Widespread Contamination Of Polychlorinated Biphenyls In South Carolina And North Carolina (Usa): A Legacy Of Malarial Eradication And Mosquito Control, James B. Glover, Deke T. Gundersen

Journal of South Carolina Water Resources

The South Carolina Department of Health and Environmental Control (SCDHEC) has been conducting fish tissue monitoring for Polychlorinated Biphenyls (PCBs) since 1974 and, based on the results, restrictive fish consumption advice has been in place at two reservoirs in South Carolina for several decades. But in 2009, widespread contamination was reported in fish from the Catawba-Wateree and Yadkin-Pee Dee River Basins. Therefore, beginning in 2010, additional monitoring of fish tissue for PCBs in the rivers and reservoirs of these two basins was initiated. Results from a spatial analysis, combined with evidence from historic literature, suggests that the source of the …

Borderline Personality Disorder Stigmatization: Bias, Discrimination, And Prejudice In The Healthcare Field, Briana L. Kunstman May 2022

Borderline Personality Disorder Stigmatization: Bias, Discrimination, And Prejudice In The Healthcare Field, Briana L. Kunstman

Psychology: Student Scholarship & Creative Works

Borderline Personality Disorder (BPD) is a personality disorder characterized by patterns of unstable moods, impulsive behaviors, and insecure relationships. Often misdiagnosed as Bipolar Disorder, BPD is difficult to diagnose due to its symptoms overlapping with many other conditions. There has been a reluctance to work with individuals who have BPD due to the surrounding stigma. In fact, healthcare workers tend to misunderstand BPD, and assume that those who have it are manipulative, aggressive, violent, and unable to be helped. This stigmatization has a profound impact on how BPD clients are seen in the healthcare field and furthermore how they receive …

Responsive Teaching And The Instructional Reasoning Of Expert Elementary Mathematics Teachers, Denise Lindstrom, Sarah Selmer May 2022

Responsive Teaching And The Instructional Reasoning Of Expert Elementary Mathematics Teachers, Denise Lindstrom, Sarah Selmer

Faculty & Staff Scholarship

This study examines instructional reasoning in an approximation of practice that simulates a teacher sitting down after class to examine students’ written work. The participants were prompted to attend to, interpret, and decide how to respond to student thinking contained in a piece of written work. Our purpose was to capture the additional cognitive work that teachers engage in. Using qualitative content analysis, we identified the most frequent types of instructional reasoning used by expert teachers just prior to engaging in a responsive deciding action about how to respond. We used the results of our analysis to present three illustrative …

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”2These words, penned by America’s Founding Fathers, have withstood the test of time, but not without great controversy. Sincethe founding of the United States, arms have played a vital and diverse rolein American history, fromdefending America in times of war to defending oneself and their property. The controversy surrounding the Second Amendment often lies in how far the right to bear arms extends. Do American citizens have the right to carry armsin public? If …

The Takings Clause Confronts The Police Power: How The Constitution’S Well-Known Protection Failed To Protect Jobs, Businesses, And The Broader Economy In The Name Of Covid-19, Ryan E. Cox

Lincoln Memorial University Law Review Archive

“This note, completed in the midst of the COVID-19 Pandemic, recounts the emergency orders issued by various levels of government in Tennessee and explains how those orders interplay with the Takings Clause of the Fifth Amendment to the United States Constitution. As the note explains in great detail, the limitations imposed on government by way of the Takings Clause, a well-known rule that essentially requires the government to pay citizens for property it takes, are thwarted by state governments’ police powers. Analogizing the COVID-19 Pandemic to a disease that kills apple trees, the note explains how the government can take …

Still Standing: Does The Government Ever Waive A Right To Challenge Standing In Fourth Amendment Cases?, Stefanie M. Bowen

Lincoln Memorial University Law Review Archive

While "standing" in Fourth Amendment cases is not a preliminary inquiry, perhaps it should be. When the government fails to object to a defendant's standing to challenge a Fourth Amendment search, there may be an opportunity to renew the objection on appeal. Your outcome is jurisdiction-specific. This article explores the reasons that the Supreme Court should again visit the question of standing with respect to Fourth Amendment searches and eliminate the government's ability to challenge standing for the first time on appeal.

Statutory Adoption Of The Objective Test For Entrapment As A Solution To Dubious Tactics In Federal Terrorism Investigations, Philip M. Gibson May 2022

Statutory Adoption Of The Objective Test For Entrapment As A Solution To Dubious Tactics In Federal Terrorism Investigations, Philip M. Gibson

Lincoln Memorial University Law Review Archive

Federal investigators and their informants frequently utilize questionable tactics which resemble entrapment in terrorism investigations. Despite the use of such tactics, entrapment has universally failed as an affirmative defense in federal terrorism cases. This is largely as a result of the subjective test for entrapment employed in federal courts which does not allow for a finding of entrapment if the defendant is found to be predisposed to commit the particular offense. This is especially damning for defendants in terrorism cases as they are frequently proponents of fringe political and religious ideologies or mentally ill which easily establishes predisposition for a …
