ในช่วงของการเปลี่ยนผ่านจากการใช้วิธีพิจารณาความแบบโบราณตามกฎหมายตราสามดวงมาสู่การจัดทำประมวลกฎหมายวิธีพิจารณาความแพ่ง สยามในยุคปฏิรูประบบกฎหมายได้ใช้วิธีการตรากฎหมายวิธีพิจารณาความใช้ไปพลางก่อนในการชำระคดีแพ่ง เช่น พระราชบัญญัติลักษณะพยาน ร.ศ. 113 และ พระราชบัญญัติกระบวนพิจารณาความแพ่ง ร.ศ. 115 จากการศึกษาพบว่ากฎหมายวิธีพิจารณาความดังกล่าวได้รับอิทธิพลอย่างมากจากกฎหมายวิธีพิจารณาความของอังกฤษ ทั้งนี้ เนื่องจากปัจจัยหลายประการ เช่น สนธิสัญญาเบาว์ริงและการเกิดขึ้นของศาลกงสุลอังกฤษ อิทธิพลของกฎหมายอังกฤษต่อนักกฎหมายชาวไทยผ่านระบบการศึกษา ตลอดจนอิทธิพลของประเทศอังกฤษเหนือดินแดนบางส่วนของสยาม แนวคิดวิธีพิจารณาความตามแบบกฎหมายอังกฤษจึงได้รับการส่งต่อเรื่อยมาในกฎหมายวิธีพิจารณาความแพ่งของไทยตั้งแต่ในอดีตจนกระทั่งในประมวลกฎหมายวิธีพิจารณาความแพ่งฉบับปัจจุบัน บทความนี้มีวัตถุประสงค์ในการศึกษาความเป็นมาเชิงประวัติศาสตร์ของกฎหมายวิธีพิจารณาความแพ่งของไทยตั้งแต่วิธีพิจารณาความแบบโบราณตามกฎหมายตราสามดวงจนถึงการจัดทำประมวลกฎหมายวิธีพิจารณาความแพ่ง เพื่อชี้ให้เห็นถึงอิทธิพลของกฎหมายอังกฤษที่มีต่อกฎหมายวิธีพิจารณาความแพ่งของไทย

บทความนี้ศึกษาวิวัฒนาการของความรับผิดทางอาญาของนิติบุคคลในประเทศฝรั่งเศสผ่านแนวคิด personnes morales ซึ่งบัญญัติไว้ในมาตรา 121-2 แห่งประมวลกฎหมายอาญาฝรั่งเศส โดยศึกษาแนวคิดนี้ภายใต้กรอบของความรับผิดของนิติบุคคลต่ออาชญากรรมร้ายแรง โดยเฉพาะอย่างยิ่งในบริบทของกฎหมายอาญาระหว่างประเทศ ซึ่งโดยหลักแล้วกำหนดความรับผิดแก่บุคคลธรรมดาเท่านั้น คำถามวิจัยหลักของการศึกษานี้คือ แนวคิด personnes morales ของฝรั่งเศสช่วยอุดช่องว่างของความรับผิดทางอาญาในกรณีที่นิติบุคคลได้เข้ามามีส่วนร่วมในการกระทำความผิดอาญาร้ายแรงตามธรรมนูญกรุงโรมได้หรือไม่ และแนวคิดนี้สามารถนำมาใช้กับความรับผิดทางอาญาระหว่างประเทศได้เพียงใด บทความได้วิเคราะห์คดีสำคัญ เช่น คดีอื้อฉาวทางเภสัชกรรม Mediator คดี Lafarge S.A. ในซีเรีย และคำพิพากษา Association Sportive ซึ่งตัดสินโดยศาลอาญาของฝรั่งเศส โดยที่ศาลได้วางหลักเกี่ยวกับเจตนาของนิติบุคคล (corporate mens rea) ผสมผสานกับความรับผิดโดยอาศัยการเป็นตัวแทนและความรับผิดโดยอิสระขององค์กร รวมถึงวิธีที่ศาลฝรั่งเศสบังคับใช้บทลงโทษกับนิติบุคคลได้อย่างมีประสิทธิภาพ นอกจากนี้ ยังมีการอ้างอิงเปรียบเทียบกับสหราชอาณาจักรและสวีเดนเพื่อแสดงให้เห็นแนวทางทางเลือกอื่น ๆ และเน้นย้ำว่าระบบฝรั่งเศสมีส่วนช่วยในการพัฒนาแนวคิดความรับผิดทางอาญาของนิติบุคคลอย่างไร ท้ายที่สุด บทความนี้ชี้ให้เห็นว่าหลักคำสอนของ personnes morales ไม่เพียงแต่เป็นกรอบแนวคิดเชิงปฏิบัติเท่านั้น แต่ยังเป็นแนวทางเชิงทฤษฎีที่สามารถแก้ไขปัญหาช่องว่างของความรับผิดในกฎหมายอาญาระหว่างประเทศได้และเสนอข้อคิดสำคัญสำหรับการปฏิรูปในอนาคตเพื่อเสริมสร้างความรับผิดชอบของภาคธุรกิจในระดับข้ามเขตอำนาจศาล

