The resurgence of interest in Kabbalistic diagrams (Segol, Busi, Chajes) raises the question of how diagrams function in religious symbolism. This question can be approached via methods used in the graphical modeling of data. Specifically, graph theory lets one define a repertoire of candidate structures that can be applied not only to quantitative data, but also to symbols consisting of qualitative components. A graph is a set of nodes and links between nodes. What nodes and links are is unspecified in this definition. The Kabbalistic Ilan is – partially – a graph. Mr. Harewood is an art professor at Florida State College of Jacksonville. He was born in Brooklyn, New York, the son of immigrant parents from Barbados. His history covers drawing comics in his youth, formal art education at the University of North Carolina, an internship at Marvel Comics, and as an art professor and community art advocate in Jacksonville. Mr. Harewood also describes several of his mural projects, his art influences, and what the COVID-19 pandemic was like for him.

Theses and Dissertations

The Committee on Public Information (CPI) was the official propaganda agency of the United States during the First World War, seeking to homogenize American public opinion and spread American ideals across the globe. Through a case study of Edwin Björkman’s work among Swedish Americans, this thesis illuminates how the CPI approached its work among immigrants, engaging questions of Americanization and transnationalism. Through an analysis of the John Ericsson League of Patriotic Service and the Scandinavian Bureau—both its domestic and foreign operations—this thesis argues that Edwin Björkman and the CPI promoted cultural pluralism rather than assimilation to a dominant Anglo-American culture. …

In recent decades, archaeological research has provided evidence that some mounds in the southeastern United States were constructed in short episodes. A large work force would have been required to accomplish these monumental projects. Shell mounds, in particular, provide an opportune type of architecture to investigate whether seasonal aggregations of laborers gathered at sites to engage in large-scale work projects because these mounds are constructed of aquatic resources that leave signatures for what time of the year they were caught or harvested. Women’s Gymnastics is one of the most popular events at the Summer Olympic Games and media coverage of the team provides a unique perspective on women’s athletics, as gymnastics is traditionally considered a feminine sport. Utilizing a discourse analysis, this thesis examines the newspaper coverage received by the team in the last 25 years. This thesis explores the narratives regarding gender within the coverage and additionally explores how abuse narratives were discussed in news media throughout theses years. This research shows that how female gymnasts are discussed is growing in type of coverage received, meaning that how female gymnastics is …

ذهبت طائفة من العلماء إلى أن ما ترَك النبي e فعله في باب العبادات، مع قيام مقتضيه وانتفاء المانع منه – وهذه السنة التَّرْكِيَّةُ - فإنَّ فِعْلّه محرَّم وبدعة؛ لأنَّ فعْلَه لو لم يكن كذلك، لما تركه النبي e، مع وجود المتقضي وانتفاء المانع. والواقع أن هذا التلازم المدعى بين تحريم الفعل وبدعيته، وكونِ تركِهِ حاصلا مع وجود مقتضيه وانتفاء المانع منه؛ مُحْوِجٌ إلى دراسته والفحص عنه، وسَبْرِه بمعيار العلم الذي به تَظهر صحتُه، أو يَثْبُتُ بطلانُه؛ وهو ما خلت عنه الدراسات السابقة في موضوعه، وما انعقد هذا البحث له، وقُصِدَ لأجله، مع التتميم فيه بإيراد ما خلَتْ عنه …

تُعد ظاهرة الإغراق من أكبر التحديات التي تواجه الاقتصادات المحلية والدولية في وقتنا المعاصر، وقد جاءت هذه الدراسة لبحث ظاهرة الإغراق، حيث تناولت توصيف الإغراق وتاريخه القانوني والتشريعي، وبيان حالاته ودوافعه وأهدافه وآثاره على السوق والاقتصاد، كما تناولت تأصيل مفهومه شرعا وبيان حكمه الشرعي في كل حالة من حالاته مع عرض آراء الفقهاء فيها وأدلتهم، ومناقشة ذلك والترجيح بينها.

من المعلوم أنَّ عقد رهن العقار في القوانين الحديثة لا ينعقد إلا بكتابة عقد الرهن وتوثيقه من قِبَل موظف عام. فكتابة عقد رهن العقار وتوثيقه له دور أساسي بعقد الرهن الرسمي أو التأميني. وهذا على خلاف الرهن الحيازي الذي يقع عادةً دون كتابة ودون توثيق، لكنه يستلزم نقل حيازة الشيء المرهون من الراهن إلى المرتهن. وهذا النوع –كما هو معلوم- لا يقع على عقار، بل على منقول. غيرَ أنَّ الفقه الإسلامي لم يُفرِّق بين العقار والمنقول في نقل الحيازة، فأوجب نقل الحيازة - وهو ما يُعرف بـ"القبض"- من الراهن إلى المرتهن سواء كان الشيء المرهون منقولاً أو عقاراً. فنَظَّم …

يُعدُّ عقد الرهن من العقود التبعية، حيث لا يراد لذاته، وإنما يكون تابعا للعقد الذي جاء لضمانه، ويضطلع عقد الرهن بدور بارز ومحوري في تحقيق ما يعرف بالأمن العقدي، من خلال توفير طمأنينة للعاقدين في العقود التي يشرع عقد الرهن لتوثيقها، بما يوفره من قدرة على الاستيثاق وحفظ الحقوق.

وتهدف هذه الدراسة إلى بيان الحقوق التي يمنحها هذا العقد، والالتزامات التي يرتبها على أحد طرفيه وهو المرتهن، وصولا إلى الخاتمة التي أودعت فيها أهم النتائج والتوصيات، التي خلصت إليها هذه الدراسة.

هذا البحث المختصر يعالج قضية من قضايا المعاملات التي انتشرت في الأسواق التجارية، وتتعلق بالمعاملات المالية، وتعرف بـ(النَّجْش).

والنَّجْشُ من الأمور التي نهى عنها شرعنا الحنيف؛ لما يحويه من غرر، وغش، وخداع، وتلبيس.

والنَّجْشُ يخل بالتوازن بين العوضين في المعاملات، والنَّجْشُ ظلم، والنَّجْشُ يورث الكراهية في صدور المتعاملين في الأسواق بعد اكتشاف الخديعة التي حدثت، والنَّجْشُ يضر بالمتعاملين في الأسواق، والنَّجْشُ يؤدي إلى عدم استقرار المعاملات في الأسواق؛ من أجل هذا وغيره نهى الشارع الحكيم عن النجش.

يُعنى هذا البحث بكشف وتفنيد دعوى التأثير اليهودي في تأسيس مبدأ حجية السنة النبوية، والذي تتداوله بعض الكتابات المعاصرة في سياق توهين مصادر التشريع الإسلامي وتضعيف الاستناد إليها. وقد اعتمد الباحث المنهج الاستقرائي والتحليلي النقدي لتفكيك مفردات هذه الدعوى ومستنداتها وتداعيتها المختلفة. ومن أبرز النتائج التي توصلت إليها: أن السنة النبوية حجة ومصدر للتشريع، وأن الطعن في حجيتها بواقع تأثير الأصولية اليهودية مجرد افتراضات عقلية غير مؤسسة علميا ومنهجيا، وأنه لا يستبعد في الخلفية العميقة لهذه الدعوى نوع تأثر لهؤلاء الكتاب بطائفة اليهود القرائين.
