"Legally Magic" Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Roseanna Sommers, Kate Weisburd Nov 2024

"Legally Magic" Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Roseanna Sommers, Kate Weisburd

Northwestern University Law Review

Fifth Amendment case law (including Miranda v. Arizona) requires that individuals assert their right to counsel or silence using “explicit,” “clear,” and “unambiguous” statements—or, as some dissenting judges have lamented, using “legally magic” words. Through a survey of 1,718 members of the U.S. public, we investigate what ordinary people believe it takes to assert the right to counsel and the right to silence. We then compare their perceptions against prevailing legal standards governing invocation.

With respect to the right to counsel, the survey results indicate that members of the public have a uniformly lower threshold for invocation than do …

Synthesis And Evaluation Of Cyclic Peptide-Dasatinib Conjugates As Anti-Melanoma Agents, Shaban Darwish, Dorna Davani-Davari, Shirley Tong, Rakesh Kumar Tiwari, Sun Yang, Keykavous Parang

Pharmacy Faculty Articles and Research

Herein, we synthesized two amphiphilic cyclic peptides, incorporating tryptophan and arginine residues, linked to dasatinib via a Cathepsin B-sensitive tetrapeptide (Gly-Phe-Leu-Gly). To mitigate steric hindrance and optimize drug release, we integrated two different linkers, succinate and glutarate, between the drug and peptide. The synthesis involved solid-phase techniques for the assembly of the peptide, followed by the coupling of the peptide on-resin with the linker, mild cleavage, and solution-phase cyclization. Conjugation of the peptide-attached linker with dasatinib was conducted in the presence of N-methylmorpholine and 1-ethyl-3-(3-dimethylaminopropyl) carbodiimide (EDC), generating the novel prodrugs. The synthesized compounds were characterized by high-resolution mass …

Myc And Egr1 Expression In Colorectal Cancer Cells With An Oncogenic Mutation In Ctnnb1 And Normal P53, Sophia Vickers, Erick Spears, Phd Nov 2024

Myc And Egr1 Expression In Colorectal Cancer Cells With An Oncogenic Mutation In Ctnnb1 And Normal P53, Sophia Vickers, Erick Spears, Phd

Science University Research Symposium (SURS)

Cancer is often initiated by genetic alterations that affect cellular proliferation, survival, and differentiation. Colorectal cancers are specifically initiated and driven by mutations affecting the Wnt signaling pathway and mutations in the CTNNB1 gene are the second most common of these mutations found in colorectal cancers. Among these, mutations in the CTNNB1 gene, encoding β-catenin, frequently lead to dysregulated Wnt signaling, a hallmark of colorectal cancer. The proto-oncogene MYC and the early growth response gene EGR1 are known to be critical downstream effectors of several oncogenic pathways. MYC is a known β-catenin target gene and under certain cellular contexts, EGR1 …

Accommodating Incompetency In Immigration Court, Elizabeth Jordan Nov 2024

Accommodating Incompetency In Immigration Court, Elizabeth Jordan

Northwestern University Law Review

In criminal law, an individual must be deemed competent to stand trial, yet our immigration courts routinely order the deportation of incompetent noncitizens. A removal proceeding against a noncitizen—where an outcome of deportation often risks life-threatening harm—continues apace even if the noncitizen has been deemed incompetent by the immigration judge. In place of halting proceedings, the immigration judge imposes “safeguards” pursuant to a provision of the immigration code that neither defines nor explains the term. In practice, judges’ application of the term “safeguards” is often absurd. The implications of continuing a proceeding against a noncitizen with a disability affecting competency …

Taxation's Limits, Luís C. Calderón Gómez Nov 2024

Taxation's Limits, Luís C. Calderón Gómez

Northwestern University Law Review

Countless pages have been devoted to the question of why everyone should pay tax, yet its opposite has gone largely unnoticed: why should some people and organizations not pay tax? Our tax system exempts from ordinary income taxation a wide and diverse array of people and organizations engaged in significant economic activity—from parents providing childcare services for their family to consular activities and charities operating animal shelters—seemingly without a convincing explanation. Perhaps because of the dizzying diversity of tax-exempt activities, scholars and policymakers have avoided comprehensively or coherently justifying our exemption regimes.

This Article develops a novel normative theory that …

South Korea’S Financial Supervisory Service Mediating Disputes Over Hong Kong-Tied Equity-Linked Security Losses, Michele Kallo

Cardozo Journal of Conflict Resolution (CJCR) Blog

Since January 8, 2024, South Korea’s financial regulator, Financial Supervisory Service (FSS), has investigated major Korean banks for selling high-risk equity-linked securities (ELS) products linked to Hong Kong’s Hang Seng China Enterprises Index (HSCEI), which resulted in substantial financial losses among South Korean investors. An ELS is a derivative product that promises returns if the underlying asset—in this case, the HSCEI—stays above a specified “knock-in” level until it matures. Due to the severe decline in the HSCEI, many ELS products have seen drastic devaluations, leading to significant losses for investors, including those who are risk averse. Investors aged 65 and …