บทความวิจัยนี้มุ่งศึกษาความสัมพันธ์ระหว่างหลักกฎหมายว่าด้วยหนี้ตามประมวลกฎหมายแพ่งและพาณิชย์ กับหลักเกณฑ์การเสนอคดีตามประมวลกฎหมายวิธีพิจารณาความแพ่ง อันเป็นกลไกสำคัญในการบังคับใช้สิทธิของเจ้าหนี้ในทางปฏิบัติ เนื่องจาก “หนี้” เป็นบุคคลสิทธิ เจ้าหนี้จึงไม่อาจบังคับชำระหนี้ได้ด้วยตนเอง แต่ต้องเสนอคดีต่อศาลเพื่อบังคับให้ชำระหนี้ การวิจัยนี้เป็นการวิจัยเชิงหลักกฎหมาย (Doctrinal Legal Research) โดยวิเคราะห์ประเด็นสำคัญเกี่ยวกับหนี้ 7 ประการ ได้แก่ การบอกกล่าวลูกหนี้กับอำนาจฟ้อง การบังคับชำระหนี้ การเรียกดอกเบี้ยกรณีลูกหนี้ผิดนัด การใช้สิทธิเรียกร้องของลูกหนี้ การโอนสิทธิเรียกร้อง การเพิกถอนการฉ้อฉล และอายุความบังคับจำนอง ทั้งนี้ ผู้วิจัยได้จำแนกบทบัญญัติว่าด้วยหนี้ออกเป็น 3 ประเภท ได้แก่ (1) บทบัญญัติที่มีเนื้อหาไม่ครอบคลุมเกี่ยวกับการเสนอคดี (2) บทบัญญัติที่กำหนดวิธีไว้แต่ไม่ครบถ้วนหรือมีปัญหาในการตีความ และ (3) บทบัญญัติที่ไม่สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง แล้วนำมาวิเคราะห์เชื่อมโยงกับบทบัญญัติในประมวลกฎหมายวิธีพิจารณาความแพ่ง รวมถึงศึกษาจากตำราและแนวคำพิพากษาศาลฎีกา ผลการศึกษาพบว่า การบังคับใช้กฎหมายว่าด้วยหนี้ให้มีประสิทธิภาพ จำเป็นต้องตีความและบังคับใช้สอดคล้องกับกฎหมายวิธีพิจารณาความแพ่ง ซึ่งผลลัพธ์ของงานวิจัยนี้จะช่วยลดปัญหาทางปฏิบัติและเสริมสร้างความเข้าใจที่ถูกต้องแก่ผู้ศึกษากฎหมายและผู้ปฏิบัติงานในคดีแพ่ง

