Can Employers Save Us From Student Loans? Credentialism, Arms Races, And Debt Forgiveness, Tammy Harel Ben Shahar, Omer Kimhi Jan 2025

Can Employers Save Us From Student Loans? Credentialism, Arms Races, And Debt Forgiveness, Tammy Harel Ben Shahar, Omer Kimhi

Washington and Lee Law Review

America is drowning in student loan debt. About 45 million Americans owe the astounding sum of $1.75 trillion in outstanding student debt, and many of them default on their payments. While most agree that something must be done, attempts to alleviate the problem have met political backlash and legal challenges. In June of 2023, the Supreme Court struck down the Biden administration’s comprehensive student loan debt forgiveness plan, and recently the administration initiated the politically contested “Saving on a Valuable Education” plan (“SAVE”). Amidst this political tug of war, this Article aims to offer a critical and nuanced analysis of …

Everything You Need To Know About Aristotelian Rhetoric You Can Learn From Kendall Jenner And Serena Williams, Allison Wexler Weiss Jan 2024

Everything You Need To Know About Aristotelian Rhetoric You Can Learn From Kendall Jenner And Serena Williams, Allison Wexler Weiss

Pop culture can teach us a lot about the law: almost everyone knows the Miranda warnings and can recite them by heart, thanks to Law and Order and other crime dramas, the concept of a “conservatorship” is familiar to many because of Brittany Spears, and the notorious RBG has become a household name, recognizable in a crown and jabot, partly due to Kate McKinnon’s portrayal on SNL.

Commercials, and the pop culture icons featured in them, can also teach students about the art of persuasive advocacy. At the start of the spring semester, when I segue from objective analysis to …

Invaluable guidance has emerged regarding online teaching in recent years, but less so concerning online and take-home final exams. This article offers various methods to administer such exams while maintaining their integrity—after asking artificial intelligence writing tool ChatGPT for its views on the matter. The sophisticated response of the chatbot, which students can use in their written work, only raises the stakes of figuring out how to administer exams fairly.

Building Belonging: Proven Methods To Decrease Attrition And Best Serve Law Students, Leila Lawlor Jan 2023

Building Belonging: Proven Methods To Decrease Attrition And Best Serve Law Students, Leila Lawlor

Scholarly Articles

A crucial task for legal educators is to determine how to retain our students, especially those who may be most vulnerable to attrition first-generation students and students of color. This article looks at nine similarly situated ABA-accredited law schools and assesses these schools' success at retaining their students. The nine schools are all public, operate both part-time and full-time J.D. programs, generally enjoy above average diversity, and have somewhat similar national rankings. The nine schools also report similar median LSAT scores and undergraduate GPAs of recent incoming classes. The overall attrition rates and attrition rates for students of color vary …

Teaching Slavery In Commercial Law, Carliss N. Chatman

Scholarly Articles

Public status shapes private ordering. Personhood status, conferred or acknowledged by the state, determines whether one is a party to or the object of a contract. For much of our nation’s history, the law deemed all persons of African descent to have a limited status, if given personhood at all. The property and partial personhood status of African-Americans, combined with standards developed to facilitate the growth of the international commodities market for products including cotton, contributed to the current beliefs of business investors and even how communities of color are still governed and supported. The impact of that shift in …

Public Education: Engaging With Secondary Education In Schools, In International Handbook On Clinical Tax Education (Amy Lawton Ed., 2023), Michelle Lyon Drumbl

Books and Chapters

This chapter will consider the benefits of public education by considering educational outreach projects in secondary schools. Chapter 8 discussed the importance of tax education for young people. Forging relationships with local schools (and, indeed, wider community organisations) is a worthwhile endeavour for any clinical tax education project. In addition to the benefits to university students (covered in more detail in Part III), the community benefits include stronger ties to the local community as well as a contribution to the financial literacy (and tax literacy) of taxpayers.

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg Jan 2023

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg

Washington and Lee Journal of Civil Rights and Social Justice

Conspicuously absent from the United States’ ongoing discourse about its racist history is a more honest discussion about the individual and personal stressors that are evoked in people when they talk about racism. What if they got it wrong? The fear of being cancelled -- the public shaming for remarks that are deemed racist -- has had a chilling effect on having meaningful conversations about racism. What lost opportunities!

This paper moves this discussion into the law school context. How might law schools rethink their law school curricula to more accurately represent the role systemic racism has played in shaping …
