Ai Bots As Law Teachers: What Is Left For Human Professors To Do?, Harold I. Abramson

Scholarly Works

This article considers what bots can do as AI law teachers, how students are already using bots for learning, how to integrate the use of AI into law courses, and what faculty can do to stay ahead of the bots in their classrooms. During this discussion, the article confronts the existential question of what is left for human law professors to do in an AI world. It concludes that there is a future for humans for now, and one that might make us better teachers.

On Guido Calabresi, Roger K. Newman Jan 2025

On Guido Calabresi, Roger K. Newman

Touro Law Review

Few individuals have had as long and as influential a career in law as Guido Calabresi. Cofounder of the field of law and economics, teacher, dean, and judge, he has inspired (and infuriated) multitudes. On the United States Court of Appeals for the Second Circuit, where he has served for thirty years (while continuing to teach until recently), his creativity and doctrinal innovations continue apace. He has urged the academy, legislature, and bench alike to engage in continuing conversation to improve the law and its effect upon those to whom it acts. One of these areas is certification—the practice of …

Even If You’Ve Adopted The Nextgen Ube, Your Work Isn’T Done Yet, Suzanne Darrow-Kleinhaus Jan 2025

Even If You’Ve Adopted The Nextgen Ube, Your Work Isn’T Done Yet, Suzanne Darrow-Kleinhaus

Touro Law Review

The National Conference of Bar Examiners (“NCBE”) is set to administer the NextGen Uniform Bar Examination’s (“UBE”) first release in July 2026. The exam questions are well-structured, well written, and require examinees to understand how the law operates and think like an attorney when faced with a particular problem. This was a primary objective for the NextGen UBE, and it has been met. However, jurisdictions that have adopted the NextGen UBE or are contemplating its adoption still have work to do to ensure that their objectives for a fair test modality and assessment of a lawyer’s basic skill of writing …

The Systematic Devaluation Of Legal Scholarship In Criminology And Criminal Justice, Henry F. Fradella Jan 2025

The Systematic Devaluation Of Legal Scholarship In Criminology And Criminal Justice, Henry F. Fradella

Touro Law Review

Certain bibliometrics have become important indicators of scholarly impact despite their many weaknesses. This Article presents data demonstrating the shortcomings of using citation counts and journal impact factors for law-based scholarship. Moreover, the Article argues that reliance on these flawed metrics is just one example of how scholars in criminology and criminal justice (“CCJ”) systematically devalue legal scholarship.

The Article begins by offering quotations from social scientists that provide insights into the negative ways they view legal scholars and their work. It also quotes from interviews conducted with CCJ scholars who hold a law degree and either earned or are …

Sharing The Tuna Platter: A Uniform System Of Assessment For Clinical Education, Melina Healey Jan 2025

Sharing The Tuna Platter: A Uniform System Of Assessment For Clinical Education, Melina Healey

Scholarly Works

Legal education’s current methods for the measurement of student achievement in clinics, and the measurement of a clinic course’s effectiveness, are often unsatisfying, unreliable, and incomplete. This article presents a methodology for uniform and integrated systems of assessment across clinical programs that can provide more reliable evaluation of student progress and achievement, and better feedback to clinical programs on their effectiveness. It also shares how Touro University Jacob D. Fuchsberg Law Center’s Clinical Program applied these strategies with both success and challenges.

Opening Up The In-House: A Model For Collaborative Holistic Services And Education In Law School Clinical Programs, Melina Healey Sep 2024

Opening Up The In-House: A Model For Collaborative Holistic Services And Education In Law School Clinical Programs, Melina Healey

Scholarly Works

Individual in-house clinics too commonly operate autonomously behind separate walls. These barriers impair the meaningful holistic representation of clients and the educational opportunities of clinic students. This article provides an argument and framework for opening the doors between clinics to enrich clinic student education and enhance client representation. Part I identifies the benefits of holistic inter-clinic collaboration for both clinic students and the clients they serve. Part II shares a model for how to integrate education and client service across practice areas of clinical programs. A forthcoming article, published separately, will further describe how clinical programs can be improved by …

Externships For Equity, Lauren K. Valastro Jan 2024

Externships For Equity, Lauren K. Valastro

Journal of Race, Gender, and Ethnicity

This article examines the crucial role of externships in improving employment outcomes for marginalized law students, who often face systemic barriers to success in the legal field. Despite advancements, these students continue to have lower employment rates after graduation, largely due to institutional failures. Externships offer a low-cost, high-impact opportunity for students to gain the competencies employers seek, thus significantly enhancing their chances of securing employment. By analyzing data, the essay highlights the positive effect of externships on marginalized students' hiring outcomes. It also addresses broader questions on how legal employers evaluate candidates and proposes that expanding and supporting externship …

Merging The Bench, Bar, And Law Schools: How A Student Scholars Program Achieves Professional Identity Through Scholarly Writing, Mentorship, And Presentation, Joan Foley, Robin Boyle, Troy Kessler

Scholarly Works

This Article describes an innovative co-curricular program, the Student Scholars Program, that provides law students with an opportunity to present their scholarly papers before the bench, bar, and law school community. The Program aids law schools in meeting accreditation standards, such as the ABA Standards 302 and 303. Standard 302 requires law schools to achieve specific learning outcomes. Standard 303(b)(3) requires law schools to provide "substantial opportunities" for students to develop a "professional identity." This program aids schools in achieving these standards. Furthermore, this program increases interaction between students and the legal profession by creating episodic mentoring opportunities. Launched in …