คำชี้ขาดที่เกิดจากกระบวนการอนุญาโตตุลาการระหว่างประเทศมักจะลงท้ายด้วยส่วนที่เป็นประกาศิต 2 ส่วน ส่วนแรกเป็นคำชี้ขาดที่ว่าด้วยจำนวนค่าเสียหาย ค่าสินไหมทดแทนที่ฝ่ายแพ้คดีจะต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดีหรือปฏิบัติการชำระหนี้รูปแบบอื่นให้แก่ฝ่ายที่ชนะคดี รวมเรียกว่าเป็นคำชี้ขาดในเนื้อความแห่งคดี ส่วนที่สองเป็นคำชี้ขาดในเรื่องค่าใช้จ่ายซึ่งมักกำหนดจำนวนค่าใช้จ่ายในการอนุญาโตตุลาการที่ฝ่ายแพ้คดีต้องชำระหรือใช้คืนให้แก่ฝ่ายชนะคดี เรียกว่าคำชี้ขาดในส่วนค่าใช้จ่าย ค่าใช้จ่ายในการอนุญาโตตุลาการมีจำนวนสูงขึ้นอย่างสม่ำเสมอ แม้ว่าเทคโนโลยีจะได้รับการพัฒนาให้ก้าวหน้าอย่างต่อเนื่องและมีการนำเอาเทคโนโลยีมาใช้ในกระบวนการอนุญาโตตุลาการอย่างกว้างขวางก็ตาม คู่พิพาทฝ่ายที่แพ้คดีอนุญาโตตุลาการระหว่างประเทศนอกจากต้องแบกรับภาระค่าใช้จ่ายของตนแล้วยังจะถูกบังคับโดยคำชี้ขาดให้เข้ารับภาระหรือชดใช้ค่าใช้จ่ายของฝ่ายที่ชนะคดีด้วย ทั้งนี้เป็นไปตามหลักเกณฑ์ที่ว่า “Costs follow the event” หรือ “ผู้แพ้เป็นผู้รับผิดชอบค่าใช้จ่าย” ที่ถือปฏิบัติกันอยู่ในวงการอนุญาโตตุลาการระหว่างประเทศ หลักเกณฑ์นี้กำเนิดขึ้นในประเทศอังกฤษ ต่อมาถูกนำไปใช้กันอย่างแพร่หลายทั่วโลกทั้งในประเทศคอมมอนลอว์และประเทศซิวิลลอว์ คู่พิพาทที่หวั่นวิตกว่าจะต้องรับภาระค่าใช้จ่ายที่สูงลิ่วหากตนตกเป็นฝ่ายแพ้คดี สามารถนำเอาวิธีการยื่นคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทมาใช้เป็นเครื่องมือจำกัดหรือลดค่าใช้จ่ายดังกล่าว หลักปฏิบัติในเรื่องการทำคำเสนอปิดผนึกเพื่อประนอมข้อพิพาทถือเป็นเรื่องใหม่สำหรับประเทศไทย ผู้เขียนมีความประสงค์ที่จะนำเสนอหลักกฎหมายและประเพณีปฏิบัติในเรื่องดังกล่าวที่แพร่หลายอยู่ในสถาบันอนุญาโตตุลาการหลักของโลกให้ผู้ประกอบธุรกิจและนักกฎหมายไทยได้รับทราบและนำไปใช้ให้เป็นประโยชน์หากต้องเข้าไปเกี่ยวพันกับการอนุญาโตตุลาการระหว่างประเทศ

