Antiracist Lawyering In Practice Begins With The Practice Of Teaching And Learning Antiracism In Law School, Danielle M. Conway
Antiracist Lawyering In Practice Begins With The Practice Of Teaching And Learning Antiracism In Law School, Danielle M. Conway
Utah Law Review
I was honored by the invitation to deliver the 2021 Lee E. Teitelbaum keynote address. Dean Teitelbaum was a gentleman and a titan for justice. I am confident the antiracism work ongoing at the S.J. Quinney College of Law would have deeply resonated with him, especially knowing the challenges we are currently facing within and outside of legal education, the legal academy, and the legal profession. I am fortified in this work by Dean Elizabeth Kronk Warner’s commitment to antiracism and associated diversity, equity, and inclusion work. Finally, I applaud the students who serve on the Utah Law Review for …

A Brown Buffalo’S Observations On Color (Blindness), Legal History, And Racial Justice In The Rocky Mountain West, Tom I. Romero Ii
Utah Law Review
This Essay is a series of observations about interrogating and complicating the meaning of color for all of us who call the Rocky Mountain West home. These observations are divided into three sections. First, in Part II, I explore what has long been the defining feature of race relations in the Rocky Mountain West—the persistent tension between the region as a racial utopia free from de jure racial inequities and the legacy of state-sanctioned racial violence and deep-rooted nurturing of White supremacy. Trekking through some of the legalscapes of property, state constitutional, civil rights, and martial law, this section spotlights …
Dei In The Legal Profession: Identifying Foundational Factors For Meaningful Change, Robert Razzante, Breanta Boss
Dei In The Legal Profession: Identifying Foundational Factors For Meaningful Change, Robert Razzante, Breanta Boss
Utah Law Review
In this Essay, we offer a critical communication pedagogy as one particular framework for using dialogue “a process of sensitive and thorough inquiry . . . to (de)construct ideologies, identities, and cultures.”70 Such an educational space can serve as an outlet for students to process their cognitive dissonance regarding difference at the intrapersonal level—our fourth factor. Intrapersonal factors, such as cognitive dissonance, if not affirmed and processed, can lead to the continual questioning of one’s place within law school and the legal profession—a continual feeling of imposter syndrome.
Filing While Black: The Casual Racism Of The Tax Law, Steven A. Dean
Filing While Black: The Casual Racism Of The Tax Law, Steven A. Dean
Utah Law Review
The tax law’s race-blind approach produces bad tax policy. This essay uses three very different examples to show how failing to openly and honestly address race generates bias, and how devasting the results can be. Ignoring race does not solve problems; it creates them. ProPublica has shown, for example, that because of the perils of filing income taxes while Black, the five most heavily audited counties in the United States are Black and poor.
The racial bias long tolerated—and sometimes exploited—by tax scholars and policymakers affects all aspects of the tax law. In 1986, Sam Gilliam was denied tax deductions …
Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe
Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe
Utah Law Review
Law schools must recognize and seek to remove the barriers to teaching cultural competence and DEI and provide appropriate training and workshops for law professors. Providing law professors with the tools to integrate cultural competency into existing curricula is a first and crucial step to ensure that law professors are well-versed in both their own cultural competency, and in the ability to provide cultural competency training to their students. The culturally competent student will become a culturally competent lawyer with the skillset to make impactful contributions towards DEI in and beyond the practice of law.
What Law Schools Should Leave Behind, L. Danielle Tully
What Law Schools Should Leave Behind, L. Danielle Tully
Utah Law Review
Legal education is at a crossroads, again. Perhaps the more apt transportation metaphor is that legal education is stuck in a roundabout. Crossroads require introspection and decision-making. You can’t move past a crossroad without making an affirmative choice. Roundabouts provide the illusion of movement while keeping you in one place. But don’t be fooled; staying in the roundabout is still a choice.
2020 disrupted this lull. Amid a polarizing political climate, state-sanctioned violence, and the coronavirus pandemic, students said enough. They were right: Enough. Staying in the roundabout right now, choosing the status quo, might be expedient; but it’s also the …
Pivoting Under Pressure: Cultural Proficiency, Race, And Reforms, Anastasia M. Boles
Pivoting Under Pressure: Cultural Proficiency, Race, And Reforms, Anastasia M. Boles
Utah Law Review
There is a new conversation in legal education about a pernicious problem. As the COVID-19 pandemic raged in spring 2020, legal educators around the country had to pivot to remote teaching. At the same time, racial protests erupted in response to the brutal and successive killings of Ahmaud Arbery, Breonna Taylor, and George Floyd. As law schools grappled with the pressure of the latest racial reckoning, Black law faculty and students demanded cultural change within legal education in response to their devastation, desperation, battle fatigue, and frustration. Unwilling to accept the performative diversity efforts of the past, there was a …

