The role of corporations in American life has become the focus of intense public and scholarly debate. How do corporations influence political outcomes? What norms or laws should structure corporate political participation? And who should decide what political interventions corporations make? In the last few years, corporations have been called upon to take public positions on myriad issues unconnected to core business concerns. Demands for public statements may arise from various stakeholders, as well as from the general public and the media. Sometimes such statements are uncontroversial, but other times, firms find themselves in a no-win position, in which both silence and voice will offend some core constituency. Crafting meaningful public-facing statements becomes a major challenge.

How Did Corporations Get Stuck In Politics And Can They Escape?, Jill E. Fisch, Jeff Schwartz

Corporations have always been involved in politics, but today is different. They are taking public positions, either directly or indirectly, on contested political and social issues unrelated to their businesses. In contrast to the conventional wisdom, we argue that this practice, which we term “corporate political posturing,” is problematic. First, it is of dubious value to the corporation and its stakeholders. Corporate political posturing often backfires, it does so unpredictably and potentially catastrophically, and it is particularly susceptible to agency costs. Second, it is harmful to society. Corporations are increasingly wading into social and political matters that are unrelated to their business operations. This Paper empirically investigates corporate participation in social debates through the corporate response to Dobbs, the Supreme Court’s decision overturning the constitutional right to abortion.

First, the Paper identifies and examines the public companies that reacted to the reversal of Roe v. Wade (“Reacting Companies”). Only a few corporations reacted. On the one side, they tend to be large, with sizeable workforces, concentrated in consumer-facing and tech industries, and headquartered in states with no restrictions on abortion rights. Federal tax law treats separate nonprofit corporations as distinct legal entities for almost all purposes, in common with most other areas of law. With respect to political activity, this means that one nonprofit corporation’s lobbying or election-related actions are generally not attributed to another nonprofit corporation. This is the case even if the two entities have overlapping or even identical boards of directors. It is also the case even if the two entities collaborate regarding their respective activities and share employees, facilities, outside vendors, and other resources, as long as the entities reasonably allocate the costs for those shared resources. …

The corporatization of health care in the United States has forced us to confront society’s moral expectations of the industry, which serves uniquely vulnerable consumers. Health care has become increasingly more lucrative, attracting private equity (“PE”) investment, specifically in private physicians’ practices. Physicians find PE transactions appealing because physicians have difficulty competing with large hospital systems and complying with expansive regulatory requirements. Free Markets And Free Speech: Understanding The Limits Of The Noerr-Pennington Doctrine, Mitsoo K. Patel

Based in First Amendment principles, the Noerr-Pennington doctrine immunizes parties petitioning the government from antitrust liability, even when such petitioning may be considered anticompetitive. Within the doctrine exists a narrower “sham exception” which eliminates Noerr-Pennington antitrust immunity when petitions are merely shams meant to interfere with a competitor’s business. The Supreme Court has examined the sham exception in two cases which have produced differing standards for when and how to apply it. Importance: The emergence of acute neurological symptoms in children necessitates immediate intervention. Although low- and middle-income countries (LMICs) bear the highest burden of neurological diseases, there is a scarcity of diagnostic and therapeutic resources. Therefore, current understanding of the etiology of neurological emergencies in LMICs relies mainly on clinical diagnoses and verbal autopsies.

Objective: To characterize the association of premortem neurological symptoms and their management with postmortem-confirmed cause of death among children aged younger than 5 years in LMICs and to identify current gaps and improve strategies to enhance child survival.

Purpose: Competency-based medical education (CBME) is gaining global attention and requires context-specific development. Taiwan's Ministry of Health and Welfare has also vigorously promoted the core competencies and sub-competencies of medical education in various specialties. This study aimed to establish a consensus on the core competencies and sub-competencies of clinical psychologists in Taiwan. Methods: In late 2022, the Association of Taiwan Clinical Psychologists (ATCP) and Taiwan Association of Clinical Psychology (TACP) formed the CBME Promotion Committee. Faculty online learning communities (FOLCs) can help faculty effectively adopt and persist in using research-based curricula. This paper documents faculty perspectives on the value they gained from participating in a multi-year FOLC designed to help them implement an inquiry-based physical science curriculum. Personal value narratives were collected from 11 volunteer FOLC participants. In the narratives, participants responded to prompts regarding their initial reasons for participation, activities they engaged in, and values they gained, as well as how participation impacted their profession, social connections, professional practice, and ability to influence their world as teachers. An extensive laboratory test program was conducted to analyze and compare the cation exchange processes in three different varieties of sodium bentonite (Na-B) geosynthetic clay liners (GCLs) over increased conditioning durations up to 32 days and investigate the effects of temperature, solution strength, and applied stress. The goal of this test program was to establish whether the variables of temperature, solution strength, and applied stress improved or degraded the engineering properties of GCLs in laboratory testing and municipal solid waste (MSW) landfill applications. This ethnography draws on key informant interviews and participant observation to produce a case study about plastic mulching as an important industry standard in specialty crop production. It documents the historic adoption and present role of plastic mulching technology in California strawberry production and addresses the characteristics of commercial standard management that inhibit the adoption of alternative mulching practices. This document details the design, implementation, testing, and analysis of an inverted short baseline acoustic positioning system. The system presented here is an above-water, air-based prototype for an underwater acoustic positioning system; it is designed to determine the position of remotely-operated underwater vehicles (ROVs) and autonomous underwater vehicles (AUVs) in the global frame using a method that does not drift over time.

Burnout has become a focal point of concern in the contemporary workplace. The syndrome has elicited undiminished interest among occupational health specialists. The World Health Organization defines burnout as a syndrome "resulting from chronic workplace stress." Burnout is said to comprise three components: (i) feelings of energy depletion or exhaustion; (ii) increased mental distance from one’s job, or feelings of negativism or cynicism toward one’s job; and (iii) a sense of ineffectiveness and lack of accomplishment.