บทความวิจัยนี้มุ่งศึกษาถึงแนวคิดและหลักความรับผิดเพื่อละเมิด โดยเฉพาะความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นอันเกิดจากข้อสันนิษฐานความรับผิดตามกฎหมายภายใต้แนวคิดที่ว่าบุคคลนั้นอาจมีส่วนผิดอยู่ด้วยในการที่เกิดความเสียหายแก่บุคคลอื่น หรือมีความบกพร่องในการควบคุมดูแลจึงเกิดความเสียหายขึ้น การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยเน้นการวิจัยเอกสารโดยศึกษาค้นคว้าจากหนังสือ งานวิจัย วิทยานิพนธ์ ตลอดจนบทบัญญัติกฎหมายที่เกี่ยวข้องกับความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นทั้งภาษาไทยและภาษาต่างประเทศ โดยนำข้อมูลต่าง ๆ มาศึกษาและวิเคราะห์เพื่อนำมาพัฒนากฎหมายความรับผิดเพื่อละเมิด จากการศึกษาพบว่ากฎหมายได้กำหนดความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นเอาไว้หลายกรณีโดยพิจารณาจากความสัมพันธ์ตามกฎหมาย ตามสัญญา ตามหน้าที่ในฐานะพิเศษ เช่น ความรับผิดของนายจ้างลูกจ้าง ความรับผิดของตัวการตัวแทน ความรับผิดของบิดามารดา ความรับผิดของครูบาอาจารย์ แต่ไม่พบกรณีความรับผิดของคู่สมรส ซึ่งคู่สมรสนั้นถือว่าเป็นบุคคลที่มีนิติสัมพันธ์ระหว่างกันตามกฎหมายอันก่อให้เกิดสิทธิ หน้าที่ และความรับผิด ด้วยเหตุนี้ จึงสมควรแก้ไขปรับปรุงกฎหมายโดยเฉพาะในเรื่องความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นของคู่สมรสเพื่อให้พัฒนาและสอดคล้องกับสภาพสังคม เพิ่มความระมัดระวังของบุคคลที่มีความสัมพันธ์เกี่ยวข้องในการดำเนินชีวิตทางสังคม ตลอดจนมุ่งเยียวยาและเพิ่มโอกาสให้ผู้ที่ได้รับความเสียหายได้รับการชดใช้ค่าสินไหมทดแทนอย่างเป็นธรรมอันเป็นไปตามเจตนารมณ์ของกฎหมายละเมิด

ภาษีทรัมป์กับองค์การการค้าโลก: ระบบการค้าเสรีแบบพหุภาคีล่มสลายแล้ว? (Trump Tariffs And The World Trade Organization: Has The Multilateral Free Trade System Collapsed?), Sakda Thanitcul

แม้ว่าองค์การการค้าโลกจะไม่สามารถทำอะไรกับภาษีทรัมป์ได้และปล่อยให้สหรัฐอเมริกาขึ้นอัตราภาษีกับประเทศคู่ค้า 59 ประเทศ ในรูปแบบการเจรจาแบบทวิภาคีก็ตาม แต่ระบบการค้าเสรีแบบพหุภาคีก็อาจยังไม่ถึงขั้นล่มสลาย เนื่องจากเหตุผลสองประการ ประการแรก คือ ประเทศคู่ค้า (ยกเว้นจีนและแคนาดา) ไม่ได้ขึ้นอัตราภาษีนำเข้าตอบโต้และสัดส่วนการค้าของสหรัฐอเมริกาในการค้าโลกคิดเป็นเพียงร้อยละ 11 เท่านั้น ประการที่สอง คือ ภาษีทรัมป์ที่มีพื้นฐานแนวคิดของลัทธิกีดกันทางการค้ามีความขัดแย้งอย่างมากกับแนวคิดพื้นฐานของเศรษฐศาสตร์กระแสหลักที่เชื่อในการค้าเสรีแบบพหุภาคี ทำให้เชื่อได้ว่าภาษีทรัมป์จะไม่ยั่งยืนตลอดไป อย่างไรก็ตาม มี “การแตกร้าว” ในระบบการค้าเสรีแบบพหุภาคีที่มีองค์การการค้าโลกเป็นผู้กำกับดูแลและบริหารกฎเกณฑ์ กล่าวคือ การไม่มีผู้ตัดสินในองค์กรอุทธรณ์ ส่งผลให้กลไกการระงับข้อพิพาทขององค์การการค้าโลกกลายเป็นอัมพาตและสหรัฐอเมริกาเป็นประเทศเดียวที่มีสถานะเหนือประเทศสมาชิกอื่น ๆ อีก 165 ประเทศ เนื่องจากเป็นสมาชิกประเทศเดียวในองค์การการค้าโลกที่สามารถกำหนดอัตราภาษีนำเข้าได้ตามอำเภอใจโดยอ้างเหตุผลด้านความมั่นคงของชาติ

