Considering the dynamic technological progress, electronic banking is now both a modern and convenient means for clients to communicate with their bank remotely. Importantly, e-banking is gaining increasing prominence as a commonly accepted and key tool for financial management in modern society. The purpose of this article is to present the results of a survey conducted among individual clients in possession of a bank account. The survey focuses on understanding the ways in which e-banking shapes clients’ habits and influences their preferences. The survey has set out two research hypotheses. First, that there is a growing trend of traditional banking …

Paying For Performance? Attorneys’ Fees In Securities Fraud Class Actions, Stephen J. Choi, Jessica M. Erickson, A. C. Pritchard
Paying For Performance? Attorneys’ Fees In Securities Fraud Class Actions, Stephen J. Choi, Jessica M. Erickson, A. C. Pritchard
Law & Economics Working Papers
This Article studies whether plaintiffs' lawyers matter in securities class actions. We use inverse propensity score weighting (IPW) to compare the results in cases led by top-tier firms against those brought by lower-tier firms. This technique addresses case selection effects by using all of the cases led by a top-tier firm and then weighting the cases led by lower-tier firms based on how similar these cases are to the cases led by top-tier firms. We do find that top-tier lawyers obtain better outcomes for shareholders in a subset of securities class actions, specifically the cases against the larger (although not …

Special Episode 1: Loss Of Innocence, Sara Gras
Summer 2024 Special Episodes
On August 8, 2024, Lazar Ðukic lost his life in a Texas lake during the first event of the 2024 CrossFit Games. His death has rocked the competitive CrossFit community to its core. Although competition resumed, it wasn’t the same. Many top athletes were missing from the floor and those who continued were subdued, grieving. But for many, the sadness is mixed with anger, with frustration. Games veterans have come forward and publicly decried, not just the execution of the particular event where Lazar lost his life, but a culture of dismissiveness where the safety and well-being of the sport’s …

The Indiana Innocence Project will screen and investigate cases with meritorious innocence claims, secure DNA testing when biological evidence …
Defining Relevant Markets In Digital Ecosystems, Daniel A. Crane
Defining Relevant Markets In Digital Ecosystems, Daniel A. Crane
Articles
Traditional market definition focuses on the substitutability of two products or geographies. In digital ecosystems, competition often occurs in important ways that elide definition in conventional substitutability terms. This Article considers three kinds of economic rivalry that do not fit the conventional market definition mold: (1) Single-side competition: In two sided markets, firms may compete on just one side of the market. For example, Google and Facebook compete for the same advertisers, but their users on the other side of the market do not necessarily think of the offerings (social media and universal search) as substitutes; (2) Ecosystem competition: Technology …

Considerations On How Does Public Scientific Research Institution Deal With Open Source Intellectual Property Problems, Yungang Bao, Xiaojuan Li
Bulletin of Chinese Academy of Sciences (Chinese Version)
Open source plays a positive role in terms of innovation iteration, ecological expansion, and international development. Nevertheless, when trying to open source scientific research achievements, or to participate in the construction of open-source communities, public scientific research institutions encounter open source related problems such as losses of state-owned assets, disposal of intellectual property right, legal risks prevention and control, etc. The authors put forward proposals from the following aspects: donation of open source projects, selection of open source license, and construction of open source Patent Pool.

Analysis Of Recent Development In Energy Storage Technology In China From Perspective Of Patents, Mingming Jiang, Zhijun Jin
Bulletin of Chinese Academy of Sciences (Chinese Version)
The achievement of the “dual carbon” goal is closely tied to the widespread implementation of renewable energy, however, renewable energy generation is characterized by intermittency and volatility. Advanced energy storage technology plays a crucial role in mitigating the fluctuations of new energy sources and enhancing their absorption capacity. Patents serve as important indicators of technological innovation, directly reflecting current research trends and future directions in energy storage technology. This paper primarily relies on the “WIPO IP Portal” website provided by the World Intellectual Property Organization to analyze the comprehensive strength of eight leading countries including the United States, China, France, …

The complex and data-driven nature of artificial intelligence (AI) raises questions for the sufficient disclosure of patent applications in this field. What are the European patent disclosure requirements for AI inventions?
-
One challenge is that, prior to training, AI systems can be considered generic models. But after training, they transform into specialized AI systems to solve a particular problem. This transformation requires training data, making it an integral part of the AI system’s definition. But to what extent is the disclosure of the training data or training process necessary for patent disclosure?

Do Androids Dream Of Bad Tv?: Un/Originality In Neil Burger’S Voyagers, Tom Ue, Callum M. Mcnutt
Do Androids Dream Of Bad Tv?: Un/Originality In Neil Burger’S Voyagers, Tom Ue, Callum M. Mcnutt
Proceedings from the Document Academy
Critics did not take kindly to Neil Burger’s Voyager (2021). On Rotten Tomatoes, the film scored a dismal 25%, and the consensus is that it’s a trip best not taken: “It has a game cast and a premise ripe with potential, but Voyagers drifts in familiar orbit rather than fully exploring its intriguing themes.” This article seeks neither to reclaim the film as an unjustly neglected cinematic masterpiece nor to assert its importance in the canon of dystopian works. Rather, it treats Voyagers as a test case for exploring our own critical investment in the genre. Our aims are …

