How Nike’S Trademark Infringement Lawsuit Against Kool Kiy & Omi May Benefit From China’S Wuhan Intermediate People’S Court’S Approach To Mediation, Daniel Hyungtae Kim
Cardozo Journal of Conflict Resolution (CJCR) Blog
In November 2022, Nike filed a trademark infringement lawsuit against Kool Kiy, Omi, and China-based manufacturer Xiamen Wandering Planet, garnering nationwide media attention. Particularly, Wandering Planet was accused of playing an integral role in the infringement by providing the sources to produce knockoff sneakers using Nike’s registered Air Jordan 1 and Dunk trade dress for Kiy and Omi. The manufacturer allegedly “knowingly participate[d] in a scheme to intentionally create confusion in the market place and capitalize on it.” Indeed, some confused consumers could not tell the difference between Kool Kiy’s products and Jordan’s. Nike’s staunch commitment to proceeding with litigation …

Cardozo Journal of Conflict Resolution (CJCR) Blog
Art and cultural heritage disputes can involve a variety of subject matter and “sensitive non-legal issues of a commercial, cultural, ethical, historical, moral, religious, or spiritual nature, while more often than not having a distinct international character. For such complex matters, there has long been conversations about the benefits of using ADR mechanisms instead of traditional litigation to address the issues that are highly relevant and important to the parties, but which courts are often not equipped or designed to address. Art-related disputes often involve not only a variety of private parties such as artists and art dealers but also …

Mathematical Description And Algorithm For Solving The Model Of The Ionite Regeneration Process In The Ion Exchange Method Of Water Softening, Djalolitdin Paxritdinovich Mukhitdinov, Nilufar Abdusami Qizi Yunusova
Chemical Technology, Control and Management
Based on the modern representation of the water softening process by the ion exchange method, modeling was carried out, an algorithm was developed and the ionite regeneration process was calculated in a water softening plant with a fixed ionite layer. To solve the system of equations of the model, special, but simple enough for use in engineering calculations, techniques and methods have been developed and applied. The constructed model and its solution algorithm can be used to predict the process of ionite regeneration in an ion exchange apparatus. It can also be used to calculate the time of the ionite …

Reflections On The Use Of Patient Records: Privacy, Ethics, And Reparations In The History Of Psychiatry, Jonathan Sadowsky
Faculty Scholarship
One of the most common questions we get asked as historians of psychiatry is “do you have access to patient records?” Why are people so fascinated with the psychiatric patient record? Do people assume they are or should be available? Does access to the patient record actually tell us anything new about the history of psychiatry? And if we did have them, what can, or should we do with them? In the push to both decolonize and personalize the history of psychiatry, as well as make some kind of account or reparation for past mistakes, how can we proceed in …

Background: Older patients with myelodysplastic syndromes (MDS), particularly those with no or one cytopenia and no transfusion dependence, typically have an indolent course. Approximately, half of these receive the recommended diagnostic evaluation (DE) for MDS. We explored factors determining DE in these patients and its impact on subsequent treatment and outcomes. Patients and Methods: We used 2011-2014 Medicare data to identify patients ≥66 years of age diagnosed with MDS. We used Classification and Regression Tree (CART) analysis to identify combinations of factors associated with DE and its impact on subsequent treatment. Variables examined included demographics, comorbidities, nursing home status, and …

Toward A Neural Semantic Parsing System For Ehr Question Answering, Sarvesh Soni, Kirk Roberts
Faculty, Staff and Student Publications
Clinical semantic parsing (SP) is an important step toward identifying the exact information need (as a machine-understandable logical form) from a natural language query aimed at retrieving information from electronic health records (EHRs). Current approaches to clinical SP are largely based on traditional machine learning and require hand-building a lexicon. The recent advancements in neural SP show a promise for building a robust and flexible semantic parser without much human effort. Thus, in this paper, we aim to systematically assess the performance of two such neural SP models for EHR question answering (QA). We found that the performance of these …

