The Information Costs Of Exclusion, Jonathan Sarnoff Jun 2024

The Information Costs Of Exclusion, Jonathan Sarnoff

University of Chicago Law Review

The appropriate scope of the right to exclude is among the most contentious topics in property theory: while some defend direct state regulations that override owners’ right to exclude unwanted uses from their property, others defend greater deference to owners’ authority, implemented by stringent enforcement of the right to exclude. In recent years, scholars who favor exclusion have developed novel arguments to support it by focusing on the information costs of property. Because every- one must respect property rights, those rights must be simple enough for everyone to understand their content. And the right to exclude, which requires everyone to …

Deciphering The "Traditional Property Interests" Test For Property-Based Mail And Wire Fraud, Grant Delaune Jun 2024

Deciphering The "Traditional Property Interests" Test For Property-Based Mail And Wire Fraud, Grant Delaune

University of Chicago Law Review

The mail and wire fraud statutes are the “first line of defense” against fraudulent activities. Adaptable and broadly written, they are go-to tools in the white- collar prosecutor’s arsenal. But this flexibility has also raised concern about their expansive and indeterminate scope—leading the Supreme Court to eliminate certain honest-services theories of fraud and limit property-based theories of fraud to the protection of “traditional property interests.”

Unfortunately, the vagueness of the traditional property interests test has resulted in a confusing morass of inconsistent judgments. With limited guidance from the Supreme Court on how to conduct such an inquiry, lower courts have …

The Finality Of Reinstated Orders Of Removal Under 8 U.S.C. § 1252, Jonah Klausner Jun 2024

The Finality Of Reinstated Orders Of Removal Under 8 U.S.C. § 1252, Jonah Klausner

University of Chicago Law Review

Federal law authorizes the reinstatement of a prior removal order when a noncitizen “reenter[s] the United States without authorization after having already been removed.” It further provides an “expedited process” for doing so, denying to such noncitizens the right to contest before an immigration judge their removability or inadmissibility. The question whether a noncitizen is removable is thus definitively settled immediately upon reinstatement. But the question to where the noncitizen will be removed is less certain. This is because noncitizens subject to reinstated orders of removal retain the right to pursue “withholding-only” relief, which precludes removal to the noncitizen’s home …

The Sources And Consequences Of Disputes Over Contractual Meaning, Randy D. Gordon Jun 2024

The Sources And Consequences Of Disputes Over Contractual Meaning, Randy D. Gordon

Faculty Scholarship

With some frequency, parties agree to the particular words used in a contract they sign, only to later disagree as to the meaning of those words and their legal effect. That is, they each assent to something, but that “something” is something different for each of them. In this Article, I first categorize and trace the sources of recurring points of disagreement as a matter of language and linguistics. Then, I look at the consequences of a dispute that leads a fact finder to conclude that the parties genuinely did not agree to the same thing, which is to say …

Mind The Gap: Toussaint And The Reception Of International Human Rights Law In Canada, Karinne Lantz Jun 2024

Mind The Gap: Toussaint And The Reception Of International Human Rights Law In Canada, Karinne Lantz

Articles, Book Chapters, & Popular Press

This article explores the reception of international human rights law (“IHRL”) in Canada and the enforcement gap that may arise when legislation is not passed expressly implementing human rights treaties that Canada has ratified. Despite establishing a variety of interpretive methods that may result in Canada’s binding IHRL obligations having domestic effect even when they are not expressly implemented, Canadian courts have struggled to provide clear and consistent guidance on how IHRL applies in Canada. The selective approach in Canada to implementing legislatively IHRL obligations may give rise to an enforcement gap when rights individuals purportedly enjoy under international law …

The study involved students from a large 4-year college in the Midwestern United States, along with mental health professionals. A diverse group of student participants and mental health professionals reviewed researcher-supplied photographs, rating coping mechanisms on a 1 to 10 scale. Students also uploaded photographs reflecting their coping methods. Quantitative and qualitative analyses were conducted on both researcher-supplied and student-submitted photographs. Mental health professionals validated student responses. Responses …

Poetry Style Experimentation, Ian Mcguckin Jun 2024

Poetry Style Experimentation, Ian Mcguckin

Honors Projects

This project is an experimentation in different craft and stylistic approaches to poetry. Each week, a different major contemporary poet was studied through one of their collections. Their work was analyzed and dissected to reveal some of the main stylistic choices they make to achieve their individual effect. After analysis, a handful of these elements were chosen to replicate in the author's own poems. Guided by crafted prompts created to inspire the author towards the chosen poet's style or subject, two to three poems were drafted each week and then revised at the end of the week. In total, this …

