Reconceiving Corporate Rights And Regulation In The Ai Era, Michael R. Siebecker Nov 2024

Reconceiving Corporate Rights And Regulation In The Ai Era, Michael R. Siebecker

Sturm College of Law: Faculty Scholarship

Can existing corporate governance principles properly guide the relationship between shareholders and directors as artificial intelligence (“AI”) plays an increasingly prominent role in corporate management, planning, and operations? Without a doubt, AI technologies allow corporations to enjoy enhanced efficiency and innovation. But the vast range of AI capabilities—from sophisticated data analytics to autonomous decision-making—raises profound questions about whether traditional governance principles remain sufficiently robust to cabin the proper development and deployment of such a powerful and rapidly evolving set of new technologies. Current corporate governance structures that focus on human actors and traditional business decision-making mechanisms seem ill-suited to address …

Resting-State Functional Connectivity Of Motivational Circuity After Tbi: A Comparison Between Medical Cannabis Users And Non-Users, Cidney Rae Robertson-Benta Nov 2024

Resting-State Functional Connectivity Of Motivational Circuity After Tbi: A Comparison Between Medical Cannabis Users And Non-Users, Cidney Rae Robertson-Benta

Psychology ETDs

For many, symptom resolution occurs relatively quickly after traumatic brain injury (TBI), however some people experience symptoms that can last for months and even years. Apathy is a symptom that can cause disruption after TBI. While cannabis has been suggested to treat several symptoms and conditions related to TBI, given the historical association with apathy, investigation of the relationship is imperative. There is little research in the medical population, with even less in specific clinical samples - this study aims to bridge this gap. 52 participants with symptoms lasting at least 6 months were compared based on the use of …

Improving Employee Retention In The Virtual Workforce, Marissa Williams

Walden Dissertations and Doctoral Studies

The need for addressing employee retention in the virtual workforce is critical, particularly in the context of the U.S. General Services Administration (GSA) Region 4. High employee turnover rates can lead to significant disruptions and decreased organizational performance. This administrative case study involved identifying effective strategies to improve retention and engagement among virtual employees. The practice-focused question involved understanding key factors that influenced employee retention and developing actionable recommendations for the GSA. Insights can be applied across similar organizations facing virtual workforce challenges. Data were collected through in-depth surveys with employees that were hired between 2020 and 2023, focusing on …

The Role Of Creation On Mediating Grace For The Purpose Of Spiritual Formation, Pam H. Zolczer Nov 2024

The Role Of Creation On Mediating Grace For The Purpose Of Spiritual Formation, Pam H. Zolczer

Doctor of Ministry Projects and Theses

During a very difficult time in my life I found emotional and spiritual healing during time spent immersed in creation. My guide on this journey, other than the human companions who were concerned for me during my loss, has been a horse. While I thought I was learning to care for and ride a horse, I learned something much more significant: I learned how to give my pain away and I rushed breathlessly into a new phase of my love for God. I also rushed into a new vocation. And all of this is because I ride Cooper.[1] This …

This Symposium piece will reiterate some of the conversations by panelists discussing the use of law to become Guardians of Justice, the relationship between education and democracy, and the Ohio Constitution as a tool for recapturing the state’s democratic values.

Shadows Of The Crown: The Virtue Of Equilibrium In American Sovereign Immunity, William T. Olmstead Nov 2024

Shadows Of The Crown: The Virtue Of Equilibrium In American Sovereign Immunity, William T. Olmstead

Cleveland State Law Review

Under the doctrine of sovereign immunity, the federal and state governments of the United States cannot be sued or prosecuted unless they voluntarily waive their own impunity. In recent decades, the Supreme Court has expanded the scope of the sovereign immunity of the state governments. This Note argues that such an expansion is a profound and shortsighted mistake. It proposes that the most effective way to balance governmental functionality with civic accountability is to pass and ratify a constitutional amendment that solidifies national sovereign immunity and abolishes state sovereign immunity. It argues that such action is necessary to ensure the …

The Dignitary Harms Of Racism In Public Education: Expanding The Lens Of Brown Beyond Segregation, Kumar Ramanathan, Matthew D. Nelsen Nov 2024

The Dignitary Harms Of Racism In Public Education: Expanding The Lens Of Brown Beyond Segregation, Kumar Ramanathan, Matthew D. Nelsen

Cleveland State Law Review

Reflecting on the 70th anniversary of Brown v. Board of Education, we reconsider the landmark ruling’s conception of dignitary harm in public education. In its argument against the separate-but-equal standard that undergirded segregated schools in the South, the Supreme Court focused on the psychological harm that segregation imposed on Black children. Building on past critiques, we argue that the Court’s analysis was too narrow: the psychological harm it identified is only one of many forms of dignitary harm that racially marginalized students can face in schools. Importantly, dignitary harms can persist even in integrated schools and classrooms, through practices …

The Decline Of Representation Reinforcement In The Supreme Court: Increasing Deference To The Political Process, Jonathan L. Entin Nov 2024

The Decline Of Representation Reinforcement In The Supreme Court: Increasing Deference To The Political Process, Jonathan L. Entin

Cleveland State Law Review

The Supreme Court has often interpreted the Constitution with an eye toward ameliorating failures of the political process. Over the past two decades, however, the Court has retreated from that concern with representation reinforcement. This article examines decisions upholding restrictive voter identification laws, making it more difficult to prove violations of the Voting Rights Act, and preventing federal courts from hearing claims of partisan gerrymandering. Some decisions that seem sympathetic to failures of the political process will not really promote representation reinforcement, and the Court’s most recent cases further reinforce the Court’s skepticism of claims of failures of the political …

Threading The Needle In Extreme Partisan Gerrymandering Cases, Michael Gentithes Nov 2024

Threading The Needle In Extreme Partisan Gerrymandering Cases, Michael Gentithes

Cleveland State Law Review

Recent Supreme Court jurisprudence paints a grim picture for future reform to address extreme partisan gerrymandering. The decisions in Rucho v. Common Cause and Moore v. Harper appear to foreclose progress at both the federal and state level. Reformers must neither create unmanageable legal standards for adjudication in federal litigation, nor ask state courts to transgress ordinary bounds of judicial review when interpreting state laws that might address gerrymandering.

