Under What Circumstances Is The Shield Against Self-Incrimination Lowered In A Civil Action?, Andrew Hemming
Lincoln Memorial University Law Review Archive
The case of Pennsylvania v Cosby has brought into sharp relief the question of what criteria apply in determining whether a defendant in a civil action can definitively rely on a District Attorney’s purported statement that no further criminal action will be taken regarding the complaint in question. It is settled law that a defendant in a civil action faces the possibility of perjury charges for not telling the truth once the shield of the constitutionally enshrined Fifth Amendment right against self-incrimination is lowered by virtue of termination of criminal prosecution on the same facts. This article considers how best …

Cross-Modal Perception Of Identity By Sound And Taste In Bottlenose Dolphins, Jason N. Bruck, Sam F. Walmsley, Vincent M. Janik

While studies have demonstrated concept formation in animals, only humans are known to label concepts to use them in mental simulations or predictions. To investigate whether other animals use labels comparably, we studied cross-modal, individual recognition in bottlenose dolphins (Tursiops truncatus) that use signature whistles as labels for conspecifics in their own communication. First, we tested whether dolphins could use gustatory stimuli and found that they could distinguish between water and urine samples, as well as between urine from familiar and unfamiliar individuals. Then, we paired playbacks of signature whistles of known animals with urine samples from either the same …

Implementing A Presumption Against Imprisonment: How Scandinavian Sentencing Policies Could Be The Key To Ending Mass Incarceration In The United States, Cydney Carter
Lincoln Memorial University Law Review Archive
With the largest prison population in the world, the United States relies on incarceration more than most when it comes to sanctioning criminal offenders, but there must be another way. This paper will examine the sentencing policies and practices in the United States, Sweden, Finland, Denmark, and Norway. It will also compare these sentencing policies and their impact on incarceration rates suggest ways in which the Scandinavian sentencing practices could influence changes to the current Federal Sentencing Guidelines in order to combat mass incarceration in the United States.

A Comparative Approach Of The Development And Impact Of Victims’ Rights On Violence Against Women In The United States, Portugal, And Pakistan, Brianna Williams
Lincoln Memorial University Law Review Archive
In recent years, victims’ rights have received worldwide attention in regards to women’s rights and opportunities-or lack thereof. However, what are victims’ rights, how are women’s issues addressed under these rights, have they had their intended effect, are they adequately addressing modern issues, how have similar rights been implemented in other counties and are they working better? This article is a comparative law project between the United States, Portugal, and Pakistan evaluating victims’ rights in each country and any correlation between the presence and enforcement of victims’ rights and the impact they have had on violent crimes against women. By …
Traditionally Exclusive Limitations In The Digital Era:The Limitations On The State Action Doctrine And Its Inability To Protect Personal Freedoms From Big Tech, Richard Haygood
Lincoln Memorial University Law Review Archive
The intersection of censorship, free speech, and big tech is area of growing concern and interest. Every year, millions of users turn to social media platforms for myriad reasons, whether it be for the latest headline news, to pick up a recipe for dinner, or to share thoughts, feelings, or opinions. Yet despite the prevalence and importance of both Big Tech and social media platforms within our daily lives, there is very little anyone can do when their voice is silenced in the digital world. This Article focuses on one method claimants have attempted to use in order to find …

The Status Of Utah Black Women, Tasha Toy, Marin Christensen, Susan R. Madsen
Marketing and Strategy Faculty Publications
Utah is becoming increasingly diverse, and this has brought wide disparities between most minority groups and the White population in terms of education, housing, and health outcomes.1 Last year, the Kem C. Gardner Policy Institute at the University of Utah released a report on race, ethnicity, and sex that started the conversation more broadly, and now the Utah Women & Leadership Project (UWLP) is expanding and deepening this discussion by focusing a series of research snapshots on Utah women of color. As the UWLP focuses on strengthening the impact of all Utah girls and women, research that increases our …

Since independence, Indonesia's foreign policy has always changed. Although the doctrine of a free and active foreign policy that was first coined by the proclaimer Mohammad Hatta in 1948 has never changed, its practice depends on the approaches and interpretations taken by the ruling leaders. The old order leaned towards the eastern bloc, the new order tilted towards the western bloc, and the reform order was in a dilemma due to various domestic and international factors. Of the various political choices that have been made by the Indonesian authorities, which one is more beneficial to Indonesia's own national interests. This …

The relationship between age-related changes in brain structural connectivity (SC) and functional connectivity (FC) with cognition is not well understood. Furthermore, it is not clear whether cognition is represented via a similar spatial pattern of FC and SC or instead is mapped by distinct sets of distributed connectivity patterns. To this end, we used a longitudinal, within-subject, multimodal approach aiming to combine brain data from diffusion-weighted MRI (DW-MRI), and functional MRI (fMRI) with behavioral evaluation, to better understand how changes in FC and SC correlate with changes in cognition in a sample of older adults. FC and SC measures were …

Structural racism is endemic in the United States and causes inequitable health outcomes that have been amplified throughout the COVID-19 pandemic. Non-Hispanic Black, Hispanic/Latino, and Native American individuals have been disproportionately affected, and are twice as likely to be hospitalized or die from COVID-19 or related morbidities when compared to White Americans. Social determinants of health inequities contribute to these disparate outcomes, given that minoritized individuals are more likely to occupy essential worker roles and to live in high-density settings. Despite their higher risk of severe COVID-19 illness, racially and ethnically minoritized individuals are less likely to receive potentially lifesaving …

The purpose of this study was to investigate gender-based differences in gait biomechanics and to evaluate those effects on forces generated on the ACL during walking. Estimation of gender-specific ACL forces in the frontal plane can provide a better understanding of the biomechanical patterns underlying higher female injury risk. The present study used a sample from the Fels Longitudinal Study to test the hypothesis that there are significant gender-differences in frontal plane ACL loading during walking. A cross-sectional sample of 178 participants, including 79 males and 99 females was used to evaluate differences in gait kinetics. Females walked at higher …

In February 2022, using the Class Climate platform, we investigated reasons why students, staff and faculty at Andrews University received or did not receive the COVID-19 vaccine. Three hundred ninety-four (394) participated: students (47.4%), staff and faculty (48.4%), and others (4.1%). Significant differences in reasons were found between vaccinated and unvaccinated.
