Toothless Trade? Implications Of The Federal Circuit’S Clearcorrect Decision For The Enforceability Of Intellectual Property Protections In Digital Trade Under Usmca, Alissa Chase Mar 2023

Toothless Trade? Implications Of The Federal Circuit’S Clearcorrect Decision For The Enforceability Of Intellectual Property Protections In Digital Trade Under Usmca, Alissa Chase

Catholic University Law Review

Digital trade is growing faster than trade in goods and services and comprises a key area for innovation and intellectual property concerns. The United States-Mexico-Canada Agreement (“USMCA”) acknowledged this development by including chapters devoted to both digital trade and intellectual property. In 2015, the Federal Circuit held that the International Trade Commission (“ITC”) does not have jurisdiction over unfairly traded digital goods. Without exclusion orders issued by the ITC, the United States lacks a powerful tool to enforce the USMCA provisions protecting intellectual property in unfairly traded digital goods. This comment explores the implications of the Federal Circuit’s 2015 ClearCorrect …

Federal Protection Of Illegal Short-Term Rentals: How The Protecting Local Authority And Neighborhoods Act Will Hold Airbnb Liable, Enforcing Local Regulations, Nicole Schaeffer

Catholic University Law Review

Section 230 has come under scrutiny from academics and politicians, leading to calls on lawmakers to limit, or even end, Section 230’s immunity for Internet corporations; however, less attention has been given to the effects of Section 230 on the legal landscape in local, off-line communities. Online providers of short-term rental (STR) services such as Airbnb have used Section 230’s protection to shift the burden of complying with local laws and lease agreements onto the users listing STRs. By wielding Section 230 as both a sword and shield in litigation over their listings that violate local laws and lease agreements, …

Deciphering The N-Glycomic And Collagen Proteomic Molecular Signatures Towards Breast Cancer Control And Prevention, Denys Rujchanarong Mar 2023

Deciphering The N-Glycomic And Collagen Proteomic Molecular Signatures Towards Breast Cancer Control And Prevention, Denys Rujchanarong

MUSC Theses and Dissertations

Breast cancer is the most diagnosed cancer among women worldwide and the incidence rates are rising annually. The rates of metastatic breast cancer are projected to increase by 54.3% from 2015 to 2030. Breast stroma plays a significant role in breast cancer risk and progression yet remains poorly understood. In breast stroma, regulation of post-translational modifications (PMTs) is representative of the health state of the local microenvironment. Two abundant PTMs in the extracellular matrix include hydroxylation of prolines (HYP) and N-glycosylation in collagen and non-collagen proteins, respectively. Here, mass spectrometry imaging (MSI) was used to investigate the spatial N-glycomic and …

Nebraska Water Center: Faculty Publications

Extreme climate events including heat waves and droughts are projected to become more frequent under future climate change conditions. However, the mechanisms between soybean yields and climate factors, specifically involving variable rainfall and high heat episodes, are still unclear, particularly with respect to spatial trends in the United States (US) Midwest. A recently modified version of the model GLYCIM was used to evaluate rainfed soybean production across 12 states at a 10 km spatial resolution for three time periods (2011–2020, 2051–2060, 2091–2099) under Representative Concentration Pathway (RCP) scenarios 4.5 and 8.5. Results showed that except for the northernmost Midwest counties, …

Creating Habitat Suitability Models For Restoration Of Sesbania Tomentosa And Chenopodium Oahuense On Molokai, Hawaii, Bronwyn Meldrum

Undergraduate Honors Theses

Hawaii is home to incredible diversity in both plant and animal life. Nearly 90% of Hawaii’s 1,400 plant taxa are found nowhere else in the world, and in an ecosystem threatened by invasive species and terrain alteration, this puts them at risk of extinction. As pressures on global biodiversity intensify, conservation efforts and restoration of endangered species are of the utmost importance. The Molokai Land Trust is actively working to eradicate invasive kiawe (Prosopis pallida) forests and to restore endemic species and other native vegetation on the Mokio Preserve. These vital efforts are made more difficult because the …

What Is The Effect Of Opioid Use During Pregnancy On Infant Health And Wellbeing At Birth?, Jessica Pac, Christine Durrance, Lawrence Berger, Deborah Ehrenthal Mar 2023

What Is The Effect Of Opioid Use During Pregnancy On Infant Health And Wellbeing At Birth?, Jessica Pac, Christine Durrance, Lawrence Berger, Deborah Ehrenthal

Population Health Research Brief Series

The opioid epidemic has severe consequences for pregnant women and their infants. Opioid use during pregnancy increases the risk of numerous poor outcomes at birth, including Neonatal Abstinence Syndrome (NAS), preterm birth, and low birth weight. Opioid use during pregnancy can also lead to child protective services reports and foster care entry. This brief summarizes the findings from a recent study that used linked administrative data from Wisconsin from 2010-2019 and child protective service reports to evaluate the effects of exposure to prescription and illicit opioids during pregnancy on infant health and wellbeing at birth.

How Has The Opioid Overdose Crisis Affected Child Maltreatment In The U.S.?, Alexander Chapman Mar 2023

How Has The Opioid Overdose Crisis Affected Child Maltreatment In The U.S.?, Alexander Chapman

Population Health Research Brief Series

This brief summarizes results from a study examining the association between U.S. county-level opioid mortality rates and child maltreatment rates from 2007 to 2017. Places with higher opioid overdose mortality rates have higher rates of child maltreatment. Poverty makes this problem worse - where the proportion of families in poverty increases, the association between fatal opioid overdose rates and child maltreatment also increases. Findings suggest that intervening in opioid use by reducing poverty has the potential to markedly decrease the incidence of child maltreatment.

