Second Chance Pell Experiment: How The United States Is Starting To Recognize Education As A Right, Brittany Walker Jan 2023

Second Chance Pell Experiment: How The United States Is Starting To Recognize Education As A Right, Brittany Walker

Human Rights Brief

For decades, education as a right has been an issue between U.S. citizens and U.S. courts. U.S. courts maintain that education is not a right, as it was not explicitly stated in the U.S. Constitution. Since the U.S. Constitution is silent about education, U.S. courts have applied the 14th Amendment to defer educational matters, such as compulsory school requirements, to each state. Currently, education in the United States is generally a right until middle school. After middle school, the American government allows parents and students to determine whether additional education is necessary in their situation. This view causes disparities for …

One Of Many: The Power Of Publication In The Human Rights Regime, Amanda Lorenzo

Human Rights Brief

On September 19, 2011, the High Court of Tanzania found Ghati Mwita guilty of murder for a February 4, 2008 homicide, sentencing her to hang pursuant to Tanzania’s mandatory death sentence. The domestic Court of Appeal sitting at Mwanza dismissed Mwita’s appeal on March 11, 2013 and rejected her application for review on that decision on March 19, 2015. Mwita then brought the case to the African Court of Human Rights (the Court) alleging that the conviction and sentencing procedures violated her fundamental rights under the Banjul Charter (the Charter).

Striking Out: How The Mlb’S Baseball Academies Interfere With Children’S Human Rights In The Dominican Republic, Crystal Nieves Murphy

Human Rights Brief

Major League Baseball (MLB) has recently included a large number of foreign-born players in the league. Specifically, many of these players are from the Dominican Republic, with Dominican players making up more than ten percent of active players on MLB Team rosters across the league. This large number of Dominican baseball players in the MLB comes from a culture of scouting talent at a young age and the creation of baseball academies in Latin America as a whole. Currently, all thirty MLB teams have a baseball academy in the Dominican Republic where each team develops young teenagers talented at baseball.

Aeca And The United States War Crimes Connections In Yemen, Rachel Hage Jan 2023

Aeca And The United States War Crimes Connections In Yemen, Rachel Hage

Human Rights Brief

The conflict in Yemen wages on, and many states, including Saudi Arabia and the United States, have been complicit in human rights violations. The United States’ current and past administrations have continued to sell arms to Saudi Arabia despite multiple international organizations’ documenting the state’s human rights violations. This Article argues that, despite the lack of transparency regarding how much support the United States is lending to Saudi Arabia arms being used in Yemen, the United States may be held responsible for human rights violations in Yemen. The Arms Export Control Act (AECA) provides the U.S. President with the authority …

The Failure Of The Italian Government To Honor The Human Rights Of Migrants, John Kerins Jan 2023

The Failure Of The Italian Government To Honor The Human Rights Of Migrants, John Kerins

Human Rights Brief

Italian Prime Minister Giorgia Meloni’s Parliament, feckless in the harsh waters of European politics, looks to be breaking on the very beaches where Allied forces once landed almost 80 years ago. The small island of Lampedusa remains a pricking thorn in the Italian government’s side, further complicating the testy waters with migrants coming in from the Mediterranean. To solve this, the Italian government has begun to violate the human rights of migrants and workers alike. Giorgia Meloni’s government has called for an ‘EU Naval Blockade’ of the Mediterranean, prompting outcry from human rights groups who correctly see what the rest …

Impact Of Extreme Hindutva Ideology On Freedom Of Speech In India, Meher Shah Jan 2023

Impact Of Extreme Hindutva Ideology On Freedom Of Speech In India, Meher Shah

Human Rights Brief

In the last decade, India has seen a rise of extreme far-right nationalism often referred to as the “Hindutva movement.” While the movement existed even before India obtained its independence in 1947, it recently gained unprecedented popularity and support among Indian citizens and non-resident Indians. Among the factors responsible for the Hindutva movement’s current popularity is blatant support and affiliation from the ruling political party, the Bharatiya Janta Party (BJP). The BJP has been a leading endorser of the Hindutva ideology, bringing it back to the center stage of Indian politics.1 The rise and spread of the ideology and its …

Principles On Effective Investigative Interviews: A New Instrument Of International Law, Juan E. Mendez, Matthew Ilsley Jan 2023

Principles On Effective Investigative Interviews: A New Instrument Of International Law, Juan E. Mendez, Matthew Ilsley

Human Rights Brief

International law absolutely prohibits torture and ill-treatment, yet such abuses remain prevalent and widespread. It most frequently occurs in the questioning of individuals by law enforcement, intelligence officials, and military personnel in the context of “fighting crime,” obtaining confessions, controlling detainees, and “counterterrorism.” The “Torture Memorandums,” exemplifying the deeply misguided practices used in the global fight against terror following the attacks of September 11, 2001, illuminated the pervasiveness of these practices.

