Dipl 6131 Aa Causes Of War, Edislav Manetovic Phd

Diplomacy Syllabi

Why do states go to war? Why do social groups go to war? Major part of this course will be devoted to surveying main conceptual explanations on the causes of war. We will end the course by focusing on a single recent case study - Bosnia. To a large extend the war in Bosnia symbolizes post-Cold War conflicts because it involved numerous actors and because it was the first major peacebuilding attempt conducted by the international community. Two decades since the start of the Bosnian war, the international community is still heavily involved in Bosnia.

Endeavor to actively engage the …

Armor All: The Self-Conception Of Private Security Contractors, Volker C. Franke Oct 2012

Armor All: The Self-Conception Of Private Security Contractors, Volker C. Franke

Faculty Articles

Whereas the values, attitudes and motivations of soldiers serving in their countries’ armed forces have been widely studied, to date we know very little about the motivations and self-conception of individuals working for the private security industry. Using data obtained through an online survey, this article explores the values, attitudes and identity of more than 200 private security contractors with law enforcement backgrounds and operational experience with a security firm in Iraq. Contrary to media dominating images of ruthless, money-grabbing mercenaries, respondents in this sample adhered to attitudes and values very similar to those of professional soldiers serving in Western …

Dipl 3850/Core 3850 Church, State, And Politics In Latin America, Benjamin Goldfrank Phd

Diplomacy Syllabi

This course has two central objectives: 1) to provide students with an understanding of the evolving role of religion in Latin American politics, with a primary emphasis on the role of Catholicism and the Catholic Church from the period of the Second Vatican Council until the present; and 2) to provide students an opportunity to reflect on the normative questions of how religious beliefs and religious institutions should affect politics and of how different political systems and state policies should affect the practice of religion. The major themes, to be examined through both Catholic and non-Catholic perspectives, include the institutional …

Developing A Teacher Training Program For New Clinical Teachers, Wallace J. Mlyniec

Georgetown Law Faculty Publications and Other Works

Where to Begin? Training New Teachers in the Art of Clinical Pedagogy, an article published in the Spring, 2012, issue of the Clinical Law Review, gave a full description of Georgetown’s course in clinical pedagogy. That article set forth some of the critical questions new teachers must ask and answer by describing the goals, content, and execution of the course.

This article describes hows, whens, and whys of the program, focusing on how our faculty, over a period of many years, created and revised the curriculum for the Pedagogy course. It also describes the choices we made as we …

Statutory Genres: Substance, Procedure, Jurisdiction, Karen Petroski

All Faculty Scholarship

To decide many cases, courts need to characterize some of the legal rules involved, placing each one in a specific doctrinal category to identify the rule’s effect on the litigation. The consequences of characterization decisions can be profound, but the grounds for making and justifying them are often left unstated. This Article offers the first systematic comparison of two important types of legal characterization: the distinction between substantive and procedural rules or statutes, a distinction federal courts make in several contexts; and the distinction between jurisdictional and nonjurisdictional rules, especially those relating to litigation filing requirements. The Article explains the …

The Unfortunate Triumph Of Form Over Substance In Canadian Administrative Law, Paul Daly Oct 2012

The Unfortunate Triumph Of Form Over Substance In Canadian Administrative Law, Paul Daly

Osgoode Hall Law Journal

The standard of review analysis for judicial review of administrative action developed by the Supreme Court of Canada before Dunsmuir v New Brunswick had two important features. First, it provided a bulwark against interventionist judges, thereby protecting the autonomy of administrative decision makers and promoting deference. Second, it was substantive, rather than formal, and moved the focus of judicial review away from abstract concepts and towards the eccentricities of statutory schemes. However, in its more recent forays into the general principles of judicial review, the Court has threatened to reverse its deferential and substantive course by following a formalistic, categorical …

Evaluating Federally Appointed Judges In Canada: Analyzing The Controversy, Troy Riddell, Lori Hausegger, Matthew Hennigar Oct 2012

Evaluating Federally Appointed Judges In Canada: Analyzing The Controversy, Troy Riddell, Lori Hausegger, Matthew Hennigar

Osgoode Hall Law Journal

This commentary describes our experiences in trying to undertake a judicial performance evaluation of federally appointed judges in Canada. Some respondents were enthusiastic about the project, but others were strongly opposed to it and worried about the effects that our survey would have on judicial independence. After describing the feedback that we received and the fallout from our project, we examine the relationship between judicial performance evaluation and judicial independence. We argue that a well-conceived judicial performance evaluation does not violate judicial independence. We then explore the resistance to judicial performance evaluation in Canada, using a comparative lens. The explanation …

A New Lens: Reframing The Conversation About The Use Of Video Conferencing In Civil Trials In Ontario, Amy Salyzyn Oct 2012

A New Lens: Reframing The Conversation About The Use Of Video Conferencing In Civil Trials In Ontario, Amy Salyzyn

