Certain Prosecutors: Geographical Arbitrariness, Unusualness, & The Abolition Of Virginia’S Death Penalty, Bernadette M. Donovan
Washington and Lee Journal of Civil Rights and Social Justice
Virginia’s abolition of the death penalty in 2021 was a historic development. As both a southern state and one of the country’s most active death penalty jurisdictions, Virginia’s transition away from capital punishment represented an important shift in the national landscape. This article considers whether that shift has any constitutional significance, focusing on the effect of Virginia’s abolition on the geographical arbitrariness of the country’s death penalty.
As a starting point, the death penalty in America is primarily regulated by the Eighth Amendment, which bars “cruel and unusual punishments.” The United States Supreme Court has held that the death penalty …

Twenty years ago, in Atkins v. Virginia, the Supreme Court of the United States held that the Eighth Amendment prohibited states from executing persons with intellectual disability. While the Court’s decision is laudable and has saved many of the most vulnerable persons from the executioner, its effect has been undermined by recalcitrant states attempting to exploit language in the opinion permitting states to create procedures to implement the (then) new categorical prohibition. In this article, we examine how some states have adopted procedures which are fundamentally inconsistent with the clinical consensus understanding of the disability and how one state, …

The concept of lynching, several hundred years old and unclear in its origins, has never really left the lexicon. The word itself, however, has taken on different meanings over the years, from a mob’s taking the law into its own hands, to an organized utilization of racial violence as a means of societal control and intimidation; and finally to the more casual and defensive use of the word (“high tech lynching”) by current Supreme Court justices Thomas and Kavanaugh and others after being questioned about their past behaviors. Wiretapping The Internet: Analyzing The Application Of The Federal Wiretap Act’S Party Exception Online, Hayden Driscoll

The federal Wiretap Act—originally enacted to curtail the government’s unbridled use of wiretaps to monitor telephonic communications—was amended in 1986 to provide a private right of action, extending the Act’s Fourth Amendment-like protections to private intrusions. Since the advent of the internet, plaintiffs have attempted to predicate claims of unauthorized online privacy intrusions on the Wiretap Act. In response, defendants claim they are parties to the communications at issue and should be absolved of liability under the Act’s party exception. The federal circuit courts of appeal disagree on how the party exception applies in the internet context. This Note evaluates …

In July 2020, the New York Times published an article on a Department of Justice report detailing the systematic abuse of incarcerated individuals by prison guards within the State of Alabama’s Department of Corrections. This report evidences the challenges faced by incarcerated individuals seeking to vindicate their Eighth Amendment rights. In a legal sense, those individuals who turn to the court system for relief face an almost insurmountable burden of proof. Congenital heart disease (CHD) is a common birth defect in the United States. CHD infants are more likely to have smaller head circumference and neurodevelopmental delays; however, the cause is unknown. Altered cerebrovascular hemodynamics may contribute to neurologic abnormalities, such as smaller head circumference, thus we created a novel Cerebrovascular Stability Index (CSI), as a surrogate for cerebral autoregulation. We hypothesized that CHD infants would have an association between CSI and head circumference. We performed a prospective, longitudinal study in CHD infants and healthy controls. We measured CSI and head circumference at 4 time points (newborn, 3, 6, 9 months). …

Natural language models and systems have been shown to reflect gender bias existing in training data. This bias can impact on the downstream task that machine learning models, built on this training data, are to accomplish. A variety of techniques have been proposed to mitigate gender bias in training data. In this paper we compare different gender bias mitigation approaches on a classification task. We consider mitigation techniques that manipulate the training data itself, including data scrubbing, gender swapping and counterfactual data augmentation approaches. We also look at using de-biased word embeddings in the representation of the training data. We …

This presentation will discuss the application of principles from Cal Newport’s Deep Work within an academic library. An internal book club was the catalyst for individuals to experiment with different time management strategies and led to the implementation of a “Meeting-free Morning” for library faculty to cultivate deeper work.