The Forgotten Sexual And Gender-Based Violence Of The Vietnam-American War: Is Justice Too Late For Vietnamese Victims And Survivors?, Madison P. Bingle Jan 2023

The Forgotten Sexual And Gender-Based Violence Of The Vietnam-American War: Is Justice Too Late For Vietnamese Victims And Survivors?, Madison P. Bingle

Human Rights Brief

“The past, far from disappearing or lying down and being quiet, has an embarrassing and persistent way of returning and haunting us unless it has in fact been dealt with adequately.” —Desmond Tutu

The Vietnam-American War ended nearly fifty years ago. However, the atrocities committed during the war have had a devasting impact on the lives of persons involved long after the conflicts’ end. A particularly marginalized group within survivors and victims of the Vietnam-American War is Vietnamese women who experienced sexual and gender-based violence. And given the specific tactics of warfare employed during this war, including the use of …

Unwinding “Law And Order”: How Second Look Mechanisms Resist Mass Incarceration And Increase Justice, Destiny Fullwood, Cecilia Bruni Jan 2023

Unwinding “Law And Order”: How Second Look Mechanisms Resist Mass Incarceration And Increase Justice, Destiny Fullwood, Cecilia Bruni

Human Rights Brief

For decades, the United States has used incarceration to achieve a particularized version of safety. Amidst the civil rights movement, presidential candidate Barry Goldwater wielded the phrase “law and order” against the masses of Black men, women, and children in their fight for equitable treatment. This came at a time when “[i]t was no longer socially permissible for polite White people to say they opposed equal rights for Black Americans. Instead, they began ‘talking about the urban uprisings’” and “attaching [those] to street crime, to ordinary lawlessness[.]” The result was a decades-long, persistent campaign to maintain order by arresting and …

Politics And The Criminal Enforcement Of The Toxic Substances Control Act, Dr. Joshua Ozymy, Dr. Melissa Jarrell Ozymy, Dr. Danielle Mcgurrin

Seattle Journal of Technology, Environmental, & Innovation Law

Environmental crimes related to chemical substances are governed under the Toxic Substances Control Act (TSCA). When these violations involve significant harm or culpable conduct they may be remedied through criminal prosecution. While Democratic and Republican presidents have offered historically varied support for criminal enforcement, we know very little about how politics affects TSCA enforcement outcomes or TSCA criminal enforcement generally. To address these issues, we performed a content analysis of 2,728 criminal prosecutions from 1983-2021 that derive from the United States Environmental Protection Agency (EPA) criminal investigations and select all TSCA prosecutions. Results show 75 prosecutions were adjudicated, involving 137 …

The Value Of Vehicle-To-Grid Systems In The Clean Energy Transition: Policy And Regulatory Issues, Alyssa Valentine Jan 2023

The Value Of Vehicle-To-Grid Systems In The Clean Energy Transition: Policy And Regulatory Issues, Alyssa Valentine

Seattle Journal of Technology, Environmental, & Innovation Law

As the United States transitions to clean energy, advances in technology are making such a transition possible by enabling utility-scale renewable energy generation (primarily wind and solar) and transportation electrification. However, the growth in renewable energy generation and electric vehicles (EVs) has created new reliability issues for the electric grid due to the intermittent nature of solar and wind power and increased load on the grid from EV charging. New methods and tools are needed to balance energy supply and demand. One such tool is the vehicle-to-grid (V2G) system, which uses EV batteries to help balance the grid, providing additional …

From Spying To Mindreading: Expanding Wiretapping Legislation To Protect Customers’ Privacy Of Thought From Chat Preview In Online Chat Functions, John Deming