International experiences, including collaborative online international learning (COIL) experiences that naturally increase accessibility, are of interest to many undergraduate students. These experiences provide educators a unique opportunity to develop a student's entrepreneurial mindset (EM). Additionally, hands-on experiences aligned with the National Academy of Engineering’s (NAE) grand challenge themes (Sustainability, Security, Health, and Joy of Living) support connections between the experience, disciplinary knowledge, multicultural awareness, and EM. Through this Work-in-Progress (WiP) study, we seek to answer: 1) How do international experiences influence undergraduate science and engineering students’ EM, and 2) How does the international experience modality (i.e., study abroad or COIL) …

Ruling Out A Saddle-Point Mechanism Of Ionization In Intermediate-Energy Ion-Atom Collisions, K. H. Spicer, C. T. Plowman, N. W. Antonio, M. S. Schöffler, Michael Schulz, A. S. Kadyrov

Physics Faculty Research & Creative Works

Is there a saddle-point mechanism for ionization in intermediate-energy ion-atom collisions Since Olson [Phys. Rev. A 33, 4397 (1986)0556-279110.1103/PhysRevA.33.4397] proposed the idea that the electrons stranded in the potential saddle between the two Coulomb centers dominate the ejected-electron spectra, multiple experimental and theoretical attempts have been made to answer this question. However, the topic has remained controversial. Here we provide a theoretical analysis of this question which can contribute significantly to a definitive answer, at least for intermediate and large projectile energies. To this end we calculate the energy and angular distribution of electrons emitted in proton-helium collisions. We use …

Dentistry And The Law: Covenants Not To Compete Have Not Yet Been Banned, Daniel Schulte Jd Jun 2024

Dentistry And The Law: Covenants Not To Compete Have Not Yet Been Banned, Daniel Schulte Jd

The Journal of the Michigan Dental Association

As of now, covenants not to compete are still enforceable. The FTC voted to issue a Final Rule banning most noncompetition agreements, effective 120 days after publication in the Federal Register. Litigation aims to block this rule. Exceptions exist for senior executives and business sales. Employers must notify employees about non-enforceability, but breaches prior to the rule remain actionable. Dental practices should prepare for a potential future without noncompetition provisions.

Small-Town Dental Practice Is Where It’S At, And Irish Eyes Are Smiling!, Christopher J. Smiley

The Journal of the Michigan Dental Association

The West Michigan District Dental Society honored Dr. James Reagan with the Distinguished Service Award, reflecting his dedication to Lowell, a small town near Grand Rapids. Raised in a family that valued community, Reagan champions small-town living and dental practice. MDA President Dr. Eric Knudsen echoed this sentiment, emphasizing the rewards of rural practice. Reagan's involvement in Lowell spans various roles, from the Chamber of Commerce to the school board. His commitment to service, family, and community exemplifies the fulfillment found in small-town dentistry.

Elastic Electron Scattering From Be, Mg, And Ca, Mehrdad Adibzadeh, Constantine E. Theodosiou, Nicholas J. Harmon Jun 2024

Elastic Electron Scattering From Be, Mg, And Ca, Mehrdad Adibzadeh, Constantine E. Theodosiou, Nicholas J. Harmon

Physics and Engineering Science

We present a comprehensive set of theoretical results for differential, integrated, and momentum transfer cross sections for the elastic scattering of electrons by beryllium, magnesium, and calcium at energies below 1 keV. In addition, we provide Sherman function values for elastic electron scattering from calcium in the same energy range. This study extends the application of our method of calculations, already employed for barium and strontium, to all stable alkaline-earth-metal atoms. Our semi-empirical approach to treating target polarization has produced in our earlier work a satisfactory agreement with experimental values and precise theoretical results such as convergent close-coupling calculations for …

Paediatrics and Child Health, East Africa

Background Severe pneumonia in African children results in poor long-term outcomes (deaths/readmissions) with undernutrition as a key risk factor. We hypothesised additional energy/protein-rich Ready-to-Use Therapeutic Foods (RUTF) would meet additional nutritional requirements and improve outcomes.

Methods COAST-Nutrition was an open-label Phase 2 randomised controlled trial in children (aged 6 months-12 years) hospitalised with severe pneumonia (and hypoxaemia, SpO2 <92%) in Mbale, Soroti, Jinja, Masaka Regional Referral Hospitals, Uganda and Kilifi County Hospital, Kenya (ISRCTN10829073 (registered 6th June 2018) PACTR202106635355751 (registered 2nd June 2021)). Children were randomised (ratio 1:1) to enhanced nutritional supplementation with RUTF (plus usual diet) for 56 days vs usual diet (control). The primary outcome was change in mid-upper arm circumference (MUAC) at 90 days as a composite with mortality. Secondary outcomes include anthropometric status, mortality, and readmissions at Days 28, 90 and 180.

