The Importance Of Administrative Appeals As Second Instance Bodies To Strengthen Migration And Asylum Systems, Gabriela Richard Rodriguez Jun 2024

The Importance Of Administrative Appeals As Second Instance Bodies To Strengthen Migration And Asylum Systems, Gabriela Richard Rodriguez

Refugee Law & Migration Studies Brief

According to data from UNHCR's Report, "Global Trends - Forced Displacement in 2022," there were 108.4 million forcibly displaced people worldwide in 2022; in the first half of 2023 alone, there were 110 million displaced people, indicating that 2023 could double the figures of 2022. Based on my experience as an administrative judge in the Administrative Migration Tribunal in Costa Rica— a body of second instance in the migration system— I consider that, in view of the impact that the migration and asylum systems had had in countries of transit and destination, it is essential that there be second instances …

Advancing The Due Process Right To Appointed Counsel In Immigration Removal Proceedings, Chloe Schalit

Refugee Law & Migration Studies Brief

Right now, noncitizens only have the right to an attorney if they can afford one. While courts have grappled with the inherent due process issue accompanying this standard, no court has held that noncitizens have the right to a government- appointed attorney. This paper promotes the provision of government-appointed attorneys to noncitizens in removal proceedings in immigration court under a due process lens. This paper will first briefly examine the difference between criminal and civil matters related to the Sixth Amendment right to an appointed attorney. Next, the paper will engage in a Fifth Amendment due process analysis, ultimately concluding …

Models Of Disability And Judicial Interpretation In India, Sanjay Jain Jun 2024

Models Of Disability And Judicial Interpretation In India, Sanjay Jain

Book Chapters

How disability is modeled or understood is determinative in the evolution of both Disability Studies and Disability Politics. By focusing on India, this chapter demonstrates that transformation and metamorphosis in the lives of persons with disabilities is contingent and predicated on the adoption of models to evolve conceptions of disability and disability rights. Upon the ratification of the United Nations Convention on the Rights of Persons with Disabilities 2006 by India, a presumption arose that the Indian legal order embraced the social and Human rights models of disability and that disability was no longer to be viewed through the prism …

Hiv3: An Efficient Beehive Monitoring System, Jack Ursillo, Aneal Kuverji, Connor Merhab, Anshuman Sahu

Computer Science and Engineering Senior Theses

Beehive monitoring plays a major role in ensuring the health of beehives by checking for overpopulation or underpopulation within a hive. Beehive monitoring provides beekeepers with the opportunity to take action and save the hive before the problem becomes irreversible. Most solutions are too expensive for everyday beekeepers and lack elements of sustainability, making it impractical for small scale beekeepers. In this thesis, we propose a solution to this problem, demonstrating its sustainability and user-friendliness, which enables us to effectively reach a larger consumer market. We support these claims through the use of sustainable systems such as using a solar …

Inciting Peace From The Inside Out, Stephen G. Adubato, Ebere Bosco Amakwe, Katherine Hinic, Sarita Maldjian, Forrest Pritchett, Jon Radwan, Nicholas Sooy, Chad Thralls

Conferences

Violence and war can be incited, and so can peace. This volume shares select addresses and responses from Seton Hall University’s 2/7/23 conference “Inciting Peace From The Inside Out.” A multi-disciplinary range of scholars each addresses how reconciliation processes grow from spiritual dynamics. Multiple religious traditions teach contemplative praxes that prioritize and nurture personal reflection oriented toward peace. Social conflicts divide, so engaging them with a partisan orientation only serves to escalate harmful rifts. In contrast, bringing personal awareness and sensitivity, spiritual balance, and holistic integral perspective to conflict can transcend divisions and work toward unity. This volume is supported …
