One Day, It'll Pay Off, Valeria Pereira Oct 2012

One Day, It'll Pay Off, Valeria Pereira

First To Go Program

Change has an unsettling power that can scare most individuals. For those who commute between different environments on a daily basis, change may ranges from “seeing a pregnant mother pushing a stroller with a five year old by her side, [to seeing] a white lady jogging, with a white, well-groomed poodle by her side.” Change means difference, and for author Valeria Pereira, change comes in the form of different socio-economic environments. Between attending an expensive private school and living in Lennox, CA, Pereira learned the significance of dissimilarity. It was that experience, however, that aided her in overcoming her educational …

Technologies-That-Must-Not-Be-Named: Understanding And Implementing Advanced Search Technologies In E-Discovery, Jacob Tingen Oct 2012

Technologies-That-Must-Not-Be-Named: Understanding And Implementing Advanced Search Technologies In E-Discovery, Jacob Tingen

Law Student Publications

Even for those who are aware of the existence of advanced search and review tactics beyond keyword search, many questions remain for attorneys and judges alike. First, what are the new and emerging technologies? While courts and commentators mention the existence of the technologies, there is not much guidance with regard to what the new technologies are and what they accomplish. Second, are the new technologies superior to the manual review process? Understandably, attorneys are hesitant to use an unfamiliar e-discovery product that may not work better than the e-discovery process to which they are already accustomed. Third, if attorneys …

Dispatch From The Culture War: Virginia's Failed Hpv Vaccination Mandate, Rachel Reynolds

Law Student Publications

Part I will describe the specifics of the HPV vaccine: how it works and how Virginia decided to promote its usage. Part II will examine the ways in which jurisdictions have traditionally understood vaccination policy, and contrast it with the ways in which they have handled the HPV vaccine. Part III will examine the disadvantages of continuing the mandate’s ineffective political war of attrition, and suggest a coalition-building strategy to effect policy that honors communal values and meaningfully increases access to the …

Organized Crime Outlaws: An Evaluation Of Criminal Organization Legislation In Canada, Carol Fleischhaker Oct 2012

Organized Crime Outlaws: An Evaluation Of Criminal Organization Legislation In Canada, Carol Fleischhaker

PhD Dissertations

This thesis explains how some organized crime outlaws, such as anti-Prohibitionists, the North American Mafia or La Cosa Nostra, outlaw motorcycle gangs, and Aboriginal street gangs, come to exist and thrive in Canadian society. It sets forth the historical development and nature of criminal organization laws in Canada, and compares the definition of “criminal organization” in the Criminal Code with other criminal law concepts, such as corporate criminals and white-collar criminals; conventional criminality or garden-variety predatory crime; terrorists; and criminal conspirators, parties, and accessories. It uses various concepts and assertions within criminological, sociological and psychological theories to explain the formation …

The Tortoise And The Hare: A New Moral For An Old Fable, Jaret Kanarek Oct 2012

The Tortoise And The Hare: A New Moral For An Old Fable, Jaret Kanarek

The Intellectual Standard

Aesop's The Tortoise and the Hare is a prominent moral fable in American cultural discourse. Having originated in ancient Greece, the fable has varied over the years, but the basic elements remain the same. The story, as it is generally told, involves a tortoise and a hare as its two main protagonists. The hare is arrogant; he continually boasts about his speed and picks on the tortoise for being slow. The tortoise grows tired of the hare's boasting and questions the hare's claim of being the fastest creature. In retort, the hare decides to challenge the tortoise to a race …

The Issue Of Internet Polling, Nick A. Nichols Oct 2012

The Issue Of Internet Polling, Nick A. Nichols

The Intellectual Standard

Surveys, polls, and focus groups are common phenomena in our daily lives. We live in a world where big data is big business. Large decisions hinge on the accuracy and predicative power of these numbers. Therefore, it should not be surprising that there is a market for the malicious manipu-1ation of data. Extreme care must be taken in the collection, checking, and processing of data to prevent decisions from being made on incorrect assumptions. In order to demonstrate the full potential and possible impact of these attacks, I shall provide the following example: John Doe is a member of the …

Faulty Phrases: "There Is No Such Thing As Perfection", Michael Christison Oct 2012

Faulty Phrases: "There Is No Such Thing As Perfection", Michael Christison

The Intellectual Standard

In regard to this saying, one of the most notable references can be found in the movie Tron: Legacy. Although not a direct quote, the character Kevin Flynn, played by Jeff Bridges, communicates a very similar message to the public: "The thing about perfection is that it's unknowable. It's impossible, but it's also right in front of us all the time:' This stance from Flynn, or rather the scriptwriters, epitomizes the commonplace idea that I wish to critically examine.

Faulty Phrases: "There Are No Absolutes" & "The Truth Is Relative", Jaret Kanarek Oct 2012

Faulty Phrases: "There Are No Absolutes" & "The Truth Is Relative", Jaret Kanarek

The Intellectual Standard

"There are no absolutes:' "The truth is relative:' Each phrase implies and necessitates the truth of the other. An absolute is something that is universally true, that is, its truth is independent of all other factors or contexts (New Oxford American Dictionary). To say, "there are no absolutes:' is to say that there are no independent universal truths. All truths are therefore dependent. "The truth is relative" makes exactly this claim. Philosophically speaking, that which is relative "is dependent on something else" (New Oxford American Dictionary). But the concepts of relativity and dependence do not exist in a vacuum. For …

A Day At Filastrocca Preschool, Pistoia, Italy: Meaning Making Through Literacy And Creative Experience, Keely D. Cline, Carolyn Pope Edwards, Algo Giacomelli, Lella Gandini, Donatella Giovannini, Annalia Galardini

Department of Child, Youth, and Family Studies: Faculty Publications

In this article,1 we explore how the library teacher of an Italian preschool with a special mission focused on books, stories, and the imagination uses group literacy activities as a context for encouraging shared meaning making through creative experiences. We take readers inside one day at the Italian Preschool, Filastrocca, providing detailed descriptions and analysis of interactions and activities. We suggest that elaborate extended dialogue among children and the teacher, promotion of empathy through opportunities to take others’ perspectives (including book characters’), and group engagement in shared and multi-faceted creativity are important characteristics related to meaning making in the context …

Angry Judges, Terry A. Maroney Oct 2012

Angry Judges, Terry A. Maroney

Vanderbilt Law School Faculty Publications

Judges get angry. Law, however, is of two minds as to whether they should; more importantly, it is of two minds as to whether judges’ anger should influence their behavior and decision making. On the one hand, anger is the quintessentially judicial emotion. It involves appraisal of wrongdoing, attribution of blame, and assignment of punishment — precisely what we ask of judges. On the other, anger is associated with aggression, impulsivity, and irrationality. Aristotle, through his concept of virtue, proposed reconciling this conflict by asking whether a person is angry at the right people, for the right reasons, and in …
