Libraries Are Their People, Lex Lecrone Apr 2023

Libraries Are Their People, Lex Lecrone

Why Do We Need Libraries?

I came to USM having no idea what career I wanted to pursue, what my passion or focus was. Then I joined the Student Library Advisory Board.

Through SLAB I had exposure to work which I had no Idea would be so vital or personally fulfilling. Every opportunity I have had with the libraries has enriched my life beyond words.

During my work on this project, I realized that the greatest value offered is the passion, graciousness, and willingness to give time that these incredible staff and involved students have. Depicted above is me meeting with librarian and my project …

Localism, Pretext, And The Color Of School Dollars, Derek W. Black Apr 2023

Localism, Pretext, And The Color Of School Dollars, Derek W. Black

Minnesota Law Review Vols. 106:2 onward (2021-present)

Educational inequality is embedded in the structure of education itself. School districts, not individual schools, are the gatekeepers of educational opportunity. Racial isolation exists between school districts, not within them. Enormous funding gaps exist between neighboring school districts, sometimes in the same city, but not within them. These fault lines dictate everything from class size and teacher quality to suspension rates, achievement test scores, and graduation. To date, courts have rejected claims and remedies that would interfere with school district boundaries or local funding. The reluctance rests on the notion that localism is the historical foundation of public education. This …

Evolving Online Terrain In An Inert Legal Landscape: How Algorithms And Ai Necessitate An Amendment Of Section 230 Of The Communications Decency Act, Ellison Snider Apr 2023

Evolving Online Terrain In An Inert Legal Landscape: How Algorithms And Ai Necessitate An Amendment Of Section 230 Of The Communications Decency Act, Ellison Snider

Minnesota Law Review Vols. 106:2 onward (2021-present)

The consequences of online speech are undeniable, and yet, as the internet rapidly evolves, Section 230 of the Communications Decency Act (CDA 230), the federal law most concerned with internet regulation, stays the same. The pervasive presence of algorithms and artificial intelligence (AI), sophisticated technologies used by platforms to autonomously organize and facilitate the spread of online speech, vindicates a reassessment of CDA 230’s scope and applicability in the context of the modern internet. The internet’s impact on modern society is profound. In recent years, it has supported powerful grassroots organizing for social movements and allowed connection to distant loved …

Gender-Based Religious Persecution, Pooja R. Dadhania Apr 2023

Gender-Based Religious Persecution, Pooja R. Dadhania

Minnesota Law Review Vols. 106:2 onward (2021-present)

People fleeing gender-based violence in the home face an uphill battle when seeking asylum in the United States. Through the lens of public and private spheres, this Article explores the underutilized religion ground for asylum for cases involving gender-based violence in the home—i.e., the private sphere. This Article argues that if an individual imposes a patriarchal practice on an asylum seeker in the private sphere and justifies that practice using religion, the asylum seeker’s resistance to that practice should constitute religious expression. The religion ground protects individuals who are persecuted because of their religious beliefs and religious expression. It typically …

Criminal Terms, Anna Roberts Apr 2023

Criminal Terms, Anna Roberts

Minnesota Law Review Vols. 106:2 onward (2021-present)

Core terms used by criminal legal academics bolster the criminal system and ward off radical critique. They do this by conveying implicit messages of three types: that the criminal system is generally accurate, that it is necessary, and that it is well-intentioned and moving in the right direction. While recent legal scholarship has identified other subtle ways in which we send pro-carceral messages, it has not focused on vocabulary. We thus fall behind other entities that have announced vocabulary change, in recognition of the harm that such messages can do. We too have influence, not just through scholarly and public …

There Is No Such Thing As Circuit Law, Thomas B. Bennett Apr 2023

There Is No Such Thing As Circuit Law, Thomas B. Bennett

Minnesota Law Review Vols. 106:2 onward (2021-present)

Lawyers and judges often talk about “the law of the circuit,” meaning the set of legal rules that apply within a particular federal judicial circuit. Seasoned practitioners are steeped in circuit law, it is said. Some courts have imagined that they confront a choice between applying the law of one circuit or another. In its strong form, this idea of circuit law implies that each circuit creates and interprets its own body of substantive law that is uniquely applicable to disputes that arise within the circuit’s borders. This article argues that the notion of circuit law is nonsensical and undesirable …

Grandpa Sherman Did Not See Google Coming: Evolutions In Antitrust To Regulate Data Aggregating Firms, Michael J.K.M. Kinane

Minnesota Law Review Vols. 106:2 onward (2021-present)

There is a crisis of confidence regarding the regulation of Google and other Big Tech firms. In 2021, over fifty-five percent of Americans believed that under-regulation of Big Tech has resulted in these companies having too much economic influence. Seventy-five percent are not confident that government will hold companies accountable when they misuse data. This note_comment examines Google as the poster child for Big Tech’s use of data aggregation as an anticompetitive tactic. Thanks to Google’s vast social data collected across many platforms, it has near-perfect market intelligence. This intelligence enables profitable predictions in markets currently occupied by Google and …

The Formation Of A Guide For Licensed Educators Supervising And Supporting Paraeducators In Special Education, Catherine Parry Apr 2023