Like everything else, the reference desk and the way we provide service at it has changed. What hasn’t changed is the need for assistance with difficult information seeking tasks. Libraries receive fewer questions in the background information area (e.g. dates, places) these days but spend time on more complex research questions. DePauw Libraries seek to meet the needs of researchers by staffing the research desk with trained students and making librarians readily available for one-on-one collaboration.

The brown rot fungus Fomitopsis pinicola efficiently depolymerizes wood cellulose via the combined activities of oxidative and hydrolytic enzymes. Mass spectrometric analyses of culture filtrates identified specific proteins, many of which were differentially regulated in response to substrate composition.
Adult Day Services In Maine: Benefits, Challenges, And Opportunities, Elizabeth Gattine Jd, Eileen Griffin Jd, Kimberly I. Snow Mhsa, Ba
Adult Day Services In Maine: Benefits, Challenges, And Opportunities, Elizabeth Gattine Jd, Eileen Griffin Jd, Kimberly I. Snow Mhsa, Ba
Disability & Aging
In Maine and nationally, adult day services tend to be underfunded and underutilized compared to other types of long term services and supports (LTSS). In part, investment in adult day services is hampered by a lack of standardized data collection and limited research on issues of accessibility, cost-effectiveness, and the impact of adult day services on the broader health system. Lack of uniformity in state regulatory frameworks for licensing, program design, service delivery, and other administrative requirements further complicates cross-state comparisons. Considering these limitations, a key goal of this report is to provide a more detailed and comprehensive understanding of …

The Rise And Fall Of Group Libel: The Forgotten Campaign For Hate Speech Laws, Samantha Barbas
The Rise And Fall Of Group Libel: The Forgotten Campaign For Hate Speech Laws, Samantha Barbas
Journal Articles
It is well-known that there is no “hate speech” law in the United States. This has been criticized, especially given the existence of robust hate speech laws in other nations. The absence of hate speech laws in American law has been attributed to legal, cultural, and historical factors, including speech protective First Amendment jurisprudence and long-standing skepticism of group reputation as an interest worthy of legal protection.
This Article presents another reason for the absence of hate speech laws in America: the failure of a large-scale social movement in the 1940s to pass hate speech laws or “group libel” laws, …

Screening Families In Primary Care For Social And Economic Needs: Patients’ Urgency And Activation For Social Care Navigation, Sarah D. Ronis, Marie Masotya, Kurt C. Stange
Faculty Scholarship
Introduction: Social determinants of health (SDoH) screening and intervention in primary care aim to alleviate adverse influences on health, but its efficacy may be diluted when offered supports are not well matched to families’ desire for such services. The purpose of this prospective cohort study was to provide guidance to social care navigation teams regarding which families would be most likely to make use of services. Methods: Analysis of registry data collected in April 1–September 30, 2021 from a social care navigation program embedded in a medical home was conducted. Multivariable regression models explored (1) whether family-reported urgency of needs, …

