Protecting What Matters: Reflections On A Central Bank's Role At Times Of War, Iris H-Y Chiu, Alan H. Brener Oct 2022

Protecting What Matters: Reflections On A Central Bank's Role At Times Of War, Iris H-Y Chiu, Alan H. Brener

Vanderbilt Journal of Transnational Law

This Article explores the important and multifaceted roles of a central bank in extraordinary times of crisis such as war, focusing on the National Bank of Ukraine (NBU) and its responses in the face of the Russian invasion of Ukraine which began on February 24, 2022. During a time of martial law, institutional preservation and legitimacy can be threatened, but preserving these very institutional tenets is important in defending the nation under siege and in securing future restoration and rebuilding. In this light, we examine the NBU's difficult and conflicting choices in three respects: providing war finance, preserving banking and …

Money Grab: How The G20/Oecd Inclusive Framework For Taxation Could Unnecessarily Disrupt Corporate Incentives And Misallocate Taxing Rights, William T. Anderson Oct 2022

Money Grab: How The G20/Oecd Inclusive Framework For Taxation Could Unnecessarily Disrupt Corporate Incentives And Misallocate Taxing Rights, William T. Anderson

Vanderbilt Journal of Transnational Law

The Organisation of Economic Co-operation and Development (OECD) is proposing a dramatic shift to international corporate taxation that both sets a floor for corporate tax rates across the globe and transforms how countries obtain taxing rights over large multinational corporations. This Note focuses on the proposed framework for re-allocating taxing rights over corporations away from the traditional requirement of a physical presence in a country to mere revenues in a country. This Note identifies problems with the proposal as it relates to artificially altering corporate incentives and structures, as well as the proposal's incompatibility with theories of taxation- including Adam …

Self-Sensing Smart Products In Smart Manufacturing Systems, Juergen Lenz, Eric Macdonald, Ramy Harik, Thorsten Wuest

Faculty Publications

We are surrounded by a growing number of products with embedded intelligence relying on sensors and internet access. These smart products, that already transform our lives, are also physical entities that need to be manufactured. Manufacturing today similarly relies on data and data-driven insights to improve quality, efficiency, and safety on the shopfloor. This paper discusses the vision to utilize the ability of smart products to sense and communicate already during their own manufacturing to enrich the smart manufacturing system’s data for better insights development and optimization. We furthermore, discuss the barriers and opportunities embedded in such a paradigm shift.

Validation And Verification Of The Wray-Agarwal Turbulence And Algebraic Transition Models For 2d External Airfoil Flows, Dean Ryan-Simmons

McKelvey School of Engineering Graduate Student Theses & Dissertations

Validation and verification benchmark test cases are employed in computational fluid dynamics (CFD) to determine the best practices in application of various CFD tools. These cases focus on the geometry modeling, mesh generation, numerical algorithms, and turbulence models to ensure consistent and accurate numerical simulation of physical phenomena. Assessing model accuracy is essential to identify areas of improvement in various turbulence models. Flow past several symmetric NACA airfoils, namely NACA 0012, NACA 0015 and NACA 0018 are standard test cases for validating and evaluating turbulence models’ accuracy since the experimental data is available for these airfoils. Available wind tunnel data …

Time Criterion In Islamic Finance: Analytical Study In The Light Of Al-Zarqa's Rule Of Shariah Debts, Sami Ibrahim Al-Suwailem

Journal of King Abdulaziz University: Islamic Economics

This article presents the "Time Criterion" for identifying usurybased lending or ribā from trade and relates it to the concepts in economic theory. This criterion implies that the cost of financing cannot exceed the exchange value or utility if both parties were spot. Since the two parties are identical in a loan, the spot exchange will have no economic value; if Time is introduced, the cost of financing must be less than or equal to zero, which is a qard hasan or benevolent loan. The article also presents a mathematical formulation of the criterion which will demonstrate the acceptable range …

Evaluative Review Of Muhammad Zarqa's Research, Burhan Bin Al-Habib Al-Nafati Oct 2022

Evaluative Review Of Muhammad Zarqa's Research, Burhan Bin Al-Habib Al-Nafati

Journal of King Abdulaziz University: Islamic Economics

This article is an evaluative review of Muhammad Anas Zarqa's conclusions regarding framed maxims derived from the exegesis of the Qur’ānic verse "Allah has permitted trade and forbidden ribā (usury)" [AlBaqarah: 275] which he considers important to offer an economic interpretation to the verse. Dr. Zarqa believes that the reason why profit is permitted in exchanges that create debt is to determine the significant difference between the two transactions mentioned in the previous verse. This essay presents a refutation of the proposed maxim based on the imbalance of the continuity effect condition in some particulars, and the weakness of the …

Effects Of Ocean Acidification And Hypoxia On Stress And Growth Hormone Responses In Juvenile Blue Rockfish (Sebastes Mystinus), Hannah L. Bruzzio Oct 2022

Effects Of Ocean Acidification And Hypoxia On Stress And Growth Hormone Responses In Juvenile Blue Rockfish (Sebastes Mystinus), Hannah L. Bruzzio

