Since its inception in 1981, the International Water Tribunal has emerged as a non-governmental body with a multidisciplinary composition and a mandate based on conventional and customary international water law, which holds public hearings in order to address water-related complaints. This Article describes the historical background of the proposed Universal Water Tribunal (“UWT”) and significant difficulties on the horizon facing the proposed Tribunal (including political, practical, and legal-technical considerations). It then summarizes the key factors of such Tribunal and, finally, touches upon the proposed model based on an expanded concept of jurisdiction. The main underlying thesis is that, whereas the …

Climate change is a reality. What happens climatically over the upcoming centuries is partially dependent on the comprehensiveness of a global response to curb emissions of greenhouse gases. However, within a century, forecasts predict a one-meter sea level rise that could have grave implications to our society: the loss of an incalculable extent of cultural heritage. This Article examines the threat climate change poses to physical cultural heritage, like archaeological sites and historic structures, and the current framework of law, regulation, and policy in the United States meant to protect these resources. This Article explores the potential for state public nuisance claims to facilitate adaptation, resource protection, and other climate change responses by coastal communities in California. The California public nuisance actions represent just the latest chapter in efforts to spur responses to climate change and attribute responsibility for climate change through the common law. Cleaning Up Our Toxic Coasts: A Precautionary And Human Health-Based Approach To Coastal Adaptation, Robin Kundis Craig

Hurricanes in the United States in 2005, 2012, and 2017 have all revealed an insidious problem for coastal climate change adaptation: toxic contamination in the coastal zone. As sea levels rise and violent coastal storms become increasingly frequent, this legacy of toxic pollution threatens immediate emergency response, longer term human health, and coastal ecosystems’ capacity to adapt to changing coastal conditions.

Focusing on Hurricane Harvey’s 2017 devastation of Houston, Texas, as its primary example, this Article first discusses the toxic legacy still present in many coastal environments. It then examines the existing laws available to clean up the coastal zone—CERCLA, …

"It's My Closest Friend And My Most Hated Enemy": Students Share Perspectives On Procrastination In Writing Classes, Jennifer Gray

Journal of Student Success in Writing (Archived)

This article presents the results from an IRB-approved study that researched student perspectives on procrastination. Qualitative and quantitative data from over 200 surveys administered to first-year writers illustrated multiple reasons why students procrastinated, and these reasons are much deeper than a strong desire to do something else. Results indicated that when students perceived a lack of engagement with their topic (whether the engagement was actually there or not), they were more likely to procrastinate. In addition, students who had fewer choices in their writing assignments, such as topic choices or format choices, were more likely to procrastinate and avoid the …

Good morning! My name is Ron Tombaugh. I was born and raised on a dairy farm near Streator, IL. Streator is about 100 miles southwest of Chicago. Our farm was in the northwest corner of Livingston county, one of the largest counties in IL. To give you an idea of the crops grown there, Livingston County along with 4 surrounding counties produce more corn than the neighboring state of Missouri! Dairy farms were not real common in our area then, and are almost non-existent in the area now.

A well designed and built a barn can be invaluable for cash hay operation. Barn provide opportunity to reduce losses in dry matter and help maintain quality throughout the winter. There are numerous styles of barns that hay producers can purchase or build themselves. Wood frame structures, often with metal roofs and metal sides, are fairly common. You can also build barns with a steel structure with or without metal siding on the walls. Hoop barns are another common hay storage structure - particularly common with round bale storage. Precision agriculture has focused on optimizing efficiency. For crop production, yields can be obtained from the combine and integrated with soil nutrient data to characterize the response to changes in management strategies (spraying, harvesting, nutrient application, irrigation, etc). Currently the highest resolution for yield, for the majority of farms raising alfalfa in Kentucky, is based upon the field level of data. Specifically, most farmers could specify the bales per field. From this and a dry matter (DM) analysis, we can derive the following: bales per acre, tons per acre, total tons of DM, and nutrients removed. Soil characteristics can be …

When hay producers estimate cost of production they often focus exclusively on “cash costs” or variable cost of production such as fuel, repairs, supplies, fertilizer, labor (if hired), and rent (if leased). They all too often ignore their “fixed costs” of production such as depreciation, interest, labor (if family), insurance, and certain taxes. Although there are legitimate reasons to concentrate on cash costs in the short-run, it is a mistake in the long-run, as these are real costs. A Review Of Orthochirus From Turkey, Iraq, And Iran (Khoozestan, Ilam, And Lorestan Provinces), With Descriptions Of Three New Species (Scorpiones: Buthidae), František Kovařík, Ersen Aydın Yağmur, Victor Fet, Fenik S. Hussen

Three new species, Orthochirus fomichevi sp. n. from Turkey and Iraq, O. gantenbeini sp. n. from Iran (Khoozestan Province), and O. navidpouri sp. n. from Iran (Khoozestan and Lorestan Provinces) are described, compared with other Orthochirus species from the region, and fully illustrated with color photos. Lectotype of O. mesopotamicus Birula, 1918 stat. n. from Iran (Khoozestan Province) is designated. Emended diagnoses are given for O. iranus Kovařík, 2004, O. iraqus Kovařík, 2004, O. mesopotamicus Birula, 1918 stat. n., and O. zagrosensis Kovařík, 2004. A key and a distribution map are included.
