Conditional Purging Of Wills, Mark Glover Mar 2023

Conditional Purging Of Wills, Mark Glover

University of Richmond Law Review

The laws of most states unconditionally purge a testamentary gift to an individual who serves as an attesting witness to the will. Under this approach, the will is valid despite the presence of an interested witness, but the witness forfeits all, some, or none of her gift, depending on the particularities of state law. While the outcome of the interested witness’s gift varies amongst the states that adhere to this majority approach, the determination of what the interested witnesses can retain is the same. The only consideration is whether the beneficiary is also a witness; whether her gift is purged …

Grandma Got Arrested: Police, Excessive Force, And People With Dementia, Rashmi Goel

University of Richmond Law Review

Recent events have shone a light on the particular vulnerability of people with dementia to police violence. Police are arresting people with dementia and using excessive force to do it—drawing their firearms, deploying tasers, and breaking bones.

To date, little attention has been paid to the burgeoning number of people with dementia, one of society’s most vulnerable populations, and their experiences with the criminal justice system. This Article examines how dementia leads people to engage in activity that appears criminal (shoplifting (forgetting to pay), and trespass (wandering), for instance) and the disproportionate response of police. In several cases where people …

Resolving Regulatory Threats To Tenure, Joseph W. Yockey Mar 2023

Resolving Regulatory Threats To Tenure, Joseph W. Yockey

University of Richmond Law Review

Many lawmakers and public university governing boards are looking to curb faculty tenure. Driven by both ideological and economic motives, recent efforts range from eliminating tenure systems altogether to interfering when schools seek to tenure individual, often controversial scholars. These actions raise serious questions about higher education law and policy and have important implications for the future of academic freedom. Indeed, if they gain further traction, current regulatory threats to tenure will jeopardize the ability of American universities to remain at the forefront of global research and intellectual progress.

This Article examines the growing anti-tenure sentiment among state officials and …

“Fundamental Fairness”: Finding A Civil Right To Counsel In International Human Rights Law, Meredith Elliott Hollman Mar 2023

“Fundamental Fairness”: Finding A Civil Right To Counsel In International Human Rights Law, Meredith Elliott Hollman

University of Richmond Law Review

Every other Western democracy now recognizes a right to counsel in at least some kinds of civil cases, typically those involving basic human rights. The World Justice Project’s 2021 Rule of Law Index ranked the United States 126th of 139 countries for “People Can Access and Afford Civil Justice.” Within its regional and income categories, the United States was dead last. The United Nations and other international treaty bodies have urged the United States to improve access to justice by providing civil legal aid. How did we fall behind, and what can we learn from the rest of the world? …

Cftc & Sec: The Wild West Of Cryptocurrency Regulation, Taylor Anne Moffett Mar 2023

Cftc & Sec: The Wild West Of Cryptocurrency Regulation, Taylor Anne Moffett

University of Richmond Law Review

Over the past few years, a turf war has been brewing between the Commodity Futures Trading Commission (“CFTC”) and the Securities and Exchange Commission (“SEC”) over which agency should regulate cryptocurrencies. Both agencies have pursued numerous enforcement actions over the cryptocurrencies they believe to be within their jurisdiction. This turf war has many moving components, but the focus always comes back to one question: which cryptocurrencies are commodities, and which cryptocurrencies are securities? The distinction is important because the CFTC has statutory authority to regulate commodities, whereas the SEC has statutory authority to regulate securities. This Comment rejects the pursuit …

Merging Black Holes: Assessing The Performance Of Two Analytic Gravitational Waves Models, Dillon Buskirk, Maria Babiuc-Hamilton Mar 2023

Merging Black Holes: Assessing The Performance Of Two Analytic Gravitational Waves Models, Dillon Buskirk, Maria Babiuc-Hamilton

Physics Faculty Research

Merging black holes produce the loudest signal in the detectors. However, this is the most difficult signal to accurately predict with analytical techniques. Only computer simulations can account for the nonlinear physics during the collision, but they are inherently complex, costly, and affected by numerical errors. In order to bypass this problem, two analytical models for the merger have been developed: the Implicit Rotating Source (IRS) and the newer Backwards one Body (BoB). In this work, we assess the performance of the BoB model by comparing it with the older IRS model and with the numerical data, identifying its strengths …

Psychosocial Needs Of Pediatric Patients With Cancer Predisposition Syndromes: Standardized Screening Needed, Meredith Ehrhardt, Mirae Fornander, Rachel Moore Mar 2023

Psychosocial Needs Of Pediatric Patients With Cancer Predisposition Syndromes: Standardized Screening Needed, Meredith Ehrhardt, Mirae Fornander, Rachel Moore

Posters

Introduction Cancer predisposition syndromes (CPS; e.g., Li-Fraumeni syndrome, Von Hippel-Lindau syndrome) require routine, standardized medical monitoring with accompanying unique, complex psychosocial needs (e.g., family medical needs). Despite limited research within pediatric populations, emerging literature has begun to support the benefit of routine psychosocial screening in this population. Very few pediatric CPS clinics with dedicated psychosocial care (i.e., psychology) exist in the U.S. and there is currently no standard of care for psychosocial support of CPS patients. This study aims to better understand the psychosocial needs of pediatric CPS patients and support the need for a standardized psychosocial screening protocol among …

