most important function of state and local governments. Compulsory school attendance laws and the great expenditures for education both demonstrate our recognition of the importance of education to our democratic society. It is required in the performance of our most basic public responsibilities, even service in the armed forces. It is the very foundation of good citizenship. Today it is a principal instrument in awakening the child to cultural values, in preparing him for later professional training, and in helping him to adjust normally to his environment. In …

Corporate Governance & International Law, Kishanthi Parella

Stakeholder activism by nongovernmental organizations (NGOs), consumers, employees, and others can incentivize corporate managers to comply with international law on climate change, armed conflict, human rights, and access to medicine, among other issues. As such, stakeholder enforcement of international law has two distinct audiences: the corporation that is persuaded to change and fellow stakeholders who are persuaded to act. But familiar difficulties with collective action impede the success of stakeholder enforcement of international law. These challenges can compromise the ability of shareholders to monitor corporations; these same problems similarly jeopardize the ability of stakeholders to monitor corporate compliance with international …

Timmsen: A Criminal Procedure U-Turn Or Just A Detour?, Nancy Jack, Karl T. Muth
Timmsen: A Criminal Procedure U-Turn Or Just A Detour?, Nancy Jack, Karl T. Muth
Loyola University Chicago Law Journal
This Article reviews a recent traffic stop case in Illinois that looks unremarkable from a distance but, upon closer examination, contains a variety of criminal procedure questions about traffic stops, mistake of law, formation of suspicion, and—ultimately—the durability and flexibility of the reasonable, articulable suspicion standard itself when a bizarre fact pattern puts it to the test. In People v. Timmsen, the Illinois Supreme Court wrestles with the question of whether wholly legal behavior, when misinterpreted as illegal conduct, can create the basis for a roadside interaction and the evidentiary question of whether, given the facts particular to this …
The Death Of The Evolving Standards Of Decency, Meghan J. Ryan
The Death Of The Evolving Standards Of Decency, Meghan J. Ryan
Florida State University Law Review
The Eighth Amendment Punishments Clause is in jeopardy. The con-stitutionality of punishments is usually judged according to the “evolv-ing standards of decency that mark the progress of a maturing socie-ty.” And in evaluating these standards, the Court has traditionally looked to changing societal views on punishment. This is a living con-stitution approach to interpretation, and the Eighth Amendment is the only area of law in which the Court has consistently and explicitly ap-plied such an approach. But a living constitution approach is diamet-rically opposed to the current Court’s focus on originalism. This is the first originalist Court in history, and …

Integrating Human Rights In Domestic Practice, Ryan Thoreson, Tamar Ezer, Aya Fujimura-Fanselow, Elizabeth Brundige
Faculty Articles and Other Publications
Given that the human rights framework contains a rich and evolving body of norms and standards, integrating human rights law into clinical teaching provides new avenues to approach problem-solving. A human rights framework offers additional sources to ground moral and legal claims, as well as new strategies and advocacy targets. These alternatives work to foster creativity and lawyering skills, particularly in areas where domestic law is limited or constraining. Moreover, U.S. advocates have much to learn from global human rights struggles and advocacy efforts and can benefit from engaging in human rights discourse and practice. This article introduces readers to …
Smouldering Semantics, Mark A. Drumbl
Smouldering Semantics, Mark A. Drumbl

Law privileges remedies such as incarceration and, in the case of the ICJ, satisfaction, restitution, and compensation. Diverse remedies, like divestment and shareholder activism, remain marginal. It is indeed refreshing to me that the protests roiling university campuses do not call for criminal prosecution, or ICJ denunciation, but rather for divestment and thereby open a conversation about wider causal elements. Law also privileges a reductionism--there is one blameworthy entity at fault, namely, the defendant, the respondent, or the accused. Such a parsimonious approach obscures the broader forces that conspire to seed the loneliness and abandonment that, to me, is a …

The Best Interests Of The Child In Judicial Perspective: Morocco And Chile As Case-Studies (1990-2020), Susana Sanz-Caballero
Children's Legal Rights Journal
Is there a common understanding in the judiciary process about what “the child’s best interests” are, regardless of geographic location or legal order? In every nation, when disputes impacting minors arise, judges emerge as the final adjudicators. Judges, as final adjudicators, appear to be in the best possible position to determine a child’s best interests and apply the notion fairly and appropriately. However, the concept of a child’s “best interests” is far from uniform, varying across cultures and individual family dynamics. It is an invaluable exercise to review the national case law of different countries to test whether the concept …

The Role Of Foster Care: How Foster Parent Intervention Affects The Child Welfare System, Olivia Mcgrath
The Role Of Foster Care: How Foster Parent Intervention Affects The Child Welfare System, Olivia Mcgrath
Children's Legal Rights Journal
"Every child is entitled to a caregiver who can support the family's efforts toward a successful reunification." The National Training and Development Curriculum for Foster and Adoptive Parents provided by the Children's Bureau clearly states the rights of a child in foster care. A child removed from their biological family's home deserves the efforts of the child welfare system, their biological parents, and their foster parents to work toward returning the child to their home. "Foster to adopt" is a misleading term that contradicts the role of a foster parent. Federal and state legislation defines the primary goal of foster …

The Future Of Activism Is Youth-Full: How Youth Around The World Are Carrying The Torch For Gazans, Sierra Garcia

Throughout history, many successful nonviolent action campaigns have been led by young people, from the Free Speech movement to the Civil Rights movement to the Black Lives Matter movement. Recent social movements worldwide - from Latin America to Hong Kong and beyond - have drawn on the strength of mass youth mobilization. It is difficult to imagine the landscape of social activism today without the efforts of young people.
Today, social movements are meeting the pressing crises of our time with unique vision, scale, and infrastructure - pointing the way toward transformation, with youth leading that charge. Studies show that …

Prisons As Laboratories Of Antidemocracy, Brandon Hasbrouck
Prisons As Laboratories Of Antidemocracy, Brandon Hasbrouck
Scholarly Articles
Prisons are woefully ineffective as tools to protect society from violence and exploitation, yet America’s prison population exploded in the twentieth century. On the outside, this devastated Black communities, Black opportunities, Black economic power, and Black voting power. Yet a similarly insidious development came from inside prison walls: prison administrators honed antidemocratic techniques for constraining and oppressing incarcerated persons, techniques that would later be deployed against the ostensibly free population. Jeffrey Bellin’s Mass Incarceration Nation provides a robust analysis of the ways state and federal policies have combined to create an explosion in the scope of American prisons in the …

First, it will offer a basic overview of Intellectual Property and what may be protected under U.S. law. Then, offer an outline of the legal frameworks involved and best practices essential for safeguarding trademarks and copyrights in the Mexican market, as …
