Mr. Toad’S Wild Ride: Business Deregulation In The Trump Era, Joan Macleod Heminway Apr 2019

Mr. Toad’S Wild Ride: Business Deregulation In The Trump Era, Joan Macleod Heminway

Scholarly Works

This Essay identifies and takes stock of the Trump Administration’s deregulatory efforts as they impact business interests, with the thought that even incomplete or biased information may be useful to transactional business lawyering.

What of significance has been done to date? With what articulated policy goals, if any? How may — or how should — the success of the administration’s business deregulatory plans and programs be judged? What observations can be made about those successes? For example, who may win and lose in the revised regulatory framework that may emerge? The Essay approaches these questions from a transactional business law …

Developing And Examining Validity Evidence For The Writing Rubric To Inform Teacher Educators (Write), Tracey S. Hodges, Katherine Landau Wright, Stefanie A. Wind, Sharon D. Matthews, Wendi K. Zimmer, Erin Mctigue

Literacy, Language and Culture Faculty Publications and Presentations

Assessment is an under-researched challenge of writing development, instruction, and teacher preparation. One reason for the lack of research on writing assessment in teacher preparation is that writing achievement is multi-faceted and difficult to measure consistently. Additionally, research has reported that teacher educators and preservice teaches may have limited assessment literacy knowledge. In previous studies, researchers have struggled to provide strong evidence of validity, reliability, and fairness across raters, writing samples, and rubric items. In the present study, we fill several gaps in the research literature by developing a rubric, the Writing Rubric to Inform Teacher Educators (WRITE), which utilizes …

Hermaphroditism And The Rhetoric Of Shifting Sexual Identity In Early Modern Europe, Thomas Hudson Apr 2019

Hermaphroditism And The Rhetoric Of Shifting Sexual Identity In Early Modern Europe, Thomas Hudson

Honors Theses

This project is a historical examination of shifting sexual identities and intersex individuals in early modern Europe. This project focuses primarily on anatomical “hermaphrodites” (as they are termed in contemporary sources) and their place within the established binary society. This project answers questions pertaining to intersex individuals and their treatment throughout early modern Europe, depending on country, region, or communities in question. Using primary sources such as Spanish inquisition tribunal transcripts, among other official documents, this project sheds a new light on cultural gender norms of early modern society, producing deeper understanding and hopefully appreciation to our modern culture.

Milton, Jerome, And Apocalyptic Virginity, Brooke Conti Apr 2019

Milton, Jerome, And Apocalyptic Virginity, Brooke Conti

English Faculty Publications

Milton’s youthful interest in virginity is usually regarded as a private eccentricity abandoned on his maturation. His “Mask” is often read, analogously, as charting the Lady’s movement from temporary virginity to wedded chastity. This essay challenges those claims, arguing that Milton’s understanding of virginity’s poetic and apocalyptic powers comes from Saint Jerome, whose ideas he struggles with throughout his career. Reading “A Mask” alongside Jerome suggests that Milton endorses the apocalyptic potential of virginity without necessarily assigning those powers to the Lady herself. In later works, Milton modifies and adapts Jerome before finally producing the perfect eremitic hero of “Paradise …

The Financial Burden Of Illegal Aliens: Directing Attention Toward The Employers Of Undocumented Workers, Shane Dola Apr 2019

The Financial Burden Of Illegal Aliens: Directing Attention Toward The Employers Of Undocumented Workers, Shane Dola

Brigham Young University Prelaw Review

Businesses that employ illegal aliens hoard enormous profits even as illegal immigration costs U.S. taxpayers approximately $135 billion a year. The fraudulent employment practices of companies that either intentionally or negligently hire undocumented workers have been inadequately addressed by both the federal legislature and executive administrations in the past. Rather than punishing predatory employers who provide economic incentive for immigrants to violate the law, governments have chosen to focus their efforts on futile attempts to prevent illegal immigration itself. Even effective federal regulations, which may otherwise have succeeded in curtailing the widespread practice of hiring undocumented workers, have mostly been …

