Patent Eligible Inventions After Bilski: History And Theory, Joshua Sarnoff Feb 2011

Patent Eligible Inventions After Bilski: History And Theory, Joshua Sarnoff

College of Law Faculty

The U.S. Supreme Court has continued to require that patentable subject matter eligibility determinations under Section 101 be made by reference to three historic, categorical exclusions, for scientific principles, natural phenomena, and abstract ideas, which must be treated as if already known even when newly discovered by the applicant. Various thoughtful scholars have alternatively urged that these exclusions from the patent system should be viewed restrictively or that eligibility decisions should be avoided. But these scholars underappreciate the benefits of categorical exclusions and particularly of treating them as if they were already known prior art, and in any event the …

So How Did We Get Into This Mess? Observations On The Legitimacy Of Citizens United, Alexander Polikoff Feb 2011

So How Did We Get Into This Mess? Observations On The Legitimacy Of Citizens United, Alexander Polikoff

NULR Online

How did the American body politic allow business corporations to threaten members of Congress by saying, credibly, “Do what we want or we’ll bury you!”?

On January 21, 2010, the Supreme Court’s 5-4 decision in Citizens United v. Federal Election Commission interpreted the U.S. Constitution’s First Amendment to permit corporations to spend unlimited amounts of money to support or oppose their chosen candidates. "[A] lobbyist," said the front page of the next day’s New York Times, "can now tell any elected official that [if you vote wrong,] my company, labor union or interest group will spend unlimited sums explicitly …

Transparency Soup: The Acta Negotiating Process And "Black Box" Lawmaking, David S. Levine Feb 2011

Transparency Soup: The Acta Negotiating Process And "Black Box" Lawmaking, David S. Levine

Joint PIJIP/TLS Research Paper Series

The negotiations of the Anti-Counterfeiting Trade Agreement (ACTA) have been marred by a level of attempted secrecy heretofore unseen in international intellectual property lawmaking. Simultaneously, the Freedom of Information Act (FOIA) has been used in several significant national contexts to prevent the disclosure of data and information in ways that call into question its efficacy as an effective regulation of governmental knowledge. This paper seeks to tie together these two recent developments in order to (a) prevent future international intellectual property law negotiations from being unduly secret and (b) encourage Congress to consider reforming FOIA in light of current public …

The Principle Of Legality In International Criminal Law, Beth Van Schaack Feb 2011

The Principle Of Legality In International Criminal Law, Beth Van Schaack

Faculty Publications

This short piece contains remarks made at the 2009 Annual Meeting of the American Society of International Law on the topic of the principle of legality in international criminal law (nullum crimen sine lege or NCSL). Summarizing conclusions from a longer piece (Crimen Sine Lege: Judicial Lawmaking at the Intersection of Law & Morals, 97 Geo. L. J. 119 (2008)), this piece argues that the NCSL jurisprudence does not compromise the fundamental fairness of modern international criminal law proceedings because it is largely consistent with the international formulations of the principle, authoritative interpretations emerging from institutions charged with enforcing human …

Catalyzing Technology Development Through University Research, Jorge Contreras, Charles R. Mcmanis

Working Papers

Research universities have traditionally been catalysts for technological innovation, particularly in new and emerging industries. Against this backdrop, it is not surprising that some of the most promising new technologies relating to climate change are being developed at research universities. In this chapter, we first summarize several modes of university technology development and licensing. Next we describe the evolution of university technology commercialization and the Bayh-Dole Act of 198'8 which is widely credited with establishing the intellectual property structure of current university licensing and technology transfer. We then discuss some important legal and intellectual property considerations relevant to the development, …