This study employs a corpus-based critical discourse analysis (CDA) grounded in Halliday’s transitivity framework to investigate how China’s diplomatic stance is discursively constructed within conflict reporting. Focusing on media coverage of the Russian-Ukrainian War and the Palestinian-Israeli Conflict (2023), the study investigates how Chinese and Western mainstream media depict China’s stance. Based on a self-built corpus of 153 news reports and analyzed via AntConc, the study quantitatively and qualitatively identifies distinct patterns in the use of transitivity processes across the two corpora. Australia is well known as a ‘sporting nation’ with outstanding elite sporting achievements and grassroots-level sports participation. The reality for Australia’s First Nations people and those from Culturally and Linguistically Diverse (CALD) backgrounds, however, tends to differ from the mainstream Australian population. One of the contributing factors being argued within this paper is the prevalence of historical and contemporary racism in Australian sport. This study focuses on four of Australia’s most popular community-participation sports, including Australian Rules Football (ARF), Cricket, Netball, and Swimming. Although non-native English-speaking teachers now make up the majority of the global ELT workforce, perceived nativeness continues to function as an enduring filter in hiring and evaluation. This perspective paper examines how that filter operates unevenly across the institutional sectors of South Korea’s EFL labor market, arguing that Filipino English Teachers (FETs) face a distributive rather than a uniformly ideological inequity, with the biggest disadvantage concentrated in commercially driven private academies. "Creative constructions" are defined as patterns which deviate slightly but noticeably from grammatical, fully licensed structures in English (and are therefore sometimes branded as "wrong"), inviting specific cognitive associations to make sense of them. It is argued that such structures offer a window into the nature of the cognitive manipulation of linguistic innovations and change. Mathematical Modelling and Numerical Simulation with Applications

Diphtheria is a highly infectious respiratory and skin disease that poses a significant threat to global public health. In Nigeria, children and adults with low immunity remain at high risk due to recurring annual outbreaks in the last decade, with a death rate of as high as 68.8\%. This paper presents a deterministic compartmental model to evaluate the effectiveness of interventions implemented by the Nigerian government. The model's mathematical and epidemiological validity is established through proofs of non-negativity and boundedness. The dynamics of an infectious disease outbreak are studied under a stochastic framework in a closed population where individuals are homogeneously mixed. A vaccination program is implemented in the community prior to the start of the epidemic. The administered vaccine is imperfect, meaning that vaccinated individuals may still become infected upon contact with infected individuals. The mathematical Susceptible-Vaccinated-Infected-Recovered (SVIR) model describing the evolution of the epidemic is formulated as an absorbing, continuous-time, three-dimensional Markov chain with compartments for vaccinated, susceptible, infected and recovered individuals. Hydroclimatic whiplash, characterized by rapid transitions between wet and dry conditions, poses a growing challenge for water resource management and ecosystem stability. However, the spatial and statistical characteristics of wet–dry transitions across the contiguous United States are not fully understood. This study analyzed Palmer Drought Severity Index (PDSI) and Palmer Hydrological Drought Index (PHDI) records from 344 NOAA climate divisions spanning 1895–2024. Whiplash was defined as a transition between severe drought and severe wetness within 12-month rolling windows. Statistical descriptors including lag-1 autocorrelation, variance, and skewness were evaluated for whiplash and non-whiplash windows to assess differences between them. Whiplash hotspots …

We investigate logics that generalize both intuitionistic logic and quantum logic. In earlier work, we introduced Ex-logic, an extension of Holliday's fundamental logic that coincides with the intersection of orthologic and the implication-free fragment of intuitionistic logic. In this paper, we add an implication connective to Ex-logic and axiomatize iEx-logic, the intersection of full intuitionistic logic and orthomodular logic with the implication connective interpreted as the Sasaki hook. As a consequence, we obtain a characterization of the lattice of logics extending iEx-logic as the product of the lattice of intermediate logics and the lattice of orthomodular logics. With growing global concern over climate risk, high-carbon enterprises are assuming an increasingly critical role in strengthening climate resilience and fostering low-carbon development. However, how climate risk disclosure shapes their carbon performance—specifically through what mechanisms and pathways—remains a pivotal yet underexplored question. To address this gap, this study constructs a panel dataset comprising Chinese listed high-carbon companies over the period 2006–2022 and employs a two-way fixed-effects econometric model to assess how climate risk disclosure affects carbon performance while investigating the underlying mediating channel.