Trips-Plus In China: How The United States Can Use Trips To Strengthen Trademark Minimum Standards In An Fta With China, Neal Hillam

Brigham Young University Prelaw Review

The United States and China have attempted to make a free trade agreement on several occasions over the last few years. A potential amalgamation between the two countries is of particular interest because the United States and China are two of the world’s largest economic powers. This paper discusses what trademark minimum standards should be placed in the agreement and proposes that explicit adherence to TRIPS be made the backbone. The paper will identify several specific trademark problems in China and how stricter adherence to TRIPS can abate these internal issues. The proposed method of using TRIPS as the backbone …

Muddling The Middle: Cynical Representations Of Ethnic Relations In V.S. And Shiva Naipaul, Kevin Frank Apr 2019

Muddling The Middle: Cynical Representations Of Ethnic Relations In V.S. And Shiva Naipaul, Kevin Frank

Publications and Research

In this essay from the collection, Seepersad and Sons: Naipaulian Synergies, Kevin Frank argues that coming from a creolized society, unlike their father, Seepersad, V.S. and Shiva Naipaul's representations of "race" and ethnicity in their works is cynical, favoring one side in the Indo- and Afro-Caribbean racial antagonism, mainly because of their anxiety about "Black Power."

Introduction. Dialogues With Shklovsky: The Duvakin Interviews 1967-1968., Slav N. Gratchev, Irina Evdokimova

Modern Languages Faculty Research

Dialogues with Shklovsky: The Duvakin Interviews 1967–1968 reflects the spirit of times—when the most dramatic events of the twentieth century were happening in Russia and the USSR. The first English translation of the 1967–1968 interviews with the founder of the Formalist School of literary theory, Viktor Shklovsky, this volume offers a slice of Russian micro-history that relies on the living voice of that history. Through the transcription of a six-hour phono-document, the readers will hear the voice of a real participant in events that for the longest time in the USSR were forbidden to be discussed or written about.

A Manifesto, In 140 Characters Or Fewer: Social Media As A Tool Of Rebel Diplomacy, Benjamin T. Jones, Eleonora Mattiacci

Faculty and Student Publications

© 2017 Cambridge University Press. Can rebel organizations in a civil conflict use social media to garner international support? This article argues that the use of social media is a unique form of public diplomacy through which rebels project a favorable image to gain that support. It analyzes the Libyan civil war, during which rebels invested considerable resources in diplomatic efforts to gain US support. The study entails collecting original data, and finds that rebel public diplomacy via Twitter increases co-operation with the rebels when their message (1) clarifies the type of regime they intend to create and (2) emphasizes …

Highlights

• Applied bifactor models to NEO-FFI-3, HEXACO PI-R, and BFI-2 data estimating domain, evaluation, and acquiescence factors.

• The evaluation factor was a significant, positive predictor of GPA.

• The acquiescence factor was not a strong predictor of GPA.
• Domain factor score validities were more negative than corresponding summated scale validities.
• Results suggest that extraneous factor contamination can be measured and used with the modeling techniques employed here.

Alternative Dispute Resolution: Toward A Clear, Reliable And Effective Dispute Resolution System In Saudi Arabia, Ahmad Bedaiwi Apr 2019

Alternative Dispute Resolution: Toward A Clear, Reliable And Effective Dispute Resolution System In Saudi Arabia, Ahmad Bedaiwi

SJD Dissertations

Saudi Arabia has declared its post-oil economic plan: Vision 2030 seeks to make the Kingdom "a global investment powerhouse" and disentangle national economic growth from oil revenues. This dissertation argues that jurisdictions like Saudi Arabia that hope to foster hospitable environments for foreign investment and efficient trade systems must establish effective dispute resolution systems that all business parties can trust. Alternative Dispute Resolution (ADR) mechanisms fit perfectly in this context. ADR has become increasingly prevalent and popular around the world; indeed, arbitration and other means of ADR have become universal methods for resolving disputes in international commerce.

Determining whether the …
