Intellectual Heirs Property: Why Certain Musical Copyrights Should Be Included In The Heirs Property Reform Movement, Austin Weatherly May 2022

Intellectual Heirs Property: Why Certain Musical Copyrights Should Be Included In The Heirs Property Reform Movement, Austin Weatherly

Journal of Intellectual Property Law

The modern heirs property reform movement seeks to ameliorate the issues caused by the procedures governing the inheritance of real property from landowners who die intestate. This procedure can have a negative impact on heirs and the value of their inherited property. The reform movement, as it stands, only seeks to resolve the issues created by these procedures in the real property context. The rhetorical basis for the modern heirs property reform movement largely focuses on closing the racial wealth gap in the United States and slowing the wealth bleed from one black generation to the next. Many of the …

Exposing The “Folklore” Of Re-Recording Clauses (Taylor’S Version), Justin Tilghman May 2022

Exposing The “Folklore” Of Re-Recording Clauses (Taylor’S Version), Justin Tilghman

Journal of Intellectual Property Law

Many artists believe that their significance, power, or notoriety comes from how many GRAMMY awards they have won or how well their albums sales do the first week. However, very few artists recognize that the true power comes in the form of owning the rights to their master recordings. Given how difficult it is to achieve commercial success as an independent artist, many artists will turn to major record companies to help with their music production and distribution. This help, however, is not unconditional. The artist will sign over the master recording rights to the song or album to the …

Greasing The Wheels Of Patent Law: Clarifying The Judicial Exceptions Via American Axle & Manufacturing, Inc. V. Neapco Holdings Llc, Michael Oliver May 2022

Greasing The Wheels Of Patent Law: Clarifying The Judicial Exceptions Via American Axle & Manufacturing, Inc. V. Neapco Holdings Llc, Michael Oliver

Journal of Intellectual Property Law

Patents stimulate the economy, they give inventors (and investors in the patent) confidence that their work will be protected. You have never been able to patent laws of nature, natural phenomena or abstract ideas. These combine to create the judicial exceptions. The issue is that these terms are so broad that it is difficult to determine when a patent is connected to a judicial exception. The Supreme Court created the Alice test, a two-part test to determine whether a claim is tied to a judicial exception. That was back in 2014 and is the last time the Supreme Court has …

When A “+” Doesn’T Add Anything In The Equation: Analyzing The Effect Of The “+” On Trademark Law, Vasilios Nasoulis May 2022

When A “+” Doesn’T Add Anything In The Equation: Analyzing The Effect Of The “+” On Trademark Law, Vasilios Nasoulis

Journal of Intellectual Property Law

In the past decade, there has been a growing trend where companies use the plus sign, “+”, in their branding. From industry titans like Google and Apple to smaller, niche companies like World Champ Tech, there has been an increased use of the + in product and service names. This raises trademark questions about how the mark should be protected and how does the + change the meaning of a name. Trademarks are designed to protect producers as well as consumers from deceit, miscommunication, and misunderstanding. The + potentially denies producers and consumers these protections.

Another trend in the past …

Reconsidering The Willful Blindness Doctrine In Contributory Trademark Infringement, Andrew Ligon Fant May 2022

Reconsidering The Willful Blindness Doctrine In Contributory Trademark Infringement, Andrew Ligon Fant

Journal of Intellectual Property Law

The Lanham Act provides for a cause of action of direct trademark infringement. In 1982 the Supreme Court effectively expanded that cause of action by allowing for traditional tort secondary liability in the context of manufacture and distribution of goods. Since that decision, the lower courts have adapted the doctrine of contributory trademark infringement to the modern world. One of those adaptations was the importation of the willful blindness doctrine from criminal law to trademark infringement law. The circuits have divergent standards for what knowledge is required for liability under willful blindness, and the Second Circuit appears to have multiple …

Patent Performativity, Dan L. Burk May 2022

Patent Performativity, Dan L. Burk

Journal of Intellectual Property Law

Gender bias is rife in the patent system; a large and growing body of empirical literature demonstrates the exclusion of women from the patent system at every level. Such pervasive marginalization cannot be explained by the paucity of women in STEM fields. Rather, more fundamental discriminatory mechanisms must be at work. In this paper I examine one aspect of such biases, arguing that patents operate as performatives, that is, as social assemblages that enact what they disclose, and that create their own social facts. To demonstrate patent performativity, I briefly trace the development of performative concepts, from Austinian declarations, through …

