The River That Powers Us: A Tribute To Dean Emeritus Kevin R. Johnson, His Steadfast Commitment To Diversity And Excellence, And His Legacy Of Impact, Angela Onwuachi-Willig

This Essay pays tributes to Dean Emeritus Kevin R. Johnson’s extraordinary contributions to the growth and successes of full-time Latinx faculty and other faculty of color within the legal academy. To do so, it utilizes the recent, inaugural study of faculty by the Association of American Law Schools (AALS) to situate the legal academy’s progress with the diversification of its faculty within a longer trajectory and then illustrates how such gains over the past three decades are the product of intentional, sustained intervention rather than organic institutional and societal evolution. Self-Compassion And Law Student Professional Identity Formation, Janice L. Craft
The Journal of Law Teaching and Learning
The American Bar Association’s Standards for Legal Education and Admissions to the Bar require law schools to provide students with “substantial opportunities” for “[t]he development of a professional identity.” The Standards do not require a particular curriculum or mode of instruction but offer two guideposts for legal educators: one, that “professional identity focuses on what it means to be a lawyer and the special obligations lawyers have to their clients and society,” and two, that professional formation “should involve an intentional exploration of the values, guiding principles, and well-being practices considered foundational to successful legal practice.” The guidance and concomitant …

Democratic Lawyering: Upending The “Hidden Curriculum” To Prepare New Lawyers For A New World, Eduardo R.C. Capulong, Andrew King-Ries, Monte Mills
The Journal of Law Teaching and Learning
Multiple heightening crises reveal the deficiencies and contradictions of legal education, in particular the values it imparts. Perpetuating myths about U.S. democracy and rule of law, the enduring formalist, liberal legalist cast of law school is increasingly at odds with students’ lived experiences. As liberal democracy and the rule of law falter, no longer is relying on the “hidden curriculum” or the historically nebulous and mythical narratives of the law and our legal system sufficient to prepare tomorrow’s lawyers for the challenges faced by our profession. Aba Standard 303(C) And Divisive Concepts Legislation And Policies: Challenges And Opportunities, Sherley Cruz, Becky L. Jacobs, Karen L. Tokarz, Kendall Kerew, Andrew King-Ries, Carwina Weng

This article by six clinicians discusses the challenges and opportunities of new ABA Standard 303 (c), including the implications of and interactions between Standard 303(c) and “divisive concepts” laws and other threats to representation, academic freedom, and free speech in legal education. The article also highlights the intersection of Standard 303(c) and Standard 303(b)(3), which addresses professional identity formation; discusses opportunities to adapt current curriculum and teaching and create new curricular responses to meet the new accreditation standards and interpretations; and explores ways to resist increasing limitations and find a supportive academic community to sustain hope and resilience.

Tapping Into The Talent Pipeline While Repairing The Leaky Pipe, Michelle M. Kwon

Diversity in the legal profession matters. It helps legitimize our legal system, giving everyone confidence that they will be treated fairly. Diverse legal teams make it more likely that the team will understand different perspectives and avoid “group think.” Having diverse groups make, enforce, and interpret laws leads to better outcomes. And yet, the legal profession is one of the least diverse in the country. The vast majority of lawyers are White men even though women constitute half of the population and about 40% of the U.S. population is not White. The percentage of Black lawyers has remained virtually unchanged …