The Formation Of A Guide For Licensed Educators Supervising And Supporting Paraeducators In Special Education, Catherine Parry

Doctor of Education (EdD)

According to Individuals with Disabilities Education Act and the Oregon Administrative Rules, the work of paraprofessionals is required to be directed and supervised by a licensed teacher. While the typical licensed special educator is often unprepared for these duties, there are also very few accessible and applicable resources to support growth in this area. Through bracketing and memoing of literature on the topic, this content development dissertation examines what aspects of supervision and support of paraprofessionals should be included in a guide. It then proceeds to offer a succinct guide for licensed special educators on how to supervise and support …

Development Of Value-Added Butter By Incorporating Whey Protein Hydrolysate-Encapsulated Probiotics, Kritika Gaba, Sanjeev Anand, Athira Syamala Apr 2023

Development Of Value-Added Butter By Incorporating Whey Protein Hydrolysate-Encapsulated Probiotics, Kritika Gaba, Sanjeev Anand, Athira Syamala

Dairy Science and Food Science Faculty Publications: 2022 to Present

The probiotic foods market is growing exponentially; however, probiotics’ survivability and interaction with product attributes pose major challenges. A previous study of our lab developed a spray-dried encapsulant utilizing whey protein hydrolysate-maltodextrin and probiotics with high viable counts and enhanced bioactive properties. Viscous products such as butter could be suitable carriers for such encapsulated probiotics. The objective of the current study was to standardize this encapsulant in salted and unsalted butter, followed by storage stability studies at 4 ◦C. Butter was prepared at a lab-scale level, and the encapsulant was added at 0.1% and 1%, followed by physiochemical and microbiological …

Philanthropic Justice: The Role Of Private Foundations In Transitional Justice Processes, Julia Emtseva Apr 2023

Philanthropic Justice: The Role Of Private Foundations In Transitional Justice Processes, Julia Emtseva

Michigan Journal of International Law

In recent years, political transitions have become a major area of interest to private actors, including philanthropies. More and more philanthropic foundations have chosen to donate money to support transitional justice processes across the globe. However, philanthropies often take on not only the role of a funder but also the role of an active participant in transitional justice (TJ) mechanisms. They push for the building of long-lasting partnerships with state authorities and international organizations, and, sometimes, take over and administer certain transitional justice processes. As a result, philanthropic foundations wield considerable power in transitional justice, especially when the state cannot …

On Electric Vehicles And Environmental Policies For Innovation, Shi-Ling Hsu Apr 2023

On Electric Vehicles And Environmental Policies For Innovation, Shi-Ling Hsu

UC Law Science and Technology Journal

Electric vehicles have been in existence for over a century. Impetus and progress towards commercialization have been uneven. For the most part, government policy on electric vehicle development has consisted of government funding and other support for research and development. The long, meandering path that has now resulted in the emergence of Tesla as an industry leader has been documented carefully in John Graham’s The Global Rise of the Modern Plug-in Electric Vehicle. Graham’s account is remarkably broad and thorough, leaving few stones unturned, and comprehensively detailing the history of electric vehicle policy in a number of countries, and often …

The Role Of Constitutional Provisions In Protecting Artificial Reproductive Technology: A Comparative Analysis Of The United Kingdom, France, Germany, Italy, And The United States, Gabrielle Kleyner Apr 2023

The Role Of Constitutional Provisions In Protecting Artificial Reproductive Technology: A Comparative Analysis Of The United Kingdom, France, Germany, Italy, And The United States, Gabrielle Kleyner

UC Law Science and Technology Journal

Artificial reproductive technology (ART) is a common medical treatment for individuals struggling with infertility. However, accessibility depends largely on social, economic, and legal factors. This article will examine the role constitutional provisions play in protecting access to ART, comparing countries with constitutional provisions protecting the right to health like the United Kingdom, France, Germany, and Italy, with the United States, which lacks such safeguards. This article will begin by comparing the constitutional provisions protecting the right to health broadly and then explore the specific guidelines governing ART. The article ultimately finds a relationship between constitutional health protections and access to …

With the emergence of various information technologies, how to reasonably layout in different touch points has become a crucial issue for the company in practice, especially for those experienced durable goods with greater uncertainty and decision complexity. The company seeks to leverage the limited budget to achieve the most efficient marketing strategies, and thus the most effective combination of information channels. Title Matters: Impacts Of Titles On User Engagement In Short Video Platforms, Hao Chen Apr 2023

Title Matters: Impacts Of Titles On User Engagement In Short Video Platforms, Hao Chen

Dissertations and Theses Collection (Open Access)

With the increasing popularity of short video marketing in business world, understanding how to engage short video viewers has attracted the attention from both academics and practitioners. Prior studies on short videos mainly focus on how characteristics of users or the attributes of video content affect marketing effectiveness. As a heuristic cue of short video content, the video title is expected to grab viewers’ attention thereby playing an important role in influencing viewers’ attitudes towards the short video consumption. Drawing on signaling theory, I propose that the characteristics of short video titles, such as the length, the sentiment strength, and …
