The federal government engages in massive amounts of informal adjudication - a process that resolves a dispute between the government and a private party by making an individualized and legally binding decision without being required to conduct an evidentiary hearing if the dispute is not settled. This article sketches the highly diverse world of federal informal adjudication and surveys the procedural requirements imposed on it by due process and federal statutes. It proposes a set of best practices for conducting and improving informal adjudication that are rooted in those legal requirements. For decades the National Environmental Policy Act (NEPA) of 1969 was a paradigm of statutory stability. In 2023 that changed overnight with a major rewrite of NEPA as part of the debt ceiling bill. The text of the statute was hurriedly negotiated between President Biden and House Speaker McCarthy, and then passed with virtually no debate.

This article is the first to analyze the amendments. Due to the frenzied enactment process, NEPA is now loaded with overlapping and partially conflicting language, provisions that seem nonsensical if taken literally, and perplexing gaps. The rapid advancement of technology, including artificial intelligence (AI), is creating new challenges for judicial review under the Administrative Procedure Act (APA). In late 2023, federal administrative agencies publicly disclosed over 700 use cases of AI that employ sophisticated techniques like machine learning and natural language processing. While the APA's flexible judicial review framework certainly allows agencies to utilize new technologies, the APA also requires explainability of agency decisions; thus, agencies must be able to articulate the reasoning and methodology behind AI-enabled decisions for the purpose of judicial review. Transgressions of federal environmental law involving significant harm or culpable conduct can result in criminal prosecution. However, we know very little about how such prosecutions have taken place within EPA Region 5, which includes Illinois, Indiana, Michigan, Minnesota, Ohio, and Wisconsin. We undertake a content analysis of 2,807 criminal prosecutions that resulted from U.S. EPA criminal investigations from 1983-2022, selecting all 392 prosecutions occurring within Region 5 for analysis. Results show that over $3.4 billion in monetary penalties, 1,039 years of probation, and over 492 years of incarceration were assessed at sentencing. 33 % of prosecutions centered on water pollution, …

Meeting the Biden administration's goal of cutting greenhouse gases by at least 50 percent from 2005 levels by 2030 will necessarily require transitioning the U.S. energy system away from carbon-intensive fossil fuels like coal. However, coal plants that are retiring early in states with regulated electricity markets usually still have undepreciated book value that has not yet been recovered from ratepayers. If not handled correctly, these "stranded assets" could have financial consequences for utility companies and cause them to actively oppose the energy transition. We propose a new layered visualization in PyArg for grounded labelings of abstract argumentation frameworks. Argument nodes are colored according to their label (IN, OUT, or UNDEC) and have a new length annotation, which is derived from provenance subgraphs. New edge annotations explain an attack-edge’s role in determining the value (label) of nodes in an argumentation framework.

編寫"亡國"歷史記憶 : 徐鉉《吴王隴西公墓志銘》之興亡敘事與李煜論定, Xincheng Zhang

本文以墓志銘爲媒介，期以探析趙宋官方對待降君之態度，透視南唐降臣入宋後的處境與心態，進而側觀趙宋君臣如何回憶並編寫征服南唐的歷史記憶，以及如何詮釋被征服者的政治地位。本文鈎沉徐鉉受宋太宗命爲李煜撰墓志銘背後複雜緊張的政治背景，發現徐鉉在把握趙宋官方統一南唐的立場時，也存故主之義，使之同時具有特殊的文學與史學價值。徐鉉構建南唐國亡乃天命所歸的敘事模式，既淡化李煜亡國之君責任，又尊奉揄揚了趙宋承天受命的正統性。徐鉉還粉飾歷史情境中趙宋侵略的主動性，同時還將國覆責任推之於離間趙宋、南唐關係的吴越。而著重敘述南唐被代表正統的趙宋所併，也源於太宗朝對“太平”這一統治目標的追求。徐鉉在對李煜形象與功業進行蓋棺論定時，突顯李煜對内以古道馭民施行仁政，對外謹藩國之度；藉之促使降臣群體再次認同南唐被趙宋征服的歷史事實。徐鉉繼承“燕許”碑取實録的寫作要旨，客觀指出李煜治國時的弊端，也隱含反省規箴之意。在銘文中以騷體描述李煜既葬勒銘的過程，以典奥淒婉之風抒發哀悼；且運散入駢，顯出雄辭逸氣。徐鉉實對北宋文壇具深遠影響，以該文爲取徑重新審視徐鉉駢文價值，明晰北宋廟堂文章倡古道、守法度、重氣格的文學風尚實有源自宋初徐鉉之跡。

