Courtroom To Classroom: Judicial Policymaking And Affirmative Action, Dylan Britton Saul

The judicial branch, by exercising judicial review, can replace public policies with ones of their own creation. To test the hypothesis that judicial policymaking is desirable only when courts possess high capacity and necessity, I propose an original model incorporating six variables: generalism, bi-polarity, minimalism, legitimization, structural impediments, and public support. Applying the model to a comparative case study of court-sanctioned affirmative action policies in higher education and K-12 public schools, I find that a lack of structural impediments and bi-polarity limits the desirability of judicial race-based remedies in education. Courts must restrain themselves when engaging in such policymaking.

The purpose of this paper is to examine sex trafficking as a profitable, international, and illegal industry. One goal of this paper is to explain what sex trafficking is and how it differs from other industries. Sex trafficking is an underground activity and its growth worldwide since the 1980s has had a destructive impact on global societies and economies. Beyond this, the study wants to show that, aside from moral and socio-cultural implications, that sex trafficking is indeed an industry, with a structure not so different from other industries. Objective: Morbidity and mortality among homeless individuals is higher than the general population. This study aims to determine the prevalence of current self-reported, chronic physical health conditions in a large sample of homeless people with sub-samples from shelters and street in British Columbia, Canada. The objective of this Capstone project is to determine how Ben Bernanke used rhetoric during his tenure as Chairman of the Board of Governors of the Federal Reserve System from 2006 to 2013. The scope is limited to testimony delivered as opening statements to the Federal Reserve’s semi-annual Monetary Policy Report to Congress and his prepared testimony during his Senate confirmation hearing. While statisticians have simulated the expected rate of growth in pyramid schemes, this research examines actual data on the spread of an alleged pyramid scheme in Montana. Fortune Hi-Tech Marketing (FHTM) was a multilevel marketing firm, sued by six states and the Federal Trade Commission and permanently shut down in 2014. Data from a settlement with the State of Montana provide a population of participants in a geographic region with definable markets and offer unique insights into local contagion. Creating public housing space in Barcelona requires rethinking how its historic properties might maintain their cultural and structural vitality while serving critical social and economic needs. Drawing on programs from the United States, Europe, and China, I suggest two strategies that Catalan officials might use to effectively leverage Barcelona's historic properties to reduce its public housing deficit. The U.S. Department of Justice is currently investigating the state of Wisconsin with respect to its administration of the Milwaukee Parental Choice Program (MPCP), which provides low-income students with public money to attend private schools. Faced with complaints of disability discrimination by private schools accepting voucher students, DOJ has ordered Wisconsin to oversee and police these schools to ensure compliance with Title II of the Americans with Disabilities Act, which applies to states and their agencies, and § 504 of the Rehabilitation Act, which applies to recipients of federal funding.