But there remains a path forward that focuses on clear and detailed state constitutional mandates to curb gerrymandering practices. Beneath their rhetoric, these decisions support clear legal rules over broader democratic …

The Perceptions Of Female Superintendents Regarding Their Underrepresentation N Public School Districts, Vanessa Araceli Conejo Nov 2024

The Perceptions Of Female Superintendents Regarding Their Underrepresentation N Public School Districts, Vanessa Araceli Conejo

Walden Dissertations and Doctoral Studies

Male superintendents predominantly hold superintendency in K–12 public school districts in the southern United States. The research problem was the underrepresentation of female superintendents in K–12 public school districts. The purpose of this qualitative study was to explore how female superintendents perceive the underrepresentation of females holding superintendent positions and recommendations on how to secure the position in K–12 public school districts. The conceptual framework was the congruity theory of Eagly and Karau, which posits that aspiring female K–12 school principals willing to serve the school districts in the role of superintendent are perceived as less suitable for leadership positions …

Patrol-Level Law Enforcement Experiences With Gray Area Mental Health Crises, Stephanie Louise Schilling Nov 2024

Patrol-Level Law Enforcement Experiences With Gray Area Mental Health Crises, Stephanie Louise Schilling

Walden Dissertations and Doctoral Studies

Law enforcement officers (LEOs) often find themselves responding to mental health crises that are gray area situations that neither clearly warrant arrest nor hospitalization but still require intervention. This qualitative study involved addressing the critical issue of how patrol-level officers in California manage such crises despite limited mental health training and restrictive legal frameworks. The study involved filling a gap in literature by focusing on nuanced challenges officers face in these situations, rather than use of force or racial disparities. Grounded in Bronfenbrenner’s bioecological model, the research involved exploring lived experiences of six patrol-level officers using interpretative phenomenological analysis (IPA). …

Organizational Characteristics As Drivers Of Employer Attraction, Naomi L. Akins-Osuma Nov 2024

Organizational Characteristics As Drivers Of Employer Attraction, Naomi L. Akins-Osuma

Dissertations

This research study examined perceptions of attraction to different organizational characteristics based on an individual’s Career Stage in Super’s (1980) life-span model. Using a diverse sample of 230 participants in the U.S. workforce 18 years or older, the study manipulated the opposing Reputation and flexible working arrangement (FWA) conditions of a hypothetical hiring organization in the technology industry. The results indicated that the main effects of Reputation and FWAs on general attraction, intention to pursue, perceived economic citizenship, and perceived ethical citizenship were significant. Although the high levels of Reputation and FWA yielded the highest mean scores among the dependent …

Attention Deficit/Hyperactivity Disorder In Secondary Instrumental Music Ensembles: A Qualitative Intrapersonal Inquiry, Christopher Sakowski Nov 2024

Attention Deficit/Hyperactivity Disorder In Secondary Instrumental Music Ensembles: A Qualitative Intrapersonal Inquiry, Christopher Sakowski

Dissertations

Executive function is deficient in individuals with ADHD. Playing a musical instrument has been shown to improve executive functions. This study examined if participants with ADHD perceived a connection between playing an instrument in a music ensemble and improved executive functioning, as well as improved ADHD presentations. The research design used for this study was a basic qualitative design, focusing on phenomenological intrapersonal inquiry. Data collection was done entirely through 60-120 minute semi-structured interviews with both music educators and non-music school personnel that participated in instrumental music ensembles as young students. Interviews were recorded using Zoom, transcribed using Microsoft Office …

The Last Crusade, Macy Kendall

B.A./B.S. Practicum Group Exhibit (ART 499)

Since I was little, I was always drawing and it has always fascinated me. Drawing was something that allowed me to let my overactive imagination roam as a child and it also allowed me to bond with people. I remember being in Elementary School and I would have inside jokes with friends about some art project we came up with together. Growing up, in high school I was still the ‘quiet kid’ that people like my current partner thought didn’t even speak, until they saw me in the art room. Truth was, the art room was a release for me …

‘Thank The Heaven’s Issue 1: Plate of Bones’ is an issue of a comic I have created inspired by the older style of weekly publications such as that of Casper The Friendly Ghost or Archie that people would buy at newsstands. This comic is set in Europe in a vaguely distant time period and inspired by my background as an Italian American. My work aims to combine the best of both worlds of physical and digital art by blending traditional art methods, primarily illustration in the form of comics, with the ease and convenience that technology and digital tools allow …

The Last Crusade, Michael Ridenour

B.A./B.S. Practicum Group Exhibit (ART 499)

Michael Ridenour

My work comes from imaginative inspiration as well as a personal nostalgia. This visual influence on my work comes primarily from Japanese animation as well as my memories of the visual culture of my youth—I filter these touchpoints through current trends to inspire new work. The vast majority of my art involves drawing with graphite and/or charcoal. My art making reflects critical thinking about my experiences by trying to portray a breadth of emotion in the confined two-dimensional space of a drawing. I am interested in continuing to explore the ideas of childhood nostalgia in my future work. …