This paper examines tomb inscriptions as a medium to analyze the Zhao Song dynasty's official attitude toward defeated monarchs, specifically to illuminate the conditions and mindsets of Southern Tang officials after their submission to the Song dynasty. It further observes how the Zhao Song rulers and ministers recalled and constructed the historical memory of their conquest of Southern Tang and interpreted the political status of the conquered. The study delves into the complex and tense political background behind Xu Xuan's commission by Emperor Taizong of Song to compose the tomb inseription for Li Yu of the Southern Tang dynasty. …

新見哈佛大學燕京圖書館藏錢謙益《吾炙集》舊鈔本考論 : 兼談此集的編選與刊刻, Yang Xu

錢謙益所輯《吾炙集》作爲清初詩歌選集之重要一種，乾隆間雖曾遭禁毁，仍在清代産生了深遠影響。通過對相關序跋、題詞、評注的解讀，可知《吾炙集》的編選乃本乎真性情，標舉風雅，以見詩家之靈心。從錢氏評語亦可窺見其崇尚自然質樸、反對一味模擬復古的詩學主張，以及晚年對於幽憂衰頽的“亡國之音”的不滿情緒。《吾炙集》初以鈔本形式流傳，因遇文網，故秘而未刊，現存有光緒二十八年刊《怡蘭堂叢書》本、光緒三十三年刊《佚叢甲集》本、民國六年刊《虞山叢刻》本三種，各本跋文略述版本之由來，也存有若干疑點，《吾炙集》是否爲未成之書，所收詩家多寡，前人多謂尚待續考。新見哈佛大學燕京圖書館所藏舊鈔本，爲我們進一步研究提供了重要綫索，今蒐集辨析《吾炙集》刊本、鈔本，又考以相關詩文别集，可知傳世本《吾炙集》應非完帙，集中前二十家當是從錢氏原稿所出，而許友一家則並非原貌。另外，許友目下之末二首可能爲方文佚詩，而卷末評語亦非許友詩評，而是錢謙益評方文詩語。

The Wu Zhi Collection, compiled by Qian Qianyi, is a significant anthology of early Qing poetry. Despite being banned during the Qianlong era, it had a profound impact throughout the Qing Dynasty. Analysis of the prefaces, postscripts, inscriptions, and commentaries associated with the collection reveals that its compilation was rooted in authenticity and genuinity, aiming to showcase elegant tastes and the spiritual essence of poets. Qian's own commentaries also reveal his preference for natural simplicity over slavish imitation of antiquity, as well as his late-life dissatisfaction with the "sounds of a lost nation" (wang Guo zhi yin …

塑造"中國" : 成康大分封與成周王畿區的空間整合, Xianchuang Ye

後世多將《詩經．北山》“溥天之下，莫非王土”視爲西周王朝美好政治願景，實際這句話真切反映出周人欲實現大一統的宏圖。而要達成這一政治鵠的，藉由分封制的推廣來重構新的“中心—四土”地理格局勢在必行。西周統治核心區爲《漢書．地理志》所言的“洛邑與宗周通封畿”，與西部宗周王畿的形成不同，東部的成周王畿區是周公東征以來軍政謀略運用下的塑造結果，突出展現在成康大分封時代異姓諸侯的徙封和姬姓子弟的新封中。商末周初異國楚、鄂原居中原要地，因其阻礙周人地盤擴張和核心區穩固，迫其南遷，而姻戚陳國的褒封因不合於成王封建佈局，亦徙封至南土。成王在令康叔徙封至衛以領有殷舊畿大部基礎上，再於中原新封邘、凡、共、柞、密諸姬姓國。康王更進一步將姜姓焦國遷出三門峽，另封以姬姓焦國來穩固兩畿之間，並將本居邢丘的邢國徙封至北土邢臺以抗戎，從而真正起到蕃屏功效。每一分封（含徙封）諸侯的背後，都體現周初統治者精心建構其地緣空間、優化國土結構的高超設計，最終令後世爲華夏代名詞的“中國”區域在成康時代基本奠定下來。

王國維《人間詞話》雖吸收傳統詩學並以中國傳統的詩話形式寫成，卻深具現代美學的眼光。其境界説既是中國傳統文論的發展，也是中國現代美學的奠基。朱光潛以克羅齊的直覺説爲觀念框架將王國維的境界説納入其中，對其觀念作了進一步的詮釋與再造，使得境界成爲詩論體系中的核心範疇，亦使境界説轉化爲現代美學的基本範疇。朱光潛在吸收王國維境界説建立本人之詩學過程中，也與王氏形成了詮釋與對話關係。王國維論詞有隔與不隔之説，朱光潛對王氏的理解與詮釋究竟隔與不隔？實成一有趣的學術史問題。從王國維到朱光潛都融會中西文論與美學而自成其説，呈現出晚清到民國期間學術轉型的重要面向。

