Software licensing options for large enterprises are evolving almost as quickly as the mission-critical software solutions those companies deploy. In the past, most software licensing metrics were based on the software installation itself. Increasingly, software publishers are offer- ing more licensing options and flexibility to meet their customers' software needs; however, that increased flexibility often results in complex software asset management ("SAM") risks and obligations. Licensing models that once would have required custom agreements with unique protocols, if technologically feasible in the first place, now are offered alongside the "traditional" licenses in increasingly dense menus of choices for IT teams …

It is not difficult to imagine a case where a long time salesperson leaves her former employer and begins work with a new employer. When the salesperson began employment with her former employer, the former employer required the salesperson to sign an employment agreement. This agreement contained a covenant not to compete that stated that the salesperson would not compete with the former employer after he resigned. It also provided that she would not use the former employer's confidential information. But the agreement did not provide any express promise that the former employer would ever give the salesperson any confidential …

Ultimately, this Article strives to advance discussion of values and rights and thereby give greater freedom to the individual in decisions relating to life and liberty. This Article argues that the value of life is best expressed when the concept of value is given a subjective rather than objective meaning. In other words, the individual himself should determine the value of his life. A third party should not force upon that individual a determination with no understanding of an individual's private end-of-life choices. Where the book is lacking is in not connecting Annapolis’ history to larger national and global issues.

Journal of Metals, Materials and Minerals

Two series of natural rubber/carboxylated styrene butadiene rubber (NR/XSBR) (80/20) nanocomposites containing different loadings of carbon black (CB) (3-9 phr) and carbon nanotube (CNT) (0.1-0.4 phr) have been prepared by a latex stage compounding method. Before mixing with NR/XSBR blended latex, CB and CNT were dispersed and stabilized in water by ball milling with the aid of surfactant. The obtained compounded latex was cast into sheet on a glass mold and thereafter cured in an oven at 80°C for 3 h. A new cynipid species, Saphonecrus hupingshanensis Liu, Yang, et Zhu, sp. nov. (Hymenoptera: Cynipidae: Synergini), is described from China. This is the first species of the inquilinous tribe Synergini ever known to have an association with chinquapins (Fagaceae: Castanopsis). The biology and implication to species diversity of Cynipidae in eastern and southeast Asia are discussed.

The article discusses teaching law school courses with the Public Access to Court Electronic Records (PACER) system and both student and instructor e-writing projects relating to that system.

The case method of instruction in its classic form does not capture the context and intricacies of bankruptcy practice, especially in United States Chapter 11 cases. What is often missing is the rich compilation of detail found in the mountain of filings that is a Chapter 11 case, whether large or small. These details often evidence the shifting loyalties, relationships, interests, and emotions of the participants. These dynamics are largely lost in …

Insider trading has been in the news on a relatively constant basis in the new millennium. Raj Rajaratnam and associates, Mark Cuban, and Martha Stewart have been among the many subjects of legal actions involving insider trading since the Enron debacle in 2002. Some of these cases have been garden-variety insider trading cases; others have exposed confusing and evolving elements of U.S. insider trading doctrine. Most recently, the STOCK Act — a law providing for an express congressional prohibition on insider trading — has made headlines.