The Book of Enoch is a non-canonical text that is often referenced in later Judeo-Christian apocalyptic texts and mythology. Enoch scholarship is limited to the past two centuries due to its status as a “lost” work; research has only recently begun. Most prior scholars focused their research on examining the text through the lens of form and historical criticism. They sought to define the genre, to contextualize the book, to determine its authorship, and simply to translate the text from various languages. Confucianism is not only a historically important belief system, but it also continues to be rooted in many societies today, particularly in East and Southeast Asia. The growing influence of some of these Confucian-ingrained societies on the international stage justifies expanding the limited literature present on Confucianism and its societal implications. Using a conceptualization of heavily influenced Confucian societies previously set out by earlier research, this paper evaluates the validity of the common age-old assumption that Confucianism is correlated with greater gender inequality, as determined by the World 2016 dataset. This fictional work is based on Euthyphro by Plato and Dialogues Concerning Natural Religion by David Hume. It mimics the dialogue style of these authors and places Socrates, Cleanthes, and Philo at Gettysburg College to discuss the existence and nature of God along with the author, a Gettysburg College student. In doing so, it shows how the questions asked by Plato and Hume are relevant today.

This work investigates media framing done by CNN between the 2016 and 2020 presidential elections. Although Latinx voters remain underrepresented and under researched, they have the ability to highly influence elections. Specifically, CNN uses the sleeping giant frame, the need for Latinx voter registration as a frame, and the importance of Latinx voter mobilization as a frame in the 2020 presidential election more prominently than in the 2016 presidential election upon consideration of Latinx vote choice and voter turnout.

This paper is a literature review on the subject Age-Related Macular Degeneration (AMD) with a focus on its etiology, pathophysiology, clinical features, diagnosis, treatment, and prevention. AMD is the leading cause of severe and irreversible central vision loss in in individuals over the age of 55. There are two subtypes of AMD referred to as dry and wet respectively. The etiology of this disease is multifactorial and complex, with no hallmark of disease definitively identified. The distinct pathophysiological features differing in dry and wet AMD are explored in this review as well as its diagnosis and treatment. This disease is …

Kentucky Transportation Center Research Report
Each year the Kentucky Transportation Center publishes Analysis of Traffic Crash Data in Kentucky, a report that reviews state-level crash data from the previous five years. This report summarizes crash data for 2017 through 2021. In addition to presenting a review of crash data, the report also contains safety performance functions (SPFs) for nine roadway types. Because SPFs were derived using 2017-2021 data, the models predict crashes for a five-year period. Users must adjust the model by adding a coefficient of 1/5 to models to avoid overestimating crashes by a factor of five.

The role of African American parents in education reform initiatives in Chicago is not clearly defined. Local School Councils (LSC) allow parents to make school related decisions in Chicago. But LSCs are removed from decisions about whether or not to place school on or off probation, and whether or not to close schools based on performance or building utilization. In 2013, African American and Latinx parents expressed outrage over the decision by Chicago Public Schools (CPS) to close 49 schools with protests, including a hunger strike by a group of parents, and pleas to the Chicago Board of Education (BOE). …

Four of the eight Engineering Standards in the Next Generation Science Standards (NGSS, 2013) focus on authentic science communication: “asking questions (science) and defining problems (engineering), analyzing and interpreting data, constructing explanations (for science) and designing solutions (for engineering), engaging in argument from evidence, obtaining, evaluating and communicating information” (Sampson et al., 2010, p. 218). Authentic science communication is supported in NGSS through cross-cutting concepts (Driver et al., 2000) that integrate the structure and function of science concepts together with communication strategies that include reading, writing, and peer critique. The Magnetic Field Thus Controls Both The Magnitude And Sign Of The Dipolar Potential. The availability of historical flood data is vital in recognizing weather-related trends and outlining necessary precautions for at-risk communities. Flood frequency, magnitude, endurance, and volume are traditionally recorded using established streamgages; however, the material and installation costs allow only a few streamgages in a region, which yield a narrow data selection. In particular, stage, the vertical water height in a water body, is an important parameter in determining flood trends. This work investigates a low-cost, compact, rapidly-deployable alternative to traditional stage sensors that will allow for denser sampling within a watershed and a more detailed record of flood events. Changes to labor law by the National Labor Relations Board are nothing new; changes in Presidential administrations often result in changes to the law, based on differences in philosophy by new majorities of the Board toward the proper interpretation of the National Labor Relations Act. But in2020, the Board made a fundamental change to long-standing interpretations of the Act’s protections for union and other concerted activities, not based on the Act itself, but based on what it said were the mandates of the anti-discrimination laws for employers to prevent harassment and discrimination.