Capstone Projects and Master's Theses

Global climate change is causing increasing ocean acidification (OA) and deoxygenation (hypoxia) of coastal oceans. Along the coast of California, where upwelling is a dominant seasonal physical process, these environmental stressors often co-occur and are intensified in nearshore ecosystems. For juvenile nearshore fishes, who spend a crucial developmental life stage in coastal kelp forests during the upwelling season, these stressors are experienced concurrently and may have large implications for fitness. Environmental stress can set off an endocrine response, which impacts physiology, energy allocation, growth, and behavior. To test the effects of climate change on juvenile blue rockfish, I measured the …

Confronting The Racial Pay Gap, Stephanie Bornstein Oct 2022

Confronting The Racial Pay Gap, Stephanie Bornstein

Vanderbilt Law Review

For several decades, a small body of legal scholarship has addressed the gender pay gap, which compares the median full-time earnings of women and men. More recently, legal scholars have begun to address the racial wealth gap, which measures racial disparities in family economic security and wealth accumulation. Yet a crucial component of both the gender pay gap and the racial wealth gap remains unaddressed in the legal literature: the pay gap between the earnings of White workers and workers of color. Today, all women average eighty-two cents to each dollar men earn, but Black and Latinx workers average only …

Policing The Police: Personnel Management And Police Misconduct, Max Schanzenbach Oct 2022

Policing The Police: Personnel Management And Police Misconduct, Max Schanzenbach

Vanderbilt Law Review

Police misconduct is at the top of the public policy agenda, but there is surprisingly little understanding of how police personnel management policies affect police misconduct. Police-civilian interactions in large jurisdictions are, in principle at least, highly regulated. But these regulations are at least partially counteracted by union contracts and civil service regulations that constrain discipline and other personnel decisions, thereby limiting a city’s ability to manage its police force. This Essay analyzes police personnel management by bringing forth evidence from a variety of data sources on police personnel practices as well as integrating an existing, but relatively siloed, literature …

Gravity And Grace: Foreign Investments And Cultural Heritage In International Investment Law, Valentina Vadi Oct 2022

Gravity And Grace: Foreign Investments And Cultural Heritage In International Investment Law, Valentina Vadi

Vanderbilt Journal of Transnational Law

Globalization and international economic governance have promoted dialogue and interaction among nations, potentially increasing cultural diversity and providing the funds to recover and preserve cultural heritage. However, these phenomena can also jeopardize cultural diversity. Foreign direct investments in the extraction of natural resources have the potential to change cultural landscapes, destroy monuments, and erase memories. In parallel, international investment law constitutes a legally binding and highly effective regime that demands that states promote and facilitate foreign direct investment. Does the existing legal framework adequately protect cultural heritage vis-a-vis the economic interests of foreign investors? To address this question, this Article …

Security Council Resolutions And The Double Function Of Explanation Of Votes, Mark Klamberg Oct 2022

Security Council Resolutions And The Double Function Of Explanation Of Votes, Mark Klamberg

Vanderbilt Journal of Transnational Law

UN Security Council resolutions are not always clear: they sometimes need to be interpreted. Members of the Security Council may make statements in connection with their votes, termed explanation of votes. Explanation of votes may have at least two functions. First, they may contribute to the formation of customary international law. Secondly, they can be used as a means for interpreting Security Council resolutions in relation to a specific situation or dispute. The present Article examines different trajectories of conversations to show how Security Council resolutions and explanation of votes may protect the status quo in some instances and act …

Defending Henrietta Lacks: Justification Of Ownership Rights In Separated Human Body Parts, Arseny Shevelev, Georgy Shevelev

Vanderbilt Journal of Transnational Law

Since the time of Moore v. Regents of the University of California, it has become a well-established and widespread view that a person, when their separated body parts are misappropriated, is forced to limit themselves to fiduciary and other non-proprietary claims against those who violate the bodily inviolability of their separated parts. Now, with the filing of a lawsuit in defense of the rights in body parts of the victim of racial discrimination, Henrietta Lacks, the judicial system has an opportunity to justify itself by adopting a different perception of rights in human body parts. This Article focuses on the …

Intact Polar Brgdgts In Arctic Lake Catchments: Implications For Lipid Sources And Paleoclimate Applications, Jonathan H. Raberg, Edgart Flores, Sarah E. Crump, Greg De Wet, Nadia Dildar, Gifford H. Miller, Áslaug Geirsdóttir, Julio Sepúlveda

Geosciences: Faculty Publications

Paleotemperature histories derived from lake sediment archives provide valuable context for modern and future climate changes. Branched glycerol dialkyl glycerol tetraether (brGDGT) lipids are a valuable tool in such pursuits due to their empirical correlation with temperature and near ubiquity in nature. However, the relative contributions of terrestrial and lacustrine sources of brGDGTs to lake sediments is site-dependent and difficult to constrain. Here, we explored the potential for intact brGDGTs—the complete lipids with polar head groups (HGs) still attached—to provide insight into the sources of brGDGTs on the landscape and their contributions to the sedimentary record in a set of …