Findings Between 12 August 2018 and 22 April 2022, 846 eligible children were randomised, 424 to RUTF and 422 to usual diet, and followed for 180-days [12 (1%) lost-to-follow-up]. RUTF supplement was initiated in 417/419 (>99%). By Day 90, there was …

Masters Theses

This thesis research politically charged public spaces in Hong Kong due to the past social movements and acknowledges its uniqueness formed by the intuitive use of the vernacular public spaces in the context of both day-to-day life and social movements. The way of freely utilizing elements in public spaces makes the public space in Hong Kong a space to be, a space to express, and a space to resist. However, a unique public space like this often causes misunderstanding, misrepresentation, and sometimes fear from other sides. Thus, this thesis aims to create a subjective analytical view of the formation and …

Gender Disparity In Students’ Performance Of Science And Mathematics: Evidence From Nationwide Study In Pakistan, Sadia Muzaffar Bhutta, Aisha Naz Ansari, Sohail Ahmad Jun 2024

Gender Disparity In Students’ Performance Of Science And Mathematics: Evidence From Nationwide Study In Pakistan, Sadia Muzaffar Bhutta, Aisha Naz Ansari, Sohail Ahmad

Institute for Educational Development, Karachi

Gender disparity in science and mathematics performance is being researched internationally. In a complex education system, like Pakistan, studying the difference in isolation may not generate holistic understanding. Therefore, this paper investigates changes in trends of performance in Science and Mathematics for both genders across public and private schools. Data were gathered from a nationwide sample of elementary grades students (n=15,391) using SATs/MATS. Independent t-test and two-way-ANOVA were employed to analyse data. Results revealed that girls outperformed boys in Science (p<0.01) while no gender differences in performance were observed in Mathematics. Gender and school systems demonstrated significant interaction effect only in mathematics, unveiling that girls perform better in public schools while this difference diminished in the private school system. The results show implications for employing gender-fair policies and practices in science and mathematics education.

Function Follows Material, Pablo Ejarque González Jun 2024

Function Follows Material, Pablo Ejarque González

Masters Theses

Dear Designer,

How often do we find ourselves lost in the design process, unsure of the next steps? It’s tempting to view every aspect of design as a problem needing a solution. However, function is not a problem. For a long time, I approached design from a problem-solving perspective, treating material as a secondary consideration after the idea had already formed. This approach needed to change.

This book is a journey—a map of material exploration. It is an embrace of experimentation and innate curiosity. Many of the experiments conducted did not culminate in finished furniture pieces, yet this does not …

Exploring The Versatility Of Clay In Double Curvature Surface Formation, Yicheng Zhang Jun 2024

Exploring The Versatility Of Clay In Double Curvature Surface Formation, Yicheng Zhang

Masters Theses

This thesis aims to investigate the efficacy of clay in shaping double- curved surfaces. In conventional interior design practices, Glass Reinforced Gypsum (GRG) is commonly employed to craft sculptural elements on surfaces such as ceilings and walls. However, despite its efficiency, GRG is not environmentally sustainable. As an excellent material for creating indoor curved surfaces, GRG, offers the advantages of easy construction and high efficiency. However, during the demolition process, the inclusion of glass fibers makes the recycling process very complicated. It is difficult to separate these materials for recycling, which ultimately leads to a significant amount of construction waste.

Additionally, …

Recomposing Museums: Designing Rhythmic Experiences For Short Attention Spans In The Digital Age, Yujiang Wu Jun 2024

Recomposing Museums: Designing Rhythmic Experiences For Short Attention Spans In The Digital Age, Yujiang Wu

Masters Theses

Learning, being the primary aspiration of museums, “is a byproduct of attention.”1 A visitor’s ability to focus and sustain attention on the objects, narratives, and messages within the exhibition environment profoundly influences their overall experience and the educational impact of their visit.

In an era of rapid digital evolution, changes in how information is consumed and communicated have led to shorter attention spans. Traditional museums, which are rooted in continuous, linear storytelling, now face a need for adaptation. This thesis advocates for an innovative exhibition design approach tailored to the realities of shorter attention spans, proposing curatorial and design …

Milpa: Cultivating Community Through Grid Remediation In México, Marianna Pasaret Molinar Jun 2024

Milpa: Cultivating Community Through Grid Remediation In México, Marianna Pasaret Molinar

Masters Theses

In México, the proliferation of monotonous affordable housing developments on the outskirts of urban centers stems from a profit- driven approach that prioritizes rapid construction over livability and community well-being. These housing developments, stark rows of barren husks, reflect a system that depletes both land and human connection. Abandoned units — consequences of a patchwork (or non existent) infrastructure —now stand as silent critiques of this broken system.

Drawing inspiration from the cycical strategies of ancestral agricultural traditions, that recognize the full spectrum from barren stalk to abundance, this project proposes a cyclical model for community growth. Current housing practices, …
