The purpose of this research was to find if leadership skills are developed from co-curricular involvement. Research would determine whether natural-born leaders were drawn to student involvement opportunities, or whether involvement develops the average students’ leadership skills. To arrive at a conclusion, research asked the question “Does involvement on a college campus develop leadership skills?” Research was answered by quantitative research. Fifty undergraduate students from a private Midwestern university were surveyed. Each participant was given two assessments. One was a leadership self-assessment and another was a campus involvement assessment. The campus involvement assessment was created for the purpose of this …

Context: Research is a vital component of a college of osteopathic medicine (COM) portfolio. Previous studies have described research activity at COMs from 1989 through 2004 using data from surveys of COM administrators conducted by the American Association of Colleges of Osteopathic Medicine (AACOM). However, these studies had limitations.

This essay uses the recent controversy over President Obama's mandate that insurance companies provide generous birth control coverage to explore larger issues about the optimal locus of health care decision making. Mandates may be justified in some instances, but they sacrifice choice and local variation and perhaps lead to worse social outcomes. The key question for policy makers is whether market processes or rule by expert is more likely to strike the right balance of choice and mandate. The Law Of Ponzi Payouts, Spencer A. Winters

When a Ponzi scheme collapses, there will typically be net winners and net losers. The bankruptcy trustee will often seek to force the net winners - those who received more money back from the Ponzi scheme than they invested - to disgorge their profits. Courts diverge on whether they should compel disgorgement in this instance. This Note argues that under prevailing fraudulent transfer law, net winners in a Ponzi scheme need not disgorge their profits. This is because the investor's dollar-for-dollar discharge of a preexisting debt constitutes the transfer of value in exchange for the payout. There are two exceptions …

American contract law is supposed to facilitate the efficiency and fairness of market transactions between parties.  Does the increasing success of the puffery defense in false advertising and securities cases further the fairness of transactions between companies with major advertising budgets and consumers?  This Article contends that it does not.

In this Article, John Teeter reexamines his life as a law teacher and engages in uncommonly pungent self-criticism that he hopes will prove insightful for other professors and those pondering a career in academics.  By reassessing critical decisions he made as a student, a lawyer, and a teacher, Teeter reveals how he repeatedly undermined both his interpersonal aspirations and professional potential.  Such failures have given rise to their own solace and peculiar wisdom, however, and Teeter also explicates the joy he derives from teaching and offers ideas on how others can enhance their fulfillment and success in the academy.

Despite the need to strike a proper balance between effective § 1983 suits to deter government misconduct and corresponding, robust defenses to deter frivolous suits, courts across the nation cannot agree on the fundamental questions of what the proper defenses to § 1983 actions are or how to allocate the burdens of proof in such litigation.  This Article would remedy this situation, proposing an approach that offers both a single defense to § 1983 claims and a uniform allocation of the burdens of proof when that defense is raised.

State courts have wrestled with the single subject rule for over a century and a half.  A workable legal standard for this rule has been elusive, however.  A recent Illinois case addressing a controversial piece of legislation illustrates just how evasive the application of this rule can be.  In Wirtz v. Quinn, the Illinois Supreme Court upheld a state “stimulus” package, which addressed topics ranging from candy taxes to video gaming in its nearly three hundred pages, because it felt that the bill fell under the subject of “capital projects.”  In addition to introducing a new “smoking gun” requirement, …

Kids Growing with Grains is a school-based agricultural education program that improves youths’ conceptual understanding of how agriculture is linked to nutrition, the environment, and human health. University of Maryland Extension Educators developed the program’s hands-on activities, which focus on grain science, grains and the environment, grains and animals, and grain nutrition. The program is traditionally implemented through a station-based field trip experience lasting 4 hours in length. Pain is an expected reaction from tissue injury in the postoperative setting, yet it is commonly inadequately managed. The literature has exposed some clear-cut guidelines to manage acute pain, and the consequences poorly managed pain. Pain management is expected to be individualized, timely, safe, evidence based and multi modal. An extensive literature review of the cement research of multimodal pain management was conducted. Specifically, the use of opiates along with at least one non-opioid (Tylenol, NSA1Ds, gabapentin and pregabalin). Successful pregnancy outcomes have been reported in all solid-organ transplant recipients on a variety of immunosuppressive medication regimes. In October 2007, the FDA pregnancy category of mycophenolic acid products (MPA) was changed from category C to D, based on registry and post-marketing data which revealed a higher incidence of spontaneous abortions and structural birth defects. The purpose of this abstract is to describe pregnancy outcomes with exposure to MPA and pregnancies fathered by male transplant recipients conceived while taking MPA. Can tribes exert criminal jurisdiction over non- Indians who consent, by whatever means, to adhere to tribal laws? Has federal Indian law, and tribes’ reaction to it, changed the universe of tribal jurisdiction so significantly that non-Indians can truly never be subject to tribal criminal law? This article explores the concept of consent as a still viable theory of tribal criminal jurisdiction. I first examine some historical examples of non-Indian consent through adoption or naturalization under tribal law, and reactions to such consent by federal officials.