Background: Transesophageal echocardiography (TEE) is an essential tool in many structural heart procedures, such as transcatheter mitral valve edge-to-edge repair (TEER). Interventional procedural TEE requires a unique skill set. This study aims to evaluate the complexity of interventional structural heart TEE used to guide TEER compared with standard of care (SOC) TEE studies performed at a single center.
Methods: A retrospective case-control analysis was performed of 200 patients who underwent TEE in the Henry Ford Health System. One hundred cases of interventional TEE-guided TEER were compared with 100 controls of SOC TEE. Complexity was quantified by the total duration of …

Background: Estimating the risk of complications in chronic total occlusion (CTO) percutaneous coronary intervention (PCI) facilitates risk-benefit assessment and procedural planning.
Methods: We analyzed the Prospective Global Registry for the Study of Chronic Total Occlusion Intervention (PROGRESS-CTO; NCT02061436) and created a risk score for in-hospital major adverse cardiovascular events (MACE). Logistic regression prediction modeling was used to identify independently associated variables and the model was internally validated with bootstrapping.
Results: Of the 10,480 CTO PCI cases performed between 2012-2022 at 40 US and non-US centers, in-hospital MACE occurred in 215 (2.05%). The final prediction model identified 5 independent predictors of …

Background: The impact of proximal cap ambiguity on procedural techniques and outcomes of chronic total occlusion (CTO) percutaneous coronary intervention (PCI) has received limited study.
Methods: We examined the clinical and angiographic characteristics and procedural outcomes of 11,169 CTO PCIs performed in 10,932 patients at 42 US and non-US centers between 2012 and 2022.
Results: Proximal cap ambiguity was present in 35% of CTO lesions. Patients whose lesions had proximal cap ambiguity were more likely to have had prior PCI (65% vs 59%; P < 0.01) and prior coronary artery bypass graft surgery (37% vs 24%; P < 0.01). Lesions with proximal cap ambiguity were more complex with higher J-CTO score (3.1 ± 1.0 vs 2.0 ± 1.2; P < 0.01) and lower technical (79% vs 90%; P < 0.01) and procedural success (77% vs 89%; P < 0.01) rates compared with non-ambiguous CTO lesions. The incidence of major adverse cardiovascular events (MACE) was higher in cases with proximal cap ambiguity (2.5% vs 1.7%; P < 0.01). The retrograde approach was more commonly used among cases with ambiguous proximal cap (51% vs 21%; P < 0.01) and was more likely to be the final successful crossing strategy (29% vs 13%; P < 0.01). PCIs of CTOs with ambiguous proximal cap required longer procedure time (140 [95-195] vs 105 [70-150] min; P < 0.01) and more contrast volume (225 [160-305] vs 200 [150-280] mL; P < 0.01).
Conclusion: Proximal cap ambiguity in CTO lesions is associated with higher utilization of the retrograde approach, …

In open-source software, it is known that there are many concurrency bugs. A previous study in Go revealed that a considerable number of such bugs are simple (for example, 9% of the bugs are the ones that forget to unlock a mutex,) through a manual program investigation. This paper tries to detect such bugs by applying a simple analysis to see how far such a tool can match the manual analysis. We built a simple intraprocedural control flow analysis in Go, and evaluated its performance concerning the open source programs with concurrency bugs reported in the previous study. Consequently, as …

ZrB2 was mixed with 0.5 wt% carbon and up to 10 vol% ZrC and densified by hot-pressing at 2000 °C. All compositions were > 99.8% dense following hot-pressing. The dense ceramics contained 1–1.5 vol% less ZrC than the nominal ZrC addition and had between 0.5 and 1 vol% residual carbon. Grain sizes for the ZrB2 phase decreased from 10.1 µm for 2.5 vol% ZrC to 4.2 µm for 10 vol% ZrC, while the ZrC cluster size increased from 1.3 µm to 2.2 µm over the same composition range. Elastic modulus was ~505 GPa and toughness was ~2.6 MPa·m½ for all compositions. …