From Credit Information To Credit Data Regulation: Building An Inclusive Sustainable Financial System In China, Christine Menglu Wang, Robin Hui Huang, Douglas Arner
Washington International Law Journal
A lack of information about potential borrowers is a major obstacle to access to financing from the traditional financial sector. To prevent fraud, increase access to finance, and support balanced sustainable development, countries aroun6d the world have moved over the past several decades to develop credit information reporting requirements and systems to improve the coverage and quality of credit information. Until recently, such requirements mainly covered banks. However, with the process of digital transformation in China and around the world, a range of new credit providers have emerged, in the context of financial technology (FinTech, TechFin, and BigTech). Application of …
International Investment Law And The Rule Of Law: The Case Of China, Ming Du
International Investment Law And The Rule Of Law: The Case Of China, Ming Du
Washington International Law Journal
This article purports to discuss the impact of international investment law on domestic governance and the rule of law of a nation state. Using China as a case study, this article argues that the role of international investment law in advancing domestic rule of law has long been overstated. The prevailing narrative is premised on some deeply flawed assumptions of the nature and function of international investment law as well as how international investment law may affect domestic legal change. These assumptions include, inter alia: (1) international investment norms possess the rule of law ideals; (2) improving good governance and …
Regulating Digital Platforms Through Sanctions, Michelle Miao
Regulating Digital Platforms Through Sanctions, Michelle Miao
Washington International Law Journal
This article, theoretically and empirically, articulates the rising role of criminal law as a regulatory tool of China’s digital platform economy. This unique Chinese model of digital platform governance is described as “regulation through sanctions.” Through a comprehensive survey of a wide range of digital platforms— e.g., financial fundraising platforms, e-commerce, taxi-hailing, and video-sharing platforms—and criminal cases involving such platforms, I reveal the logic of regulation through sanctions: It shifts state regulatory burden and accountability, redistributes risks and responsibility, and enhances political legitimacy. Compared to the direct regulatory model adopted by European countries and indirect, self-regulatory model employed in the …
Does Black-Letter Law Matter In Labor Rights Protection In China? - A Tale Of Two Cities, Peter Chi Hin Chan
Does Black-Letter Law Matter In Labor Rights Protection In China? - A Tale Of Two Cities, Peter Chi Hin Chan
Washington International Law Journal
This article discusses the role of black-letter law in labor protection in China in cases where employers dismiss employees on the grounds of serious breaches of internal regulations. This article presents an empirical analysis of the judicial practice of two of China’s economically developed cities, Suzhou and Wuxi. Suzhou employers have to give employees the opportunity to be heard prior to dismissal, while Wuxi does not provide that opportunity. First, this article introduces the Chinese labor legislation system, the dismissal system, and the two cities’ local labor regulations. Second, the article will analyze and discuss 140 cases from Suzhou and …

Bridging The Global Divide In Ai Regulation: A Proposal For A Contextual, Coherent, And Commensurable Framework, Sangchul Park
Washington International Law Journal
As debates on potential societal harm from artificial intelligence (AI) culminate in legislation and international norms, a global divide is emerging in both AI regulatory frameworks and international governance structures. In terms of local regulatory frameworks, the European Union (E.U.), Canada, and Brazil follow a “horizontal” or “lateral” approach that postulates the homogeneity of AI, seeks to identify common causes of harm, and demands uniform human interventions. In contrast, the United States (U.S.), the United Kingdom (U.K.), Israel, and Switzerland (and potentially China) have pursued a “context-specific” or “modular” approach, tailoring regulations to the specific use cases of AI systems. …

A Crosswinds Of Corporate Accountability: Corporate Climate Liability In The Canadian Legal Abyss, Hassan M. Ahmad
All Papers
This chapter queries the absence of corporate-related climate cases in Canadian courts. It first retells the recent history of corporate accountability in Canadian courts for human rights-related harms. While initial cases faltered on jurisdictional and justiciability grounds, the Supreme Court of Canada’s 2020 decision in Araya v. Nevsun Resources Ltd. was arguably a watershed moment in Canadian corporate accountability law that, in conjunction with climate litigation commenced against government actors, should have bolstered the prospect of corporate climate litigation. On the contrary though, post-Nevsun corporate accountability claims have been minimal and, to date at least, have not pursued allegations …

Johnson v. M’Intosh is important for its extensive description of the racist Doctrine of Discovery. But its holding had no bearing on legal rights of American Indian nations. The opinion’s articulation of tribal rights to land ownership and retained sovereignty were correctly stated.

Johnson v. McIntosh was as fake as John Wayne’s teeth. That one was a property dispute, remember? Two wealthy, privileged, and powerful white people squared off over thousands of acres of land acquired from Indigenous nations who called the vast valley of Eagle River home. On one side, you had a former United States Supreme Court Justice; on the other, you had a wealthy political benefactor/beneficiary. No tribal nations or Indigenous peoples to be seen or heard from. And of course, the competing property claims at issue barely overlapped, if at all, thanks to stipulations of the parties at the …

The Usefulness Of Pillar 1, Reuven S. Avi-Yonah

Many commentators have declared that pillar 1 of the base erosion and profit-shifting project 2.0 is dead. By its explicit terms, the multilateral tax convention (MLC) implementing pillar 1 cannot go into effect this year without ratification by the United States, and the chances of the United States ratifying it before or after the election are low given massive opposition in Congress. If the MLC does not go into effect by December 31, 2024, over 30 countries will likely impose digital services taxes on January 1, 2025, making the whole pillar 1 project (which was aimed at preventing the spread …

Nakomidizo: An Anishinaabe Law Response To Two-Hundred Years Of Johnson V. M’Intosh And The Doctrines Of Discovery And Implicit Divesture, Kekek Jason Stark
Tribal Law Journal
Responding to the history involved in the establishment and perpetuation of the doctrines of discovery and implicit divesture, this article critiques how federal Indian law has been developed to support the diminishment of tribal sovereignty through the perpetuation of historical assimilation policies. In response, this article will show that the diminishment of tribal sovereignty through the perpetuation of historical assimilation policies can be overcome with the effective implementation of tribal law principles. To counter the narrative of diminished sovereignty, I offer an understanding of the trust responsibility from an Anishinaabe law perspective. In particular, the revitalization of tribal law through …