Although written in "poetry talk" form developed in traditional Chinese poetry criticism, Wang Guowei's The Ci Poetry Talk of the World introduces a perspective of modern aesthetics and establishes his theory of "Inscape." After Wang Guowei, Zhu Guangqian adopted Croce's theory of intuition as a broad conceptual framework to rethink and transform Wang's theory into a broader aesthetic paradigm. 明代《冬官》未亡說新論 : 以明代何喬新《周禮集注》為討論中心, Tak Wah Leung

明代治《周禮》者衆多，著作且豐，然後人對明代《周禮》學卻並不重視，如《四庫全書》於“周禮”一類只收三種明人著作，即柯尚遷《周禮全經釋原》、王應電《周禮傳》及王志長《周禮注疏删翼》；《四庫全書簡明目録》更於《周禮注疏删翼提要》中言“以有明一代，三禮幾成絶學，故姑存以備家數”，可見四庫館臣對明代《周禮》學著作極爲輕視，甚至深詆由宋至明《冬官》未亡説之討論。這些論述影響及至現代，至今仍有不少學者承續《提要》的立場，批評明代補亡研究，以致鮮有學者探討相關著作。有見及此，本文擬深入探討《周禮·冬官》補亡的現象，嘗試描述由宋、元至明代中期《冬官》未亡説發展之脈絡，其後再重點討論明代何喬新《周禮集注》之《冬官》未亡研究的特點。因《集注》系統整理宋、元的補亡觀點，且簡明地訓釋《周禮》原文，並常借經文發揮《周禮》大義，引起了明代《周禮》學者廣泛的重視，因而本文亦會討論《集注》對明代《周禮》學之影響，從而略補前人研究之未足。

During the Ming dynasty, the study of The Rites of Zhou flourished with numerous scholars and an abundance of works; however, later scholars, including those involved with the compilation of the Complete Library in the Four Branches of Literature, did not place significant emphasis on these studies. 清代書院的數量爲歷代之最，然而在高壓文化政策背景下，世宗、高宗兩代帝王發展書院教育的主要目的其實是將書院改變爲官辦性質，從而使其成爲朝廷鉗制文士思想、監控其言行的平台和工具，目的是以愚民化的方法來增强君主專制權力。兩代帝王先後通過增加提督學政的監察權，提高山長束脩及生員膏火銀，嚴格月課考核，改科舉策論文爲試帖詩，提倡程式化的八股文寫作，廣泛而深入地宣講《聖諭廣訓》等方式，實現對廣大士子思想的鉗制與禁錮。就其實質而論，乃建州落後的奴隸制宗法體系之金字塔式的主奴關係爲其根本，假借儒家倫理觀念爲其外衣，形成社會思想控制的嚴密體系，爲居於頂端之皇權服務。這一系列的措施雖獲得了王朝的一時穩定，但是極大地損害士風和學風，爲晚清的貧弱狀況埋下了禍根，也嚴重地阻止了中國社會近代化的進程。

Optimized agronomic production is vital to life and livelihood in Haiti. As such, rapid, low-cost soil characterization may inform specific decision making for improved crop production. Ahead of a larger soil characterization campaign (120,000 points) in Eastern Haiti, this study evaluated the use of two proximal sensors (portable X-ray fluorescence – pXRF; NixPro color sensor) at farms of Association Zanmi Agrikol (AZA) for soil characterization and evaluation of spatial variability of soil properties. Despite the increased popularity of female elite road cycling, research to inform the fueling requirements of these endurance athletes is lacking. In this case study, we report for the first time the energetics of a female world-tour cyclist competing in the 2023 Tour de France Femmes, an 8-day race of the Union Cycliste Internationale. The 29-year-old athlete presented with oligomenorrhea and low T3 before the race. Total daily energy expenditure assessed with the doubly labeled water technique was 7,572 kcal/day (∼4.3 physical activity levels), among the highest reported in the literature to date for a female. With high rates of violence exposure among justice-involved youth, it is critical to identify factors that might impact the likelihood of youth engaging in violence themselves. One such factor is sensitivity to context, which describes how sensitive youth are to experiences in their environment. Using an ethnically diverse sample of justice-involved male adolescents (47% Latino, 38% Black/African American, 15% White) aged 13-17 at the time of their first arrest, the results of this study indicate that exposure to violence was related to increased violent behavior six months later, and this effect was strongest among youth who were low in sensitivity …