Seattle Journal of Technology, Environmental, & Innovation Law

When you chat online, there is a space of time between when you type out your message and when you decide to send it. During this time, you might assume that you have the chance to read over your message, edit it, or even delete it if you don’t like what you’ve written- all without the other person seeing it. However, this is frequently not the case when consumers chat with customer service representatives, thanks to ‘chat preview.’ ‘Chat preview,” which goes be several different names throughout the chat software industry, is a feature that allows the person on end …

There Is No Such Thing As Circuit Law, Thomas B. Bennett Jan 2023

There Is No Such Thing As Circuit Law, Thomas B. Bennett

Faculty Publications

Lawyers and judges often talk about “the law of the circuit,” meaning the set of legal rules that apply within a particular federal judicial circuit. Seasoned practitioners are steeped in circuit law, it is said. Some courts have imagined that they confront a choice between applying the law of one circuit or another. In its strong form, this idea of circuit law implies that each circuit creates and interprets its own body of substantive law that is uniquely applicable to disputes that arise within the circuit’s borders.

This article argues that the notion of circuit law is nonsensical and undesirable …

Judicial Process And Vigilante Federalism, Charles W. "Rocky" Rhodes, Howard M. Wasserman Jan 2023

Judicial Process And Vigilante Federalism, Charles W. "Rocky" Rhodes, Howard M. Wasserman

Faculty Publications

Jon Michaels’ and David Noll’s "Vigilante Federalism" (Cornell Law Review) decries the explosion of state laws that target certain people (women seeking abortions, trans students seeking to use bathrooms, schools trying to teach about race) and rely on private civil litigation by random "any persons" as the exclusive or primary enforcement mechanism. These laws "deputize private actors to wage and win the culture wars," while subordinating marginalized groups.

But Michaels and Noll conflate well-taken substantive constitutional objections to these laws with procedural issues surrounding the private enforcement mechanism, which is neither unique nor constitutionally problematic. States have long authorized private …

Ready To Do The Difficult Work Ahead: The Legal Legacy Of Senator Harry Reid, Robert Lemus, Sarah Voehl

Nevada Law Journal Forum

This White Paper examines the legal legacy of Harry Reid, who served Nevada in the Senate for thirty years and rose to the position of Majority Leader from 2007 to 2015. Senator Reid's work on land and water policy, climate change, immigration, gaming, and labor deeply affected Nevada and the United States as a whole. Through his positions of leadership, he secured funding for critical infrastructure projects, protected public lands, championed renewable energy, passed the Affordable Care Act, fought for immigration reform, and advocated for labor and gaming issues. This paper concludes that Senator Reid's legal legacy is a powerful …

A Professional Comedian’S Fundamental Right To Publicly Bully A Child Because Of His Disability? Scrutinizing Ward V. Quebec Human Rights Commission Through A Disability Lens, David Lepofsky Jan 2023

A Professional Comedian’S Fundamental Right To Publicly Bully A Child Because Of His Disability? Scrutinizing Ward V. Quebec Human Rights Commission Through A Disability Lens, David Lepofsky

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Ward, a well-known Quebec comedian, thought it would be funny to publicly ridicule and humiliate an adolescent with a disability known in Quebec for his singing. Quebec’s Human Rights Tribunal found that Ward violated his target’s statutory right to be free from disability discrimination in relation to the right to dignity, guaranteed by section 4 of the Quebec Charter of Human Rights and Freedoms. A five-justice majority of a sharply split Supreme Court of Canada overturned the award, leaving Ward free to repeat his bullying. Ward’s Supreme Court majority extended problematic legal protection to extreme, widely disseminated public taunting and …

Improving Voluntary Carbon Markets Through Standardization And Blockchain Technology, Nicholas P. Espenan Jan 2023

Improving Voluntary Carbon Markets Through Standardization And Blockchain Technology, Nicholas P. Espenan

Wyoming Law Review

The impacts of climate change, if left unchecked, will result in significant economic and ecological harm globally. While reducing carbon emissions in a sustainable manner may mitigate these effects, a concerted effort is required from all nations. Carbon markets present an opportunity to address emissions while promoting economic growth and technological advancement in carbon sequestration initiatives. However, the current state of the global voluntary carbon market is fragmented, with little uniformity and lacking transparency, which can undermine its effectiveness. To address these challenges, an industry-wide carbon sequestration standard, supported by a transparent blockchain protocol, should be implemented to enhance the …

The Article then examines …