The Oxycontin® Reformulation In 2010 Increased States’ Food Insecurity Rates, Colleen Heflin, Xiaohan Sun

Population Health Research Brief Series

The massive surge in opioid misuse and overdose over the past three decades has led to major family, economic, and social disruptions in the United States. OxyContin® - a highly potent, extended-release opioid was among the most commonly-abused narcotics throughout the 2000s. After reformulating OxyContin® to make it more difficult to inhale or inject, many people with opioid use disorders switched to using street drugs. The reformulation had many other unanticipated consequences. This brief shows that states with higher initial OxyContin® misuse rates had an increase in food insecurity after OxyContin® reformulation. The authors argue that public policies must consider …

Federal Medication-Assisted Treatment Expansion Grants Do Not Reduce Homelessness, Andrew Sullivan, Changwe Park Mar 2023

Federal Medication-Assisted Treatment Expansion Grants Do Not Reduce Homelessness, Andrew Sullivan, Changwe Park

Population Health Research Brief Series

Medication-assisted treatment (MAT) is an evidence-based intervention that, combined with counseling and behavioral therapies, can effectively treat opioid use disorders. However, MAT is underused due to multiple barriers. To increase access to MAT, the U.S. government awarded grants to local governments and nonprofit organizations to increase and retain the number of people receiving MAT. This brief examined differences in homelessness and employment outcomes between places that received a MAT grant and those that did not. They found that these grants did not reduce homelessness or unemployment rates in the places that received funding and concluded that their effectiveness may have …

Embracing A Pedagogy Of Intentionality: Reassessing Online Writing Instruction Principles Through A Post-2020 Lens, Autumn Bishard

All HCAS Student Capstones, Theses, and Dissertations

The COVID-19 pandemic upended every system, routine, set of practices and policies that stood as status quo when the pandemic was declared a national emergency on March 13, 2020. At that time, many writing instructors across America had to quickly become online writing instructors without any specialized training. Taking stock of what was learned during the pandemic, this thesis examines the Conference of College Composition and Communication’s (CCCC) Position Statement of Principles and Example Effective Practices for Online Writing Instruction (OWI) and makes recommendations that enhance inclusivity and accessibility. CCCC OWI Principles 1, 2, and 11 are examined by utilizing …

Kīpuka Leo: A Phenomenology Of Leadership In Hawaiian-Focused Charter Schools, Megan Lee Kawatachi Mar 2023

Kīpuka Leo: A Phenomenology Of Leadership In Hawaiian-Focused Charter Schools, Megan Lee Kawatachi

Educational Studies Dissertations

In Hawai‘i, the Hawaiian-focused charter school emerged as a call to action in communities that desired places of learning grounded in Native Hawaiian epistemologies, pedagogy, culture, language, and self-determination. Driven by the intention to decolonize schooling, Hawaiian-focused charter schools are still obligated to abide by the United States federal and Hawai‘i state mandates of publicly funded institutions. This phenomenological study sought to explore the experiences of eight po‘o kumu (leaders) from seven Hawaiian-focused charter schools as they develop kula (schools) from within the community, culturally rooted and responsive, while operating in a modern, Western context. Through face-to-face interviews, po‘o were …

Gabaergic Interneurons And Prenatal Ethanol Exposure: From Development To Aging, Adelaide R. Tousley Mar 2023

Gabaergic Interneurons And Prenatal Ethanol Exposure: From Development To Aging, Adelaide R. Tousley

Dartmouth College Ph.D Dissertations

Fetal Alcohol Spectrum Disorders are the most common non-genetic cause of neurodevelopmental disability worldwide. Individuals with Fetal Alcohol Spectrum Disorder experience clinical symptoms including differences in physical, cognitive and behavioral development beginning in early childhood, but continue to face challenges into adulthood. There is a critical need to examine the effects of prenatal ethanol exposure across early development, and to establish how the developmental effects of prenatal ethanol exposure may or may not progress in aging individuals. To contribute to these two areas, I asked how a binge-type prenatal ethanol exposure might affect: (1) early postnatal development of striatal neurons …

This meta-analysis assesses the predictive validity of the Graduate Record Examination (GRE) across outcome variables, including grade point average, for graduate students. In addition to aggregate effects, this paper also assessed changes in observed effects over time as related to increasing diversity in the graduate student population and as a function of gender and racial/ethnic composition of study samples. Framed using a lens of critical whiteness, this analysis examined n = 1,744 individual effects across k = 208 studies. Overall, 61.6% of reported effects were nonsignificant (i.e. no predictive value of GRE scores on student outcomes). Further, the magnitude of …

Population Health Research Brief Series

The U.S. opioid crisis is the deadliest drug crisis in the nation’s history and is not abating. This brief summarizes what is known about the relationships between opioid misuse, health, healthcare use, and crime. The authors show that the opioid crisis has led to worsening health, increased mortality, increased healthcare use, and modest increases in crime. In addition, the policies designed to curb opioid misuse and its associated harms have had only limited success.

Which Demographic Groups And Which Places Have The Highest Drug Overdose Rates In The U.S.?, Shannon M. Monnat

Population Health Research Brief Series

Although the drug overdose crisis has affected all demographic groups and places in the United States, overdose rates are much higher in some sub-populations and places than others. This brief describes demographic and geographic differences in fatal drug overdose rates from 1999-2020. Throughout most of this period, fatal drug overdose rates were highest among young and middle-aged adult White and Native American males and middle-aged and older Black males. Rates have been consistently highest in Appalachia, but in recent years have spread throughout several regions in urban and rural areas alike. Although opioids have been the main contributor, cocaine- and …
