How To Transform Capitalism Through Law, Katharina Pistor

This essay is based on the presentation of my book, The Law of Capitalism and How to Transform It, at the University of Miami Law School on October 14, 2025. The relationship between fiduciary duty and contract has never been clear. The law of fiduciaries has long constrained discretionary control of other people’s property, notably in corporate governance, where directors owe a corporation duties of care and loyalty. Yet, contract has also had the capacity to modify these duties in important—but uncertain—ways because neither body of law contains a meta-rule specifying which would “trump” in the event of conflict. Uncertainty was rarely problematic, however, because directors lacked the power to fully contract away their control of the corporation or their concomitant fiduciary duties.

Noise-Induced Gains: Are You Damaging Your Hearing While You Train?, Taylor Hitschmann, Lillian Beauvais, Blake Roth, Andrew Gannon

This study investigated the potential risk of noise-induced hearing loss (NIHL) among individuals who listen to music during exercise. Survey data were collected alongside sound intensity measurements to better understand listening behaviors in fitness settings. Results indicated that although most participants reported listening at recommended safe levels, a notable proportion exceeded these thresholds, potentially increasing their risk of NIHL. These findings highlight the importance of monitoring listening habits during workouts. Hearing health professionals are encouraged to enhance public awareness and promote safe listening practices to help reduce the likelihood of long-term auditory damage.

The Impact Of Doulason The Parental And Newborn Outcomes Of Black And Hispanic Birthing People: A Secondary Data Analysis, Nicole Amanquanor

Black and Hispanic birthing people in the United States continue to experience disproportionately high rates of maternal morbidity and mortality compared with White birthing people, even after controlling for sociodemographic factors and comorbidities. The purpose of this secondary data analysis was to examine the impact of racially congruent doula support on the parental and newborn outcomes of Black and Hispanic birthing people in two urban safety-net hospitals. Quantitative data were derived from “The HoPE Doula Study”, a mixed-methods study conducted between June 2022 and December 2023, which followed 81 birthing people and 12 doulas across prenatal, intrapartum, and postpartum periods. …

This research project explores Japanese music theories. By analyzing the basic components of Japanese music, including historical and modern approaches, this presentation demonstrates the similarities and differences in the formation of music in western thought when compared to the methodology of Japan. This research dives deep into tones, scales, melodic approaches, historical development and the effect on modern compositions today. This project informs the audience on the nuances of Japanese music theories in the hope to dispel stereotypes about music theories from different cultures, apart from western thought.

This brief summarizes the evidence on adolescent girls’ sexual and reproductive health and rights (SRHR) in West and Central Africa (WCA), particularly evidence from the GIRL Center’s priority countries. It explores social norms and structural barriers to adolescent girls’ SRHR, pregnancy, harmful practices, unmet need for contraception, service gaps, SRHR in conflict settings, and legal and policy barriers. The brief informs strategies and promising entry points that have the potential to transform SRHR outcomes for girls in the region.

Court granted respondent's motion to vacate a two-attorney stipulation of settlement in which the tenant had agreed to vacate, finding that the landlord's subsequent offer of a lease renewal—which the tenant signed and under which the tenant paid rent—reinstated the tenancy and vitiated the prior notice of termination. Court found good cause under RPAPL § 749(3) to vacate the judgment and warrant and dismiss the proceeding, holding that the lease renewal offer would cause a reasonable person to doubt the finality of the notice of termination.

