The Second Amendment provides, “[a] well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” The inception of this amendment was rooted in the Founding Fathers’ Enlightenment ideals and disapproval of the English Crown’s “standing armies.” In founding-era America, the militias were not composed of professional soldiers but instead of local citizens with the aim of providing common defense. The “public” is everywhere and nowhere in contemporary public law. Everywhere, in that the term is constantly invoked to justify and explain existing arrangements. Nowhere, in that serious attempts to identify a relevant public and elicit its input are few and far between. Scholars and officials depict the U.S. public as playing myriad roles in governance—checking, guiding, approving, repudiating—without offering an account of how public preferences are formed or how they exercise influence on questions of interest.

The invasive red lionfish, Pterois volitans, plays a unique role in seagrass and reef ecosystems, where it functions as a top predator and competitor for both food and shelter. Given the ubiquitous distribution of lionfish in the Gulf of Mexico and Caribbean basins, their species provides an excellent opportunity to understand how an invasive predator's diet and primary energy pathways change as a function of size and habitat type. Where Does A Hack Happen? Computer Intrusion Crimes And Constitutional Venue, Harrison Parker Blanchard Grant

Criminal Law Practitioner

The United States Constitution guarantees the right to a criminal trial where the criminal offense was committed. This guarantee—the venue requirement—forces courts to analyze where criminal conduct occurred. Technology makes that locational analysis more complicated. For one computer hacker, that same analysis led to his trial and conviction in Massachusetts, despite the fact that he did not hack into anything in Massachusetts. This Article examines the hacker’s case, exploring the technologies used to execute the hack and linking those technologies to the hacker’s trial in Massachusetts.

A new, previously unstudied institution is addressing felonies, including violent felonies of the highest levels, without imposing incarceration as the sanction. Attempts to abolish prisons, or at least reduce racialized mass incarceration, must consider how to respond to serious and violent crimes. This Article offers an analysis of a real-world, ongoing experiment in doing so.

The Manhattan Felony Alternative-to-Incarceration Court (“ATI Court”) is the first and, thus far, the only court in the country that systematically offers defendants of any demographic and any charge the opportunity to be diverted from the traditional criminal legal system and to avoid prison. This paper examines the application of the Americans with Disabilities Act (ADA) to the in-person sport spectatorship experience of hearing-impaired individuals. The delivery of the core sport product, especially at the stadium, is not equally accessible to individuals with disabilities, particularly for audience with hearing impairments. While the ADA mandates accessibility in public accommodations, its implementation for communication access within sport venues remains inconsistent. Promotions And Themes: An Empirical Analysis Of Attendance Factors In The National Women's Soccer League, Lena Gunn, Alexander Traugutt

Journal of Applied Sport Management

The National Women's Soccer League (NWSL) has experienced significant growth, making it crucial to understand attendance drivers at matches. This study evaluated the impact of themed events and promotions on attendance during the 2023 NWSL season. Using data from all regular-season home matches (N = 167), an OLS regression analyzed how various factors influenced attendance measured as a percentage of stadium capacity. Results revealed that themed events significantly increased attendance, while traditional promotions showed a positive but non-significant effect. External factors including post-World Cup timing, visiting team marquee players, and market demographics also significantly influenced attendance. These findings provide actionable …

Promoting Well-Being Among Intercollegiate Student-Athletes: The Impact Of Collegiate Sport Business Practices, Laura Kruger

Journal of Applied Sport Management

The purpose of this experimental study was to identify if the implementation of an educational gratitude workshop could increase intercollegiate student-athletes’ self-reported perceptions of well-being and reduce stress, considering sport administrators must address rising mental health concerns among athletes. Participants of various sport teams were randomly assigned to an experimental or control group to assess differences among self-reported measures of state gratitude, psychological distress, life satisfaction, athlete burnout, and perceived available support in sport. Species distributions depend on fine-scale ecological processes and population growth trajectories and are influenced by climate and weather changes. However, the characterization of inter-population dynamics underlying the geographic distributions of migratory organisms remains challenging. We adopted a stable isotope approach to investigate the dynamic population geography of a terrestrial migratory bird across multiple generations. We found that the age-specific geographic source of Mountain Plovers sampled during winter shifted over four years across a latitudinal gradient. Pakistan Journal of Neurological Sciences (PJNS)

Cerebral venous sinus thrombosis (CVST) is a multifactorial illness seen more commonly in females as compared to males. Its diagnosis is often delayed due to variable clinical presentations. It is now identified more often due to advancements in neuroimaging modalities. We present an uncommon case of CVST caused by anemia in a 23-year-old female. Our patient presented with complaints of headache since the past two days and left sided hemiplegia since past one day. Later on during her hospital stay she developed generalized tonic clonic seizures. MRI and MRV brain with contrast revealed right cerebral venous (vein of Trolard) thrombosis. …