Osgoode Hall Law Journal

The state of courtroom technology in Ontario is increasingly capturing the attention of both the public and the legal profession. This article seeks to contribute to the conversation on this issue by focusing on one particular technology in Ontario’s courtrooms: the use of video conferencing to receive witness testimony in civil trials. The central claim is that the approach to video conferencing that dominates the policy discourse reflects an overly narrow, instrumentalist view of technology that fails to adequately take account of possible broader political and social implications as well as this technology’s transformative potential. This argument is developed by …

Book Review: Slow Violence And The Environmentalism Of The Poor, By Rob Nixon, Dayna Nadine Scott Oct 2012

Book Review: Slow Violence And The Environmentalism Of The Poor, By Rob Nixon, Dayna Nadine Scott

Osgoode Hall Law Journal

IN SEEKING TO UNDERSTAND the relationships of the local to the global in contemporary environmental justice struggles, we have yearned for a way to trace the “occluded relationships” between transnational economic actors and the things that tie them to particular places, such as labour, land, resources, and commodity dynamics. The bodies caught in the middle have been ‘raced’ and erased, made invisible, and wiped away. With gripping urgency, Rob Nixon’s book Slow Violence and the Environmentalism of the Poor brings those bodies back into view by exposing the violence perpetrated against them across time and space.

Hyperspectral Imaging For Non-Contact Analysis Of Forensic Traces, Patrick J. Cullen, G. Edelman, T. Van Leeuwen, M. Aalders, E. Gaston

Articles

Hyperspectral imaging (HSI) integrates conventional imaging and spectroscopy, to obtain both spatial and spectral information from a specimen. This technique enables investigators to analyze the chemical composition of traces and simultaneously visualize their spatial distribution. HSI offers significant potential for the detection, visualization, identification and age estimation of forensic traces. The rapid, non-destructive and non-contact features of HSI mark its suitability as an analytical tool for forensic science. This paper provides an overview of the principles, instrumentation and analytical techniques involved in hyperspectral imaging. We describe recent advances in HSI technology motivating forensic science applications, e.g. the development of portable …

Cenotes As Conceptual Boundary Markers At The Ancient Maya Site Of T’Isil, Quintana Roo, México, Scott L. Fedick, Jennifer P. Mathews, K. Sorensen

Sociology & Anthropology Faculty Research

Ancient Maya communities, from small village sites to urban centers, have long posed problems to archaeologists in attempting to define the boundaries or limits of settlement. These ancient communities tend to be relatively dispersed, with settlement densities dropping toward the periphery, but lacking any clear boundary. At a limited number of sites, the Maya constructed walled enclosures or earthworks, which scholars have generally interpreted as defensive projects, often hastily built to protect the central districts of larger administrative centers during times of warfare (e.g., Demarest et al. 1997; Inomata 1997; Kurjack and Andrews 1976; Puleston and Callender 1967; Webster 2000; …

Dark Current Modeling With A Moving Depletion Edge, Justin Charles Dunlap, Morley M. Blouke, Erik Bodegom, Ralf Widenhorn

Physics Faculty Publications and Presentations

Within a pixel in a digital imager, generally either a chargecoupled device or complementary metal oxide semiconductor device, doping of the semiconductor substrate and application of gate voltages create a region free of mobile carriers called the depletion region. This region fills with charge after incoming photons or thermal energy raise the charges from the valence to the conduction energy band. As the signal charge fills the depletion region, the electric field generating the region is altered, and the size of the region is reduced. We present a model that describes how this dynamic depletion region, along with the location …

American contract law is supposed to facilitate the efficiency and fairness of market transactions between parties. Does the increasing success of the puffery defense in false advertising and securities cases further the fairness of transactions between companies with major advertising budgets and consumers? This Article contends that it does not.

Probing The Role Of Asn 152 In The Class C Β-Lactamase Ampc, Brianne Docter, Mujahid Anwar, David Leonard, Rachel Powers, Bradley Wallar

Student Summer Scholars Manuscripts

AmpC, a class C β-lactamase, is a main cause of antibiotic resistance to cephalosporins in many species of bacteria. The current proposed mechanism of action involves an acyl-intermediate, where the enzyme becomes covalently attached to the drug at serine-64, before an activated water hydrolyzes the bond and regenerates the enzyme. Although this mechanism is generally accepted, the exact roles that the other active site residues play in recognition and breakdown of the substrate are not fully understood. Here, we investigate the role of the active site residue asparagine-152 (Asn152) in E. coli AmpC by mutating it to a glycine, serine, …

Law Student Publications

Part I of this paper will provide a general framework for understanding human trafficking in the United States by laying out basic statistics relevant to human trafficking, describing the basic economic model under which the business of human trafficking should be understood, and discussing the major legislative approaches the United States has taken to curtail the increase in human trafficking in the country in the past ten years. Part II will then analyze the shortcomings of this approach and the successes of unique efforts to combat trafficking in Sweden. Part III recommends an approach the United States should take moving …