"A Kind Of Insanity In My Spirits": Frankenstein, Childhood, And Criminal Intent, Melissa J. Ganz

English Faculty Research and Publications

Criminal responsibility in England underwent an important shift between the late seventeenth and early nineteenth centuries. Before this period, jurists focused less on whether a person meant to commit an act and more on whether the individual committed it. English law thus made little distinction between children and adults. In the late seventeenth and eighteenth centuries, however, criminal responsibility became linked to new ideas about human understanding. Jurists such as Matthew Hale and William Blackstone maintained that individuals could not be guilty of crimes unless they fully understood and intended the consequences of their actions. In this essay, I argue …

Using Some Natural Minerals To Remove Cadmium From Polluted Water, Monier M. Wahba, Wafaa M. Hashesh, Nesreen H. Abou-Baker

Baghdad Science Journal

Water scarcity is one of the most important problems facing humanity in various fields such as economics, industry, agriculture, and tourism. This may push people to use low-quality water like industrial-wastewater. The application of some chemical compounds to get rid of heavy metals such as cadmium is an environmentally harmful approach. It is well-known that heavy metals as cadmium may induce harmful problems when present in water and invade to soil, plants and food chain of a human being. In this case, man will be forced to use the low quality water in irrigation. Application of natural materials instead of …

Using Pomegranate Peel Extract To Change The Adverse Effect Of Ethephon By Enhancing Its Antioxidant, Anti-Inflammatory, And Anti-Apoptotic Effects In Rats, Hamid Mahmood Abdullah Daabo Oct 2022

Using Pomegranate Peel Extract To Change The Adverse Effect Of Ethephon By Enhancing Its Antioxidant, Anti-Inflammatory, And Anti-Apoptotic Effects In Rats, Hamid Mahmood Abdullah Daabo

Baghdad Science Journal

Organophosphorus insecticide and growth regulator namely Ethephon (2-chloroethylphosphonic acid) are widely used as a ripening process accelerator and a cultivation duration inhibitor. Pomegranate extract (PPE) has recently been taken into consideration due to its pharmacological effects especially those associated with renal diseases. Thus, this study aims to investigate the possible protective effect of PPE against ethephon-induced nephrotoxicity in rats. In this study four groups of adult male rats were divided into control group, PPE 400 mg/kg group, Ethephon 250 mg/kg group, and finally, PPE + Ethephon group (treated with the same dose of PPE group and Ethephon group). In the …

Human Face Recognition Based On Local Ternary Pattern And Singular Value Decomposition, Ali Nadhim Razzaq, Rozaida Ghazali, Nidhal Khdhair El Abbadi, Hussein Ali Hussein Al Naffakh

Baghdad Science Journal

There is various human biometrics used nowadays, one of the most important of these biometrics is the face. Many techniques have been suggested for face recognition, but they still face a variety of challenges for recognizing faces in images captured in the uncontrolled environment, and for real-life applications. Some of these challenges are pose variation, occlusion, facial expression, illumination, bad lighting, and image quality. New techniques are updating continuously. In this paper, the singular value decomposition is used to extract the features matrix for face recognition and classification. The input color image is converted into a grayscale image and then …

Preparation-And Spectroscopic Characterization Of Transition Metal Complexes With Schiff Base 2-[1-(1h-Indol-3-Yl)Ethylimino) Methyl]Naphthalene-1-Ol, Rasha Khiderhussain Al-Daffaay

Baghdad Science Journal

The ligand 2-[1-(1H-indol-3-yl)ethylimino) methyl]naphthalene-1-ol, derived from 1-hydroxy-2-naphthaldehyde and 2-(1H-indol-3-yl)ethylamine, was used to produce a new sequence of metal ions complexes. Thus ligand reactions with NiCl2.6H2O, PdCl2, FeCl3.6H2O and H2PtCl6.6H2O were sequentially made to collect mono-nuclear Ni(II), Pd(II), Fe (III), and Pt(IV). (IR or FTIR), Ultraviolet Reflective (UV–visible), Mass Spectra analysis, Bohr-magnetic (B.M.), metal content, chloride content and molar conductivity have been the defining features of the composites. The Fe(III) and Pt(IV) complexes have octahedral geometries, while the Ni(II) complex has tetrahedral geometry and the Pd (II) complex has square planer geometry, according to these findings.

The schizophoran superfamily Ephydroidea (Diptera: Cyclorrhapha) includes eight families, ranging from the well-known vinegar flies (Drosophilidae) and shore flies (Ephydridae), to several small, relatively unusual groups, the phylogenetic placement of which has been particularly challenging for systematists. An extraordinary diversity in life histories, feeding habits and morphology are a hallmark of fly biology, and the Ephydroidea are no exception. Extreme specialization can lead to “orphaned” taxa with no clear evidence for their phylogenetic position. To resolve relationships among a diverse sample of Ephydroidea, including the highly modified flies in the families Braulidae and Mormotomyiidae, we conducted phylogenomic sampling. Using exon …
