Once More: Digital Services Taxes Should Be Creditable, Reuven S. Avi-Yonah
Articles
In a previous column, I argued that digital services taxes should be creditable as in-lieu-of taxes under section 903. A new analysis by Jane Gravelle sheds further light on this topic but does not change the outcome.
Gravelle makes three arguments against the creditability of DSTs. First, she argues that the whole concept underlying both pillar 1 and DSTs (allocating value to market jurisdictions) is wrong, and therefore they cannot be justified. Second, she argues that DSTs are passed on in full to consumers and that this precludes creditability. Finally, she argues that DSTs are discriminatory excise taxes on U.S. …

Securitisation, National Action Plan, And Law On Terrorism In The Philippines And Indonesia: Questioning Comprehensive Approach, Chaula Rininta Rininta Anindya
Global: Jurnal Politik Internasional
The fundamental aim of the National Action Plan (NAP) on Preventing and Countering Violent Extremism (P/CVE) is to employ a comprehensive approach to addressing the root causes of violent extremism. However, does it necessarily become a real instrument to employ a comprehensive approach in P/CVE? The case of Indonesia and the Philippines will show the important factors of the people behind the policy-making process and the timing of the issuance of NAP. The NAP will only become a mere jargon of a “comprehensive approach” when there is limited access for other actors outside of the governmental agencies to be involved …

The increasing involvement of States and their surrogates in cross-border commercial activities has heralded an urgent need for codification of the well-established public international law rule of sovereign immunity. The problem is particularly thorny in international arbitration when corporate entities seek to enlist the courts of one State to seize the property of another state to enforce an arbitral award. The complex nature of sovereign immunity in a globalized economy and the challenge it poses for courts in the Caribbean, was highlighted in enforcement proceeding brought by oil giant, ConocoPhillips against Venezuela’s State corporations. This article therefore discusses (a) the …

(Dis)Invested Bodies: The Neoliberal Crafting Of Disability, T. Wesley
Electronic Theses and Dissertations
Using the Americans with Disabilities Act (ADA) as a unifying text, my dissertation explores the relationship between cultural production and the neoliberal crafting of humanity, the term I use to describe how social dimensions—including the construction of the textual and material body—become reorganized and governed through market relations. While many disability scholars and activists frame the ADA’s failures through social misunderstandings of disability, few have seriously attended to the limits of the ADA as a neoliberal fusing of economic governance and classical liberal individualism.
Tracing convergences between the ADA and earlier US disability legislation to socioeconomic and political reforms enacted …

Patent Law And Access To Biotechnology, Enoch Otim
Technology and Economics Law Journal
The research analyzes the use of patents in a field other than industry and how they have a wider impact than the monetary gain of the patent holder. In recent years, patents have been taken out on organisms and gene sequences, which has a flow-on effect of jeopardizing any further research in that area and possible future developments. This is a serious issue in the fast-moving field of medical biotechnology. For example, researchers patented and developed a test that utilized and identified a gene sequence that was later patented by another party. The researchers may have to discontinue the test …

Development Of A Telecommunications Regulatory Evaluation Model Based On The Five-Generation Framework By The International Telecommunication Union (Itu), Arief Hamdani Gunawan, I Gusti Ayu Ketut Rachmi Handayani, Lego Karjoko
Technology and Economics Law Journal
With the evolution of technology and changes in societal needs, regulations in the telecommunications industry should be adaptable in order to maintain accessibility, affordability, and quality of service standards. The ITU has developed an extensive assessment model for regulations that consists of five generations. This model evaluates telecommunication regulatory policies’ effectiveness and efficiency under fast evolving technological circumstances. Each generation will be broken down according to such indicators established by the ITU as policy effectiveness, adaptability to technological change, and impact on users of telecoms services. Through various regulatory stages this evaluation model brings out comprehensive understanding about achievements made …

Penguatan Perjanjian Lisensi Dan Optimalisasi Perhitungan Royalti Dalam Melindungi Hak Kekayaan Intelektual Berupa Rahasia Dagang Dan Paten, Silveria Verawaty Rs. T. Fau
Technology and Economics Law Journal

Shadow Banking And Securities Law, Gabriel Rauterberg, Jeffery Y. Zhang
Law & Economics Working Papers
Shadow banking may be the single greatest challenge facing financial regulation. Financial institutions that function like banks, but outside the scope of banking regulation—aptly termed “shadow banking”—were at the heart of the Global Financial Crisis and most episodes of serious financial stress since then. Scholars have largely focused on one response to this problem—extending traditional banking regulation to shadow banks. Yet more than fifteen years after the crisis, major regulatory efforts along this route have stalled.
In this Article, we explore the uneasy case for greater regulation of shadow banking through securities law. Our first contribution is analytical. We demonstrate …

Walking On Water: Concrete Standing And The De Minimis Limitation At Class Certification, Daniel J. Birmingham
San Diego Law Review
…[C]lass action lawsuits are almost never presented to a jury. The sheer scope and scale of class action lawsuits typically incentivize settlement. Thus, Olean Wholesale Grocery Cooperative, Inc. v. Bumble Bee Foods LLC raises many questions. Who should decide these merits questions, and when? Is there a limit to uninjured class members, and how should it be determined? Do uninjured class members satisfy the requirements needed for Article III standing? While the Ninth Circuit’s case-by-case approach is sure to stoke the fires of the plaintiffs’ bar, this uncertain standard may increase liability for defendants (even if they are blameless).