Health Communication Blindspot: A Case Study Of Harmful Algal Blooms In The South Atlantic States, Jaron King May 2022

Health Communication Blindspot: A Case Study Of Harmful Algal Blooms In The South Atlantic States, Jaron King

Journal of South Carolina Water Resources

A Harmful Algal Bloom (HAB) is a complex natural event that occurs when algae reach a critical biomass and create one or more toxins harmful to biological life or the environment. By definition, HABs create both ecological and public health challenges. Because governments are the entities most often tasked with the responsibility for shared resources, this case study represents a snapshot of current governmental messaging about HABs in the South Atlantic states. The objective of this online content analysis is to determine the readability of both state and federal government online communications regarding HABs using the Simple Measures of Gobbledygook …

Enterococci Contamination On Edisto Island, South Carolina: Frequency, Sources Of Contamination, And Prospects On How To Improve Water Quality, Christina Ek, Dwayne E. Porter, David Graves, Bryan Rabon, Bo Cai, Guoshuai Cai, Ronald Willis, Geoffrey I. Scott

Journal of South Carolina Water Resources

Beach monitoring samples were collected from 18 (14 currently in use) locations on Edisto Island, South Carolina, from 2000 to 2016 to assess patterns of water quality violations (contraventions) indicated by the presence of multiple Enterococcus species, including Enterococcus faecalis and Enterococcus faecium, bacteria used to assess the health of surface waters for contact recreation. Statistical analyses were conducted comparing Enterococci levels and different environmental variables including location, tidal stages, wind direction, and time. Specific focus was placed on temporal and spatial patterns for dates when the bacteria levels exceeded 104 Most Probable Numbers (MPN) per 100 milliliters (ml), which …

Identification Of Stormwater Pollution Hotspots In Charleston Peninsula, Ashleigh Kirker, Vijay M. Vulava May 2022

Identification Of Stormwater Pollution Hotspots In Charleston Peninsula, Ashleigh Kirker, Vijay M. Vulava

Journal of South Carolina Water Resources

Flooding is of great concern in fast-growing coastal communities, especially in the southeastern US, due to multiplying threats such as extreme precipitation, coastal storms, and rising sea levels. Contamination associated with stormwater runoff is often given less attention during stormwater planning and management decisions. The US EPA has long recognized that stormwater runoff is the biggest contributor to the impairment of water bodies in the US. In this study, we studied stormwater runoff contamination in a densely developed section of downtown Charleston, South Carolina, to better understand the extent of the problem and identify potential hotspots that could aid in …

South Carolina Sampling, Analysis, And Governance Of Per- And Polyfluoroalkyl Substances, Justin Kidd, Emily Fabricatore, Dennis Jackson May 2022

South Carolina Sampling, Analysis, And Governance Of Per- And Polyfluoroalkyl Substances, Justin Kidd, Emily Fabricatore, Dennis Jackson

Journal of South Carolina Water Resources

The extent of sampling, analytical, and governance guidelines for per- and polyfluoroalkyl substances (PFAS) in individual states is currently inconsistent. There are no federally mandated regulations on PFAS, and the geochemical variations within different states can lead to regionally specific PFAS contamination, resulting in state-specific guidelines for PFAS contamination in different environmental matrices. There are no facilities in South Carolina known to currently or previously produce PFAS; however, they may be used in the production of other goods at industries throughout South Carolina, including Class B firefighting foams, consumer items, packaging, and stain- and weather-resistant fabrics. We assessed the sampling, …

The Road To Resiliency For South Carolina Water Utilities Paved By Planning, Persistence, And Careful Navigation Of Realities And Hypotheticals, Kaleigh Sims, Megan Copsey, Chris Ericksen

Journal of South Carolina Water Resources

Planning for a resilient future from known and emerging threats is a topic of interest among many organizations, especially in the utility sector. South Carolina communities depend on reliable and safe sources of drinking water and generally do not anticipate interruptions or issues with their water providers. With the rate at which the state is growing, the dependency will only increase. SynTerra worked with five utilities in South Carolina to assess their risk and resilience and develop or update emergency response plans. This paper reports on key takeaways from this experience in an effort to provide guidance on lessons learned …
