The Changing Landscape Of Digitization And Preservation, Sharon Bradley Apr 2018

The Changing Landscape Of Digitization And Preservation, Sharon Bradley

Presentations

Digitization and the preservation of digitized materials presents many complex legal questions, like ownership, copyright, and conflicting laws. Digital materials may be subject to many levels of legal restrictions like copying, storage, access, and modification of content. The speaker will probably confuse things even more by talking about some issues that are coming over the hill including legally enforceable duties of stewardship, loss of academic scholarship and legal authority, and arguments against strict enforcement of copyright law. It’s also time to move from collaborations, because they’re good idea, to legally established partnerships, because they have teeth.

On Appeal: Courts, Lawyering, And Judging, Richard L. O'Meara Apr 2018

On Appeal: Courts, Lawyering, And Judging, Richard L. O'Meara

Maine Law Review

If one were to ask the members of the Maine legal community to define the term “judicial temperament,” many would answer the question simply by referring to Frank Coffin. Judge Coffin's newest book, On Appeal: Courts, Lawyering, and Judging, illustrates why the Judge has earned such overwhelming respect. This highly personal work permits readers a glimpse “behind the scenes” at the judicial life of a man who has forged a highly successful career of public service marked by sensitive, fair, and well-reasoned decision-making and by good-humored, collegial relationships with all of his colleagues in the legal community and beyond.

On Appeal: Courts, Lawyering, And Judging, John P. Frank

Maine Law Review

Judge Coffin, a former Chief Justice of the United States Court of Appeals for the First Circuit, a former United States Congressman, a former Executive Department administrator, is -- despite those “formers” -- presently a very bright and engaging writer. This compact volume has worthwhile things to say on every aspect of appeals, briefing, argument, deciding the cases, and getting out the opinions. It crisply touches all the appeals phases in which we practitioners are interested.

The University Of Maine School Of Law: An Archival History Of Its Founding And Accreditation, Michael J. Bresnick University Of Maine School Of Law

Maine Law Review

When University Trustees appointed Edward S. Godfrey Dean of the new University of Maine School of Law on January 16, 1962, they did so with the expectation that he would lead the school to accreditation by the American Bar Association (ABA) as quickly as possible. Dean Godfrey proceeded with the complete support of University of Maine President Lloyd H. Elliott and senior administrative officials. By the spring of 1962 the new Dean had begun to staff and equip the school. His efforts were well-rewarded. The ABA House of Delegates provisionally approved the School of Law in February 1964. The speed …

Limited Liability Property, Danielle D'Onfro Apr 2018

Limited Liability Property, Danielle D'Onfro

Cardozo Law Review

This Article offers a theory of secured credit that aims to answer fundamental questions that have long percolated in the bankruptcy and secured transactions literatures. Are security interests property rights, contract rights, or something else? Why do secured creditors enjoy a priority right that, in bankruptcy, requires them to be paid in full before other debt holders recover anything? Should we care that secured credit creates distributional unfairness when companies cannot pay their debts?

This Article argues that security interests are best understood as a form of "limited liability property." Limited liability-the privilege of being legally shielded from liability that …

From Guantánamo To Syria: The Extraterritorial Constitution In The Age Of "Extreme Vetting", Shawn E. Fields Apr 2018

From Guantánamo To Syria: The Extraterritorial Constitution In The Age Of "Extreme Vetting", Shawn E. Fields

Cardozo Law Review

This Article examines for the first time in scholarly literature whether and to what extent the Constitution applies extraterritorially to immigrants abroad. In particular, it explores whether non-detained immigrants and refugees outside the territorial boundaries of the United States can claim constitutional protection to challenge immigration policies and orders. The Supreme Court's recent willingness to reconsider the limits of the political branches' "plenary power" over immigration law and policy, coupled with the Court's recent extension of the Constitution to certain classes of extraterritorial noncitizens, suggests that a future role may exist for extraterritorial jurisprudence to inform constitutional immigration law. Using …

Educating The New Lawyer: Teaching Lawyers To Offer Unbundled And Other Client-Centric Services, Forrest S. Mosten, Julie Macfarlane, Elizabeth Potter Scully

Dickinson Law Review (2017-Present)

In this article, Forrest Mosten and Julie Macfarlane build a new bridge in their 30-year professional relationship by linking their separate but complementary work in access to legal services, helping the self-represented litigant (“SRL”), transforming the lawyer from gladiator to problem-solver and conflict resolver, and using interdisciplinary team triage in Collaborative Law and preventive conflict wellness to better serve the public. The New Lawyer and Unbundled Legal Services are independent concepts that the three co-authors link in proposing new topics (including the concept of Legal Coaching, which is evolving from the unbundled model) and pedagogical approaches to teaching law students …