The purpose of this transcendental phenomenological study was to explore the lived experiences of higher education mathematics faculty implementing artificial intelligence tools in their classrooms. The theory that guided this study was Piaget’s cognitive learning theory, which emphasizes that learners absorb knowledge by building upon previous understandings and experiences. The central research question guiding this study is: What are the lived experiences of mathematics faculty in higher education who utilize AI tools to support instructional design in their classrooms? When the M/V Dali, a Singaporean-flagged container ship, struck Baltimore’s Francis Scott Key Bridge in March 2024, the foreign vessel owners turned to a centuries-old American statute that allows shipowners to limit their liability to the post-accident value of a vessel. The Limitation of Liability Act of 1851 (the “Limitation Act” or “Act”) was originally designed to protect and promote a nascent American shipping industry from the unpredictable perils of nineteenth-century seas. Today, however, it operates in a vastly different maritime economy, where foreign-flagged vessel owners routinely rely on the Act to shield themselves from full financial responsibility. In …

Property Without Shelter: How Anti-Public-Camping Laws Violate The Substantive Due Process Rights Of The Homeless, Aaron Rissman

In City of Grants Pass v. Johnson, the Supreme Court held that enforcing anti-public-camping ordinances against homeless individuals does not violate the Eighth Amendment’s prohibition on status crimes. While the Court foreclosed the Eighth Amendment as a vehicle for challenging such laws, it suggested that other constitutional protections may remain available. This Note takes up the Court’s invitation and argues that many anti-public-camping laws violate the Fourteenth Amendment’s substantive due process guarantees.

U.S. election administration has become supercharged with controversy. A process that should be mundane—casting and counting votes—has become the target of relentless litigation, much of which ends in non-merits rulings that risk perpetuating rather than resolving public concerns. The high volume of election litigation is costly, strains election officials, and risks eroding public trust in both elections and the courts. Recognizing the need to resolve election claims fairly and efficiently, Administering Election Disputes examines administrative remedies as an under-theorized alternative to judicial resolution. This dissertation examines the impacts of the use of plagiarism and AI detection software as surveillance methods in online writing classes. Participants in this study were asked a series of questions via questionnaire regarding their attitudes, perceptions, and experiences with plagiarism and AI detection software. Participant responses indicate that plagiarism and AI detection in online writing classes causes anxiety and fear, which degrades their relationship with the instructor and fundamentally alters their writing process and the writing they produce. This study examines the relationship between Mandarin lexical tones and melodic contour in Chinese art song, focusing on how this interaction shapes vocal performance practice. Through case studies of Huang Zi’s Three Wishes of the Rose and selected songs from Gao Ping’s Melody Abandoned, the project explores how two Western-educated Chinese composers from different historical periods negotiate poetic text, tonal language, and musical expression within evolving cultural contexts. This dissertation proposes and applies a stylistic framework for organizing original euphonium solo literature, addressing the limitations of existing repertoire resources that rely primarily on chronology, instrumentation, or difficulty level. Because the euphonium’s solo repertoire emerged largely in the twentieth and twenty‑first centuries, traditional historical periodization obscures the stylistic diversity and pedagogical functions of the literature. The purpose of this study is to develop a classification system that reflects the musical languages, performance practices, and pedagogical uses of euphonium repertoire more accurately than conventional organizational models. Patterns of structural and socioeconomic disparities are stark. Public sector actors, in particular planners and grant managers, have a responsibility to thoughtfully allocate funds to better address longstanding disparities. This study provides examples of how actionable science looks in practice in local government contexts and grounds the work in the literature across planning, public administration, and anthropology fields. This inter-disciplinary approach helps identify co-production as a common theme to stitch these works together. Adapting Early Music For Tuba/Euphonium Quartet, Bryson Camby Harding

This dissertation addresses the absence of pre-nineteenth-century repertoire for the tuba and euphonium by demonstrating the pedagogical and musical viability of adapting Late Medieval, Renaissance, and Baroque works for tuba/euphonium quartet. Because the tuba and euphonium emerged only after the invention of the valve in the nineteenth century, no original repertoire exists for these instruments from earlier periods. Consequently, low brass chamber literature has remained largely confined to modern compositions, limiting student engagement with modal harmony, imitative counterpoint, isorhythmic structure, basso continuo practice, and early formal design. Through historically informed and methodologically grounded transcription, this project expands the quartet canon …