Biological systems seamlessly combine multiple functions in lightweight and energy-efficient structures. Such capability in synthetic structures would be desirable in numerous engineering applications such as aerospace, robotics and wearable devices. Here we report an integrated silicon-based structure configured to sense, perform different classification algorithms, and produce an action signal within the same physical layer. The algorithms are coded in the mechanical responses of the sensing elements of multiple coupled micro-electromechanical systems (MEMS), simultaneously capturing acceleration measurements to produce an actuated signal. This all-in-one structure operates with zero circuitry and low power consumption. As a demonstration, we designed and fabricated a …

In this article, we are concerned with multiple solutions of Schrödinger-Choquard-Kirchhoff equations involving the fractional p -Laplacian and Hardy-Littlewood-Sobolev critical exponents in R N . We classify the multiplicity of the solutions in accordance with the Kirchhoff term M ( ⋅ ) and different ranges of q shown in the nonlinearity f ( x , ⋅ ) by means of the variational methods and Krasnoselskii’s genus theory. As an immediate consequence, some recent related results have been improved and extended.

Unity Power Factor Operation In Microgrid Applications Using Fuzzy Type 2 Nested Controllers, Ehab Bayoumi
Unity Power Factor Operation In Microgrid Applications Using Fuzzy Type 2 Nested Controllers, Ehab Bayoumi
Mechanical Engineering
The issue of low-power factor operation microgrids was reported for several layouts. Although numerous power factor improvement strategies have been applied and tested, various concerns remain to be addressed such as transient performance, simplicity of implementation, and satisfying the power-quality standards. The presented research aimed to design and implement controllers that can improve the transient response of microgrids due to changes in the load demand and achieve a near-unity power factor at the AC grid side, to which the DC microgrid is connected. Due to the nonlinear nature of microgrids, as they rely on power electronics converters, a Fuzzy type …

BACKGROUND: Research on risk factors for neuropsychiatric adverse events (NAEs) in smoking cessation with pharmacotherapy is scarce. We aimed to identify predictors and develop a prediction model for risk of NAEs in smoking cessation with medications using Bayesian regularization.
METHODS: Bayesian regularization was implemented by applying two shrinkage priors, Horseshoe and Laplace, to generalized linear mixed models on data from 1203 patients treated with nicotine patch, varenicline or placebo. Two predictor models were considered to separate summary scores and item scores in the psychosocial instruments. The summary score model had 19 predictors or 26 dummy variables and the item score …

Background: 5-year survival after childhood cancer does not fully describe life-years lost due to childhood cancer because there are a large number of deaths occurring beyond 5-years (late mortality) related to cancer and cancer treatment. Specific causes of health-related (non-recurrence, non-external) late mortality and risk reduction through modifiable lifestyle and cardiovascular risk factors are not well described. Through using a well-characterised cohort of 5-year survivors of the most common childhood cancers, we evaluated specific health-related causes of late mortality and excess deaths compared with the general US population and identified targets to reduce future risk.
Methods: In this multi-institutional, hospital-based, …

Electrospinning is a versatile tool used to produce highly customizable nonwoven nanofiber mats of various fiber diameters, pore sizes, and alignment. It is possible to create electrospun mats from synthetic polymers, biobased polymers, and combinations thereof. The post-processing of the end products can occur in many ways, such as cross-linking, enzyme linking, and thermal curing, to achieve enhanced chemical and physical properties. Such multi-factor tunability is very promising in applications such as tissue engineering, 3D organs/organoids, and cell differentiation. While the established methods involve the use of soluble small molecules, growth factors, stereolithography, and micro-patterning, electrospinning involves an inexpensive, labor …
Sensing Is A Far Cry From Sentience, Antonio Damasio, Hanna Damasio
Sensing Is A Far Cry From Sentience, Antonio Damasio, Hanna Damasio
Animal Sentience
The hypothesis that plants might be sentient confuses the notion of sentience (or consciousness) with that of sensing. Sentience/consciousness implies feeling, experience, and subjectivity. Sensing does not. Plants can sense/detect and even respond appropriately in the absence of any sentience/consciousness.

