Electoral Lies And The Broader Problems Of Strict Scrutiny, R. George Wright

Florida Law Review

States often attempt to regulate political speech in the form of deliberate lies related to ballot initiatives, referenda, candidates, or their political positions. Some courts focus on the various harms of electoral lies, while others focus more on the risks of bias and partisan abuse involved in such speech regulations; the cases are in disarray.

This Article argues, however, that the most important problem underlying this case confusion is inherent in the widely utilized constitutional standard of strict scrutiny. Strict scrutiny typically requires a compelling governmental interest, "narrow tailoring," and some causal relation between the regulation and the compelling interest. …

As the lawsuits challenging the Patient Protection and Affordable Care Act (ACA) have evolved, one feature of the litigation has proven especially rankling to the legal academy: the courts' incorporation of substantive libertarian concerns into their structural federalism analyses. The breadth and depth of scholarly criticism is surprising, especially given that judges frequently choose indirect methods, including the structural and process-based methods at issue in the ACA litigation, for protecting substantive constitutional values. Indeed, indirect protection of constitutional liberties is a well-known and well-theorized strategy, which one scholar recently termed "semisubstantive review" and another theorized as "judicial manipulation of legislative …

At the heart of the Eighth Amendment's Cruel and Unusual Punishments Clause are two concepts of proportionality—absolute and relative. Absolute proportionality ("cruel") asks whether the sentence is commensurate with the state's purposes of punishment. Relative proportionality ("unusual"), by contrast, asks whether the sentence is relatively similar to the outcomes of similar cases. Absolute proportionality sets limits on punishment based on the relationship between the punishment and the intended punitive goal; relative proportionality sets limits on punishment based on the sentencing outcomes in similar cases.

Why do scholars and activists pay such close attention to how executive compensation is structured? Appropriate pay structure has traditionally been seen as a mechanism for reducing agency costs imposed on public firms by managers. But as that view has lost explanatory power in recent years, the intense focus on executive pay structure has become difficult to justify. This Article offers a novel way to understand why we continue to care about how public firm managers are paid. Pay structure may be able to signal information about firm quality to capital markets, thereby increasing the pricing accuracy of those markets. …

A recent study of death penalty cases has revealed that judges, who are ordinarily thought of as the guardians of criminal defendants' constitutional rights, often impose harsher punishments than jurors. This may be unsettling in its own right, but it is especially concerning when one considers that judges are the individuals charged with determining whether punishments are unconstitutionally cruel and unusual under the Eighth Amendment and that these determinations are supposed to be based on society's evolving standards of decency. As work continues unabated in the study of noncovalent bonding, particularly σ-hole bonds, new challenges have emerged as the participation of transition metals in interactions of this sort is fast becoming appreciated. While there are certain similarities with the halogen, chalcogen, etc, bonds, in which the main group elements participate, there are certain unique properties of these metal atoms that must be analyzed before a complete understanding can be attained. This documentation is the revised and translated version of the 2024 article Augusto Boals Forumtheater im Deutschunterricht (Eikel-Pohen 2024). It features new observations from the second iteration of a Forum Theater project in a GER 202 language and culture class from 2025 and is again based on autoethnographic notes (Rodriguez-Mejia 2023: 71). It documents the revised application of Augusto Boal’s Forum Theater applied to language and cultural teaching in a socially critical, holistic, cooperative, intercultural, and practical way. Spatial Stochastic Frontier Model With Stochastic Weighting Matrix, Ming-Yu Deng, Levent Kutlu

Economics and Finance Faculty Publications

This paper develops a spatial autoregressive stochastic frontier model that allows the spatial weighting matrix to be stochastic. This approach captures spatial heterogeneity in the interactions among production units and quantifies random spatial dependencies arising from this variability. The model parameters are estimated using a simulated maximum likelihood approach. We propose a method to simulate spillover-corrected direct, indirect, and total efficiency estimates. Additionally, we conduct Monte Carlo simulations to evaluate the finite-sample performance of the proposed model. Finally, an empirical application to the efficiency of Spanish dairy farms is presented to demonstrate the practical implementation of our methodology.

Modern legal scholarship has largely relegated tariffs to economic analysis, overlooking their legal and policy significance. This article challenges that view by examining tariffs as a potential pillar of fiscal policy, exploring their viability as a revenue source alongside or in place of traditional income and corporate taxation. While historically central to U.S. government funding, tariffs diminished in importance with the rise of income taxation and trade liberalization. However, their recent resurgence as a tool for trade protection raises broader questions about their role in national economic strategy. This research is examining how volatility travels between major cryptocurrencies and Gulf stock markets. Using daily data for six GCC equity indices (ADX, BAX, DFMGI, KSE, QE, TASI) and five leading cryptocurrencies (Bitcoin, Ethereum, XRP, Dash, Monero) from 2017–2022. Our methodology contains a three-step framework consists of a univariate Garch (1,1) to assess the volatility of each asset. A bivariant BEKK Garch to measure shocks transmission and volatility transmission from cryptocurrencies to Gulf stock market. This thesis explores how rural communities in Kafr El Sheikh governorate, Egypt, negotiate everyday life with the contamination of Kitchener Drain, the largest agricultural drain in the central Nile Delta. Drawing on ethnographic fieldwork in three villages at the tail-end end of the drain, the study explores how water contamination shapes social and ecological, social life for farmers living in the catchment of the drain. The thesis situates the farmer’s present experience within the broader history of colonial and modernist national irrigation reforms and developments highlighting how systemic neglect and uneven governance reproduce conditions of vulnerability. This paper will assess the degree to which reclusion in the early period can be labeled a global phenomenon and will examine three key areas, the institutional ambits of reclusion, the visual-spatial world of the eremite, and the enduring cultural canon associated with eremitisms across both geographical and temporal distances. In addition, the author will perform an epistemological and phenomenological exercise in deriving humanistic insight from the experiences of recluses, as gleaned through deep consideration of their environments and cultural products.

This paper concerns the kokugaku movement as seen through the philosophy of Motoori Norinaga. Specifically, it looks at Norinaga’s view of the divine and its connection to his philosophy regarding Japanese royalty, the emperor, and the imperial line. It will examine the qualities of Norinaga’s thought that linked his philosophy of the divine with his views of the emperor, served to formulate his world view, and his idea of Japan’s place in the world.
