In this holdover proceeding, the tenant moved to amend their answer and for discovery. The court dismissed the landlord's petition, finding the landlord failed to serve a proper predicate notice. The landlord had appended a truncated version of the Real Property Law § 231-c Good Cause Eviction Law (GCEL) form to the predicate notice, which the court deemed insufficient as it did not contain enough relevant portions to be considered a non-prejudicial defect. Consequently, the tenant's motion was granted, and the proceeding was dismissed.

The shift to digital banking has redefined the financial services industry, allowing consumers to conduct everyday transactions, such as wire transfers, at the touch of a button. However, this convenience comes at a steep price: as digital banking becomes the norm, consumers are increasingly exploited by sophisticated cybercriminals, enabled by a legal system that is ill-equipped to handle modern phishing and wire fraud schemes, ultimately draining consumer accounts. By 2024, a majority of the Justices of the Supreme Court had expressed the view that to be legitimate, constitutional adjudication must be based on the original meaning of the Constitution’s text. Anything else, these Justices have argued, is illegitimate judicial policymaking. Yet, in what were likely the two most critical and high-profile cases decided in 2024, the Court, including its avowedly originalist Members, made no use of originalism. In the first case, the Court faced the question whether a State could bar President Trump from running for President under Section 3 of the Fourteenth Amendment. In the second, the …

Disputes over stolen art frequently result in arduous, decades-long litigation. These disputes are emotionally and morally charged—one recurrent fact-pattern involves the descendants of European Jewish families suing an art collector or museum that now possesses art the Nazis stole during the Holocaust. But courts often decide stolen art cases based on rules about the tolling of statutes of limitations, not the merits of the disputes. Further, these tolling rules are unclear, inconsistent, and generally favor the bona fide purchaser of stolen art over the original owner. American Subsidy Law In A World Of Changed Weather Patterns, Robert Abrams

This Article considers the extent to which governments in the United States, faced with escalating costs of weather-induced disasters, can refuse, restrict, or eliminate subsidies that encourage persons to locate or remain in harm’s way, without triggering the Takings Clause or other forms of liability. In most scenarios, the law unequivocally permits governments broad freedom to refuse, restrict, or cease subsidization.
The policy issues are more variegated—claims of reliance on subsidy-induced encouragement, or the plight of being in the wrong place at the wrong time, are not fatuous, nor is the risk of housing price instability if subsidies are withdrawn …