We studied the genetic associations of a previously developed Metabolomic Risk Score (MRS) for Mild Cognitive Impairment (MCI) and beta-aminoisobutyric acid metabolite (BAIBA)-the metabolite highlighted by results from a genome-wide association study (GWAS) of the MCI-MRS, and assessed their association with MCI in datasets of diverse race/ethnicities. We first performed a GWAS for the MCI-MRS and BAIBA, in Hispanic/Latino adults (n = 3890) from the Hispanic Community Health Study/Study of Latinos (HCHS/SOL). We identified ten independent genome-wide significant (p value <5 × 10-8) variants associated with MCI-MRS or BAIBA. Variants associated with the MCI-MRS are located in the Alanine-Glyoxylate Aminotransferase 2 (AGXT2 gene), which is known to be associated with BAIBA metabolism. Variants associated with BAIBA are located in the AGXT2 gene and in the SLC6A13 gene. Next, we tested the variants' association with MCI in independent datasets of n = 3178 HCHS/SOL older individuals, n = 3775 European Americans, and n = 1032 African Americans from the Atherosclerosis Risk In Communities (ARIC) study. Variants were considered associated with MCI if their p value <0.05 in the meta-analysis of the three datasets and their direction of association was consistent with expectation. Rs16899972 and rs37369 from the AGXT2 region were associated with MCI. Mediation analysis supported the mediation effect of BAIBA between the two genetic variants and MCI (p value = 0.004 for causal mediated effect). In summary, genetic variants in the AGXT2 region are associated with MCI in Hispanic/Latino, African, and European American populations in the USA, and their effect is likely mediated by changes in BAIBA levels.

Treatment with radiolabelled somatostatin analogs, a form of peptide receptor radionuclide therapy (PRRT), has changed the management of patients with advanced gastroenteropancreatic neuroendocrine tumors (GEP-NETs). There is a subgroup of patients who have suboptimal benefit and rapidly progress on PRRT, indicating that accurate prognostic and predictive markers are urgently needed. Currently, most of the literature concentrate on the prognostic impact of the dual positron emission tomography (PET) scan with very few information regarding the predictive value. We report a case series and review the literature to summarizes the predictive value of combined somatostatin receptor (SSTR) and fluorodeoxyglucose (FDG) PET in …

Mzion Enables Deep And Precise Identification Of Peptides In Data-Dependent Acquisition Proteomics, Qiang Zhang
2020-Current year OA Pubs
Sensitive and reliable identification of proteins and peptides pertains the basis of proteomics. We introduce Mzion, a new database search tool for data-dependent acquisition (DDA) proteomics. Our tool utilizes an intensity tally strategy and achieves generally a higher performance in terms of depth and precision across 20 datasets, ranging from large-scale to single-cell proteomics. Compared to several other search engines, Mzion matches on average 20% more peptide spectra at tryptic enzymatic specificity and 80% more at no enzymatic specificity from six large-scale, global datasets. Mzion also identifies more phosphopeptide spectra that can be explained by fewer proteins, demonstrated by six …

Reliable quantitative vegetation reconstructions for Europe during the Holocene are crucial to improving our understanding of landscape dynamics, making it possible to assess the past effects of environmental variables and land-use change on ecosystems and biodiversity, and mitigating their effects in the future. We present here the most spatially extensive and temporally continuous pollen-based reconstructions of plant cover in Europe (at a spatial resolution of 1° × 1°) over the Holocene (last 11.7 ka BP) using the ‘Regional Estimates of VEgetation Abundance from Large Sites’ (REVEALS) model. This study has three main aims. First, to present the most accurate and …
