Presidential Memories: Lincoln's Relationship With The Jews - Remembered On President's Day, Kenneth Lasson Feb 2011

Presidential Memories: Lincoln's Relationship With The Jews - Remembered On President's Day, Kenneth Lasson

All Faculty Scholarship

This article examines the relationship President Abraham Lincoln had with members of the Jewish faith.

Ever since George Washington, U.S. presidents have made inclusive gestures toward Jewish-American citizens and soldiers, but only Abraham Lincoln, whose 291st birthday we celebrated last week, ever officially intervened on their behalf. He did it twice within the span of two years. During his political career Lincoln had many Jewish associates, advisers and supporters.

During the Civil War General Grant issued General Order No. 11, which is also discussed. This order was a result of Grant’s perception that Jews were participating in a black market …

The Modern American Entrepreneur: Characteristics, Formative Legislation, And Modern Education, Jeremy S. Office

Graduate Student Dissertations, Theses, Capstones, and Portfolios

This research began by exploring traits and characteristics of the American entrepreneur. It continued by offering a history of these individuals, focusing primarily on the history of laws and regulations which have both positively and adversely affected the practice of entrepreneurialism in the United States. Current laws that affect entrepreneurship, along with the current state of entrepreneurial education in business schools, are explored in depth. This study concludes that the current system of business regulations and entrepreneurial education are flawed and that their failings have produced generations of business students who are unable to reach their full potential. A brief …

The Value Of Value-Added Measures, Nathan C. Jensen, Gary W. Ritter Feb 2011

The Value Of Value-Added Measures, Nathan C. Jensen, Gary W. Ritter

Policy Briefs

The concept of value-added measures of teacher or school effectiveness is prompting a great deal of discussion in K-12 Education policy circles. This debate reached a boiling point last year when the Los Angeles Times published a database of the value-added scores for all teachers in the nation's second largest school district. Proponents argue value-added measures provide important information on school and teacher effectiveness. Opponents argue value-added measures are imprecise instruments which measure student background instead of teacher or school quality. The purpose of this policy brief is to provide the reader with a general understanding of the concept of …

Testimony Of Rena Steinzor…Before The U.S. House Of Representatives, Energy And Commerce Committee, Subcommittee On Environment And Economics. 112th Congress, 1st Session (2011)., Rena I. Steinzor

Congressional Testimony

Environmental regulations have saved millions of lives, preventing chronic respiratory illness and heart attacks in cities across the country. These rules protect children from irreversible neurological damage, save billions of dollars in cleanup costs, and preserve water quality in lakes, rivers, and streams. If anything, our regulatory system is dangerously weak, and Congress should focus on reviving it rather than eroding public protections….

Cityland – Vol. 8, No. 1, Center For New York City Law

CityLand - 2011

This issue of CityLand covers key land use and zoning developments in New York City as of February 15, 2011. Highlights include the City Council’s rejection of the landmark designation for Grace Episcopal Church Memorial Hall in Queens, citing community opposition and procedural concerns. The Council approved multiple zoning text amendments, including clarifications to the definitions of “development” and “building,” and modifications to the Lower Density Growth Management Area (LDGMA) regulations affecting Staten Island and the Bronx. Rezoning efforts in Bayside, Williamsburg, and Midtown South advanced mixed-use and affordable housing projects. The issue also reports on the creation of new …

Patent Eligible Medical And Biotechnology Inventions After Bilski, Prometheus, And Myriad, Joshua Sarnoff

College of Law Faculty

In Bilski v. Kappos, the U.S. Supreme Court continued to require that patentable subject matter eligibility determinations under Section 101 be made by reference to three historic, categorical exclusions, for scientific principles, natural phenomena, and abstract ideas. This excluded subject matter must be treated as if already known even when newly discovered by the applicant. Unlike in other jurisdictions, the excluded subject matter thus cannot contribute creativity to the claimed inventions, either for eligibility or for patentability evaluations. The Federal Circuit has reluctantly applied eligibility doctrine after Bilski, holding in Prometheus v. Mayo that claims to treatment methods applying the …

Creditors And Debt Governance, Charles K. Whitehead Feb 2011

Creditors And Debt Governance, Charles K. Whitehead

Cornell Law Faculty Working Papers

This chapter from the book Research Handbook on the Economics of Corporate Law (Claire Hill & Brett McDonnell, eds.), provides an introduction to the law and economic theory relating to creditors and debt governance.

The chapter begins with a look at the traditional role of debt, focusing on the impact of debt on corporate governance and, in particular, the effect of an illiquid credit market on creditors’ reliance on covenants and monitoring. It then turns to changes in the private credit market and their effect on lending structure. Greater liquidity raises its own set of agency costs. In response, loans …