The Role Of The Novel Diguanylate Cyclase Pg_0686 In Oxidative Stress Resistance In Porphyromonas Gingivalis W83, Alexia Danielle Ximinies

Loma Linda University Electronic Theses, Dissertations & Projects

The survival/ adaptation of Porphyromonas gingivalis to the inflammatory environment of the periodontal pocket requires an ability to overcome oxidative stress. Several functional classes of genes, depending on the severity and duration of the exposure, were induced in P. gingivalis under H2O2-induced oxidative stress, including the PG0686 gene which was upregulated ca. 10-fold. In addition, its upregulation was also observed in the presence of oxygen and nitric oxide. This study is aimed to further characterize the function of this gene in response to H2O2. PG_0686, annotated as a hypothetical protein of unknown function, is a 60 kDa protein with a …

Ultrastructural Findings Of Budding Ballooning Clusters Are Best Correlated With Punctate Autoimmune Antibodies Seen By Immunofluorescence In Minimal Change Disease, Vasudevan Mahalingam, Seyedalireza Fatemi, Wei Li, Hassan Kanaan, Ping Zhang

Conference Presentation Abstracts

Background: The etiology of minimal change disease (MCD) remains a mystery as the only hallmark findings are the diffuse effacement of foot processes by electron microscopy (EM). Punctate IgG staining floating outside of glomerular capillary loops have recently been identified as autoimmune antibodies against nephrin in podocytes from a set of MCD cases (Watts AJB et al., JASN 2022;33:238-252). The corresponding ultrastructural findings by EM, however, of the autoimmune antibodies are not yet described. We hypothesized that budding ballooning clusters (BBC) seen in EM may be correlated with the punctate IgG staining granules. Design: We identified 7 patients with MCD …

A Case Of Hereditary Hemorrhagic Telangiectasia With Juvenile Polyposis Syndrome Associated With Smad4 Mutation, Mai Elzieny, Ashbita Pokharel, Zhenhong Qu

Conference Presentation Abstracts

Background: Hereditary hemorrhagic telangiectasia (HHT), also called Osler–Weber–Rendu syndrome, is an autosomal dominant disease characterized by aberrant blood vessel development throughout the body that results in telangiectasias, arteriovenous malformations (AVMs), and arteriovenous fistulas. Pathogenic variants in multiple genes can cause HHT, with three major disease associated genes, one of which is SMAD4. HHT caused by mutations in SMAD4 is also associated with juvenile polyposis syndrome (JPS), a condition termed JPS-HHT. Histologic features of HHT polyps have not been well characterized other than their non-adenomatous nature. Here we attempt to characterize the histologic features of such polyps in this typical case …

Colon Adenocarcinoma And Birt-Hogg-Dubé Syndrome In A Young Patient: Case Report And Exploration Of Pathologic Implications, Grant W. Jirka, Daniel S. Lefler, Jessica Russo, Babar Bashir

Department of Medical Oncology Faculty Papers

Birt–Hogg–Dubé syndrome (BHD) is an autosomal dominant disorder caused by germline mutations in the folliculin gene (FLCN) that result in the functional loss of the tumor suppressor folliculin. It is classically associated with cutaneous hamartomas, pulmonary cysts with spontaneous pneumothorax, and various renal cancers. In this case, we present a patient initially diagnosed with chromophobe renal cell carcinoma and subsequently found to have colorectal cancer (CRC). The presence of two separate malignancies in a young patient with a strong family history of CRC (father and paternal grandfather) led to genetic testing, which revealed an FLCN c.1177–5_1177-3del mutation, and a diagnosis …

Refining Statutory Construction: Contextualism & Deference Mar 2023

Refining Statutory Construction: Contextualism & Deference

The University of New Hampshire Law Review

This Article urges a novel structure for marrying statutory construction and Chevron deference into a paradigm best described as contextualism. All too often jurists and scholars describe modern statutory construction as dominated by textualism. Textualism is too simplistic and obscures how invariably courts employ a contextualist analysis when construing language. Contextualism, not textualism, is—and always has been—the paradigm for statutory construction. Focusing on contextualism in lieu of textualism promotes an acute focus on what aids in construction a court is willing to entertain, and the Article illustrates that liberal and conservative judges alike employ a contextual analysis while they may …

Total Vote Runoff: A Majority-Maximizing Form Of Rank Choice Voting Mar 2023

Total Vote Runoff: A Majority-Maximizing Form Of Rank Choice Voting

The University of New Hampshire Law Review

Total Vote Runoff (TVR) is an electoral system designed to be identical to Instant Runoff Voting (IRV), which is the most commonly understood and implemented form of Ranked Choice Voting (RCV) in the United States, except for one key detail. Like IRV, TVR sequentially eliminates the weakest candidate on the ranked-choice ballot when no candidate is ranked first on a majority of ballots. Unlike IRV, however, TVR identifies the weakest candidate to be eliminated based on the total votes each candidate receives on all the ballots, rather than just the number of first-place votes (as IRV does). A candidate’s total …