High-Throughput experiments often produce ranked gene outputs, with forward genetic screening being a notable example. While there are various tools for analyzing individual datasets, those that perform comparative and meta-Analytical examination of such ranked gene lists remain scarce. Here, we introduce Gene Rank Meta Analyzer (GeneRaMeN), an R Shiny tool utilizing rank statistics to facilitate the identification of consensus, unique, and correlated genes across multiple hit lists. Objective: Currently, little is known about the mechanism(s) regulating global and specific protein translation during metabolic dysfunction-associated steatohepatitis (MASH; previously known as non-alcoholic steatohepatitis, NASH). Methods: Unbiased label-free quantitative proteome, puromycin-labelling and polysome profiling were used to understand protein translation activity in vitro and in vivo. Results: We observed a global decrease in protein translation during lipotoxicity in human primary hepatocytes, mouse hepatic AML12 cells, and livers from a dietary mouse model of MASH. Interestingly, proteomic analysis showed that Rplp1, which regulates ribosome and translation pathways, was one of the most downregulated proteins. Purpose: Changes in autonomic (ANS) and enteric nervous systems (ENS) may be involved in pathogenesis of obesity. We hypothesized that baseline autonomic and enteric parameters may predict outcomes of diverse obesity therapies. Material and Methods: We studied ANS and ENS physiology in 37 patients (8 male, 29 female, age 45 years, weight 129.7 kg) at 4 centers in patients undergoing medical (9: low-calorie diet) versus invasive (22: 16 sleeve, 6 bypass) and semi-invasive (6: 2 band, 2 high energy stimulation, 2 aspiration) weight loss therapies. Context: Adults with type 1 diabetes (T1D) face the necessity of balancing the benefits of exercise with the potential hazards of hypoglycemia. Objective: This work aimed to assess whether impaired awareness of hypoglycemia (IAH) affects exercise-associated hypoglycemia in adults with T1D. Seven of the top ten leading causes of death in the United States are due to chronic diseases and treating these accounts for 86 percent of our nation's health care costs. The workplace offers an environment to implement chronic disease prevention strategies, such as worksite wellness programs, due to the large amount of time spent at the worksite daily by employees. As a result of COVID-19, many organizations began to change their workdays (i.e., working from home). Objective: Evaluate the validity of the PortionSize application. Methods: In this pilot study, 14 adults used PortionSize to record their free-living food intake over 3 consecutive days. Digital photography was the criterion measure, and the main outcomes were estimated intake of food (grams), energy (kilocalories), and food groups. Equivalence tests with ±25% equivalence bounds and Bland-Altman analysis were performed. Results: Estimated gram intake from PortionSize was equivalent (P < 0.001) to digital photography estimates. PortionSize and digital photography estimated energy intake, however, were not equivalent (P = 0.08), with larger estimates from PortionSize. In addition, PortionSize and digital photography were equivalent for vegetable intake (P = 0.01), but PortionSize had larger estimates of fruits, grains, dairy, and protein intake (P >0.07; error range 11% to 23%). We present an in-depth, high-resolution spectroscopic analysis of the M dwarf K2-18, which hosts a sub-Neptune exoplanet in its habitable zone. We show our technique to accurately normalize the observed spectrum, which is crucial for a proper spectral fitting. We also introduce a new automatic, line-by-line, model-fitting code, AutoSpecFit, which performs an iterative χ ² minimization process to measure individual elemental abundances of cool dwarfs. We apply this code to the star K2-18, and measure the abundance of 10 elements: C, O, Na, Mg, Al, K, Ca, Sc, Ti, and Fe. We find these abundances to be moderately supersolar, except …

Benzotriazole ultraviolet stabilizers (BUVSs) are a group of widely used chemicals added to a variety of consumer (e.g., plastics) and industrial (e.g., metal coating) goods. Although detected globally as an environmentally persistent pollutant, BUVSs have received relatively little toxicological attention and only recently have been acknowledged to affect development and the endocrine system in vivo. In our previous study, altered behavior, indicative of potential neurotoxicity, was observed among rainbow trout alevins (day 14 posthatching) that were microinjected as embryos with a single environmentally relevant dose of 2,4-di-tert-butyl–6-(5-chloro-2H-benzotriazol-2-yl) phenol (UV-327).