Background: Prostate cancer is the most diagnosed cancer in Black/African American men (AA) and the second‑leading cause of cancer-related deaths. A prostate-specific antigen (PSA) blood test is an early detection screening tool for prostate cancer, but uptake of PSA screening remains low among AA men. Greater PSA screening rates among AA men, coupled with earlier treatment, may reduce disparities in prostate cancer outcomes, including mortality. The current pilot study will test the first-of-its-kind mobile health (mHealth) app to improve prostate cancer knowledge and increase PSA screening uptake among AA men using home-based screening methods. Methods: AA men aged 55 to …

Mental illness is common and can affect anyone. Each year the University welcomes students with Mental Health Issues. One in four adults in the US will experience a mental illness in their lifetime, however according to a NUS survey, eight out of ten students will experience a mental illness while in higher education. For some student’s mental illness can be a lifelong disability. Others can experience short term issues that emerge around difficult or stressful life events, while some students may be more at risk of experiencing mental illness in relation to their ethnicity, gender, sexuality or socio-economic background. Although …

Manuscripts, Articles, Book Chapters and Other Papers

Background: MYH6 variants are the most well-known genetic risk factor (10%) for hypoplastic left heart syndrome (HLHS) and are associated with decreased cardiac transplant-free survival. MYH6 encodes for α-myosin heavy chain (α-MHC), a contractile protein expressed in the neonatal atria. We therefore assessed atrial function in HLHS patients with MYH6 variants. Methods: We performed a retrospective, blinded assessment of pre-stage I atrial function using 2D speckle-tracking echocardiography (2D-STE). Variant carriers were control-matched based on AV valve anatomy, sex, and birth year. Studies were obtained postnatally from awake patients prior to surgical intervention. Right atrial (RA) and right ventricular …

Purpose: The EXTEND trial tested the hypothesis that adding comprehensive metastasis-directed therapy (MDT) to chemotherapy would improve progression-free survival (PFS) over chemotherapy alone among patients with oligometastatic pancreatic ductal adenocarcinoma (PDAC).

Methods: EXTEND (ClinicalTrials.gov identifier: NCT03599765) is a multicenter, phase II basket trial randomly assigning patients with ≤five metastases 1:1 to MDT plus systemic therapy versus systemic therapy. Disease progression was defined by radiologic criteria (RECIST v1.1), clinical progression, or death. The primary end point was PFS in the per-protocol population, evaluated after all patients achieved at least 6 months of follow-up. Exploratory end points included systemic immune response …

Background: We have recently constructed a DNA methylation classifier that can discriminate between pancreatic ductal adenocarcinoma (PAAD) liver metastasis and intrahepatic cholangiocarcinoma (iCCA) with high accuracy (PAAD-iCCA-Classifier). PAAD is one of the leading causes of cancer of unknown primary and diagnosis is based on exclusion of other malignancies. Therefore, our focus was to investigate whether the PAAD-iCCA-Classifier can be used to diagnose PAAD metastases from other sites.

Methods: For this scope, the anomaly detection filter of the initial classifier was expanded by 8 additional mimicker carcinomas, amounting to a total of 10 carcinomas in the negative class. We validated the …

Examining Emergency Remote Teaching And Undergraduate Academic Outcomes During The Pandemic, Melissa S. Ramge

USF Tampa Graduate Theses and Dissertations

The COVID-19 pandemic represented an extraordinary public health emergency, leading to the most profound disruption to education systems in modern history. As higher education institutions expand their post-pandemic online course catalogs, it is necessary first to explore the student outcomes and student perceptions of learning related to the pandemic. This study used an explanatory sequential mixed methods research design to assess the relationship between the COVID-19 pandemic and students’ perceptions of online learning. The purpose of the study was to examine what, if any, trends in undergraduate student course grades and student perceptions of the instruction occurred coincident with the …

Research outputs 2022 to 2026

Coastal wetlands are crucial in climate change regulation due to their capacity to act as either sinks or sources of carbon, resulting from the balance between greenhouse gas (GHG) emissions, mainly methane (CH4), and soil carbon sequestration. Despite the paramount role of wetlands in climate regulation few studies investigate both aspects. The Camargue is one of the largest wetlands in Europe, yet the ways in which environmental and anthropic factors drive carbon dynamics remain poorly studied. We examined GHG emissions and soil organic carbon (SOC) stocks and accumulation rates in twelve representative wetlands, including two rice fields, to gain insights …

The Sec As An Entrepreneurial Enforcer, James J. Park Nov 2024

The Sec As An Entrepreneurial Enforcer, James J. Park

Northwestern University Law Review

The truth of disclosures by public companies is policed by both private plaintiffs and the Securities and Exchange Commission (SEC). The courts and many commentators have viewed the SEC as a more responsible enforcer than private litigants. Entrepreneurial enforcers with a profit motive have an incentive to advance questionable legal theories to expand the reach of Rule 10b-5, the primary federal prohibition of securities fraud. In contrast, the conventional view is that a public enforcer will bring straightforward cases against public companies. This Article argues that this perception is dated, and that the SEC has become more entrepreneurial in its …
