Systm.

Maze Of Mind 心之万象, Yi Bing (Bing-Yi Huang) 黄冰逸

Zhou Documents

This article introduces the artist’s exhibition Maze of Mind 心之万象. Following the main idea that “the mind is all things, the brain is the universe,” the exhibition uses painting to explore the human heart, brain, wisdom, and spirit. It takes “xiang (image) 象” from Chinese aesthetics as a key concept, understanding “xiang” as the outward expression of the mind. The exhibition is presented in four chapters: “Myriad Things 万物” emphasizes that the human’s mind is an expression of perception and interdependence with all life. “Universe 宇宙” compares the brain to galaxies and expresses the core power of love. “Emptiness 空性,” …

Empty Voting And Hidden Ownership In Canadian Jurisprudence, Maziar Peihani Jan 2025

Empty Voting And Hidden Ownership In Canadian Jurisprudence, Maziar Peihani

All Faculty Publications

The classic understanding of equity encompasses a suite of economic and governance rights, which typically includes the rights to vote, receive dividends, and participate in distribution of assets upon dissolution. This conventional view, outlined in corporate legislations, is supported by Canadian jurisprudence and corporate law scholarship. However, financial innovations have facilitated the separation of voting rights from the financial entitlements of shares, creating a marketplace where shareholder interests are reconfigured and traded in diverse ways. Derivatives and securities lending arrangements have led to phenomena known as empty voting and hidden ownership. In empty voting, an investor retains voting rights without …

What Can One Learn From Chinese Tax Administration? A Precis Of The Administrative Foundations Of The Chinese Fiscal State (Cambridge University Press, 2022), Wei Cui Jan 2025

What Can One Learn From Chinese Tax Administration? A Precis Of The Administrative Foundations Of The Chinese Fiscal State (Cambridge University Press, 2022), Wei Cui

All Faculty Publications

The Administrative Foundations of the Chinese Fiscal State (Cambridge University Press 2022) explores how China developed a tax system to support its economic transformation. Among scholars who study taxation and economic growth, a familiar idea is that it is generally very difficult for poor countries to develop the state apparatus needed to raise revenue. The lack of revenue, in turn, prevents governments from providing critical public goods and services needed to spur economic growth. State capacity in taxation, therefore, is a major determinant of which countries become prosperous and which do not. An obvious question, then, is whether the evolution …

Words And Stardom: Modernist Poetic Responses To Asta Nielsen, Karl E. Toepfer Jan 2025

Words And Stardom: Modernist Poetic Responses To Asta Nielsen, Karl E. Toepfer

Open Educational Resources

This essay discusses how four modernist poets portrayed the Danish movie star Asta Nilesen (1881-1972). German Hans Schiebelhuth (1895-1944) describes the "demonic" power of Nielsen's image to awaken dark aspects of his adolscent personality. For the Flemish poet Paul van Ostaijen (1896-1928), Nielsen's cinematic image provokes a radical shattering of language into extravagant "word-images." Danish writer Rudolf Broby-Johansen (1900-1987) linked Nielsen's image to a radical (Marxist) critique of oppressive sexual politics within a capitalist society. German Franz Behrens (1895-1977) composed a lengthy, expressionist ode to Nielsen from the perspective of one who actually worked as a screenwriter in the German …

Emortgage And Crypto-Mortgage In Home Finance, Julia Patterson Forrester Rogers Jan 2025

Emortgage And Crypto-Mortgage In Home Finance, Julia Patterson Forrester Rogers

Faculty Journal Articles and Book Chapters

Most home mortgage loans today are documented on physical paper, but they are increasingly closed as eMortgages. The move to electronic documents is inevitable and will ultimately be a positive change for lenders and borrowers. However, additional regulation is needed to address issues raised by electronic home mortgage closings and the “crypto-mortgage,” a mortgage loan with the obligation evidenced by or tethered to a non-fungible token.

