The Continuum Of International Maritime Law And Canadian Maritime Law: Explaining A Complex Relationship, Aldo Chircop, Sarah Shiels

Dalhousie Law Journal

This article discusses the relationship between international maritime law and Canadian maritime law from legislative and judicial perspectives. It explains the relationship through Canada's implementation of international maritime conventions and a study of Canadian case law The article concludes that the relationship has a well-developed pattern based on legislative structures and judicial processes. With strong historical roots and traditions, the relationship is motivated by international comity and has firm grounding in international and domestic public policyin support ofinternational uniformity to facilitate international commerce. The European Union is not generally perceived as an Arctic power However, the ever-expanding list of EU competences implies that it will have both an interest in participating in the governance of the Arctic and the authority to do so, should the seven Arctic states agree to make room. This development holds both challenges and opportunities for Canada and other Arctic states. The challenges stem from the factthat the EU will seek topromote the economic interests ofits Member States in resource extraction and freedom of navigation where Canada and Russia, in particular, have asserted strong national policies. The Tabling Of International Treaties Inthe Parliament Of Canada: The First Four Years, Ted L. Mcdorman

In January 2008, the government ofCanada announced the adoption of the policy that international treaties would be tabled in the House of Commons following their signature or adoption and prior to Canada formally notifying its intention to be bound by the treaty. This article provides an overview of the Tabling Policy, the domestic legal structure of treaty-making in Canada, a description of the international instruments that have been tabled under the Policy from 2008 to 2011, and a review of the one treaty that has been discussed at length in the House of Commons.

African states have, since the colonial encounter, been part of the international regimes on intellectual property rights. Formal accession to various treaties and conventions on intellectual property rights instruments should not be mistaken for actual internalization of the policies, structures and norms required for reaping the promised benefits of participation in such regimes. There is ample evidence showing that most African states do not have the requisite structures for fruitful engagement with international intellectual property rights regimes. Beyond The Core: Incorporating Transnational Crimes Into The Rome Statute, Regina Menachery Paulose

Cardozo Journal of International and Comparative Law

The article argues that the International Criminal Court (ICC) should expand its jurisdiction to include transnational organized crime, such as drug trafficking, counterfeiting, and arms trade, to address the growing global threat posed by these crimes. While the Rome Statute currently excludes such crimes, the ICC’s role as a court of last resort and its independence make it an ideal institution to prosecute transnational organized crime, fostering international cooperation and enhancing deterrence. The article advocates for a unified definition of transnational organized crime and the inclusion of select crimes from the United Nations Convention against Transnational Organized Crime (CATOC) and …

Haute Copyright: Tailoring Copyright Protection To High-Profile Fashion Designs, Alexandra Manfredi

Cardozo Journal of International and Comparative Law

The note argues that high-profile haute couture fashion designs, particularly those worn by celebrities at significant events, deserve copyright protection due to their artistic and economic value. It proposes modifying U.S. copyright law to protect these designs, balancing the need to safeguard designers' investments while avoiding stifling innovation or competition. The analysis suggests that such protection could be achieved through a narrowly tailored provision with specific requirements, such as mandatory registration and a short protection term, modeled after successful European frameworks.

Home Games: Legal Issues Concerning The Displacement Of Property Owners At The Site Of Olympic Venues, Jessica Blumert

Cardozo Journal of International and Comparative Law

The Olympics, as the world's largest mega event, often lead to human rights violations, particularly regarding the right to adequate housing, as host cities displace residents and businesses. The International Olympic Committee (IOC) has the unique ability to address these issues by incorporating binding human rights protections into its contracts with host countries, yet it has failed to enforce such standards effectively. The article argues that the IOC should amend its Charter to include specific housing rights criteria, drawing on international law and precedents from the European Court of Human Rights (ECtHR), to ensure compliance and protect vulnerable populations.

Turning Counseling Students Into Researchers: Enhancing Quantitative Research Courses With An Experiential Learning Activity, Mark C. Rehfuss, Dixie D. Meyer

Counseling & Human Services Faculty Publications

Research methods and application are crucial aspects of most counseling practitioners and scholars’ lives, yet practical experience with development and implementation of research projects is usually limited to doctoral level dissertations. This article describes an experiential research project that has been integrated into counseling research methods courses at both the master’s level and the doctoral level. In this mentored research activity, students move through the entire research process in one semester. They begin with a notion and finish with a submission for publication. Based on student responses, implementing this process in a research methodology course is recommended.

Les risques pour la santé et la sécurité des travailleurs exposés à l’inhalation de nanoparticules (NP) soulèvent de plus en plus d’inquiétudes. Parmi les sources d’émission de nanoparticules en milieu de travail figurent les effluents et les émanations de divers procédés, tels l’ablation et le fraisage laser. Les nanoparticules ont des propriétés potentiellement toxiques, à savoir une surface totale, une concentration en nombre et une réactivité surfacique élevées. Il a été démontré que l’inhalation – la voie d’exposition la plus courante aux nanoparticules – a des effets nocifs sur les fonctions pulmonaires, et que les particules déposées dans les poumons …