Lenders have traditionally required that home mortgage loans be evidenced by a wet-signed paper promissory note to gain the advantages and the certainty of Article 3 of the Uniform Commercial Code (UCC) governing negotiable …

Breaking Kayfabe, Thomas B. Bennett

Faculty Journal Articles and Book Chapters

The membership of the Supreme Court affects how it decides cases. This maxim is well accepted among the public. But it is exceedingly rare for Supreme Court opinions to acknowledge this fact, even when it provides the best explanation for the Court’s behavior. And in the unusual instance in which Supreme Court opinions do refer to changes in the Court’s membership, it is jarring. This Article explores two questions that flow from these uncontroversial facts. First, why does it happen so rarely? Second, why does it happen at all?

To answer these questions, the Article looks to an unusual source: …

Reevaluating Felon-In-Possession Laws After Bruen And The War On Drugs, Laura Ginsberg Abelson Jan 2025

Reevaluating Felon-In-Possession Laws After Bruen And The War On Drugs, Laura Ginsberg Abelson

Faculty Journal Articles and Book Chapters

The legal landscape surrounding firearm possession is evolving rapidly. In 2022, the Supreme Court accelerated its expansion of the individual right to bear arms under the Second Amendment in New York Rifle & Pistol Ass’n v. Bruen. Since Bruen, courts around the country have struck down nearly all types of firearm regulations, with a notable exception: felon-in-possession laws. This Article examines the implications of a legal landscape where those who have prior felony convictions, and especially prior drug convictions, are punished harshly for the same behavior—possession of a firearm—that is constitutionally protected for nearly everyone else. I argue …

A Brief Look At Authoritarianism And Totalitarianism Through A Perspective Of Jewish Law And Tradition, Samuel J. Levine

Scholarly Works

A view of authoritarianism and totalitarianism through a perspective of Jewish law and tradition might take various forms and draw upon different approaches, depending on a number of components, including definitions of terms, modes of analysis, and the scope of disciplines and materials to be incorporated. Rather than attempting to present a comprehensive or determinative presentation of historical and philosophical considerations of these issues, this essay will briefly explore conceptual lessons from narrative, political, and legal sources of Jewish tradition, suggesting that Jewish thought recognizes, at once, both the importance of unity and authority and the dangers of authoritarianism and …

You Get The Jury You Get And You Don’T Throw A Fit, Taurus Myhand

Scholarly Works

The proliferation of deepfake videos has resulted in rapid improvements in the technology used to create them. Although the use of fake videos and images is not new, advances in artificial intelligence have made deepfakes easier to make and harder to detect. Basic human perception is no longer sufficient to detect deepfakes. Yet, under the current construction of the Federal Rules of Evidence, trials judges are expected to do just that. Trial judges face a daunting challenge when applying the current evidence authentication standards to video evidence in this new reality of widely available deepfake videos. This article examines the …

Drop Dynamics During Condensation On Superhydrophobic Surfaces In Vapor Shear Flow, Shaur Humayun, R. Daniel Maynes, Julie Crockett, Brian D. Iverson

Faculty Publications

Accurate models for predicting drop dynamics, such as maximum drop departure sizes, are crucial for estimating heat transfer rates during condensation on superhydrophobic (SH) surfaces. Previous studies have focused on examining the heat transfer rates for SH surfaces under the influence of gravity or vapor flowing over the surface. This study investigates the impact of surface solid fraction and texture scale on drop mobility in a condensing environment with a humid air flow. Experiments recorded condensation with varying surface feature sizes from micro- to nano scale under different flow rates. Video analysis detected the drop-size distribution and maximum drop departure …

Accessibility For All?, Jessica Pasquale Jan 2025

Accessibility For All?, Jessica Pasquale

Law Librarian Scholarship

There are new Americans with Disabilities Act requirements for state and local governments, so as employees of the University of Michigan, my colleagues and I have been preparing to meet them for over a year. Recently, I began wondering about the accessibility of websites for law firms in Michigan, so I conducted a brief and informal survey of randomly selected firms based on affiliations listed in the State Bar of Michigan’s ‘Find a Lawyer’ directory. I ran each site through the automated tool offered by AccessibilityChecker.org and found that 100% of the sites I checked were rated as noncompliant with …
