A Settlement In Crisis: How In Re Opioid Litigation Fails To Put People Before Corporations, Gabrielle Hunter
Emory Business Law Review Perspectives
Since 1999, 932,000 people in the United States have died from a drug overdose. In 2021 alone over 100,000 people died from a drug overdose. Seventy-eight percent of those overdoses involved opioids. As the opioid epidemic has torn families apart and decimated American communities, the natural response is to find someone to blame. State and local governments, Native-American tribes, labor unions, insurance companies, hospitals, and individuals have all pointed the finger at the same culprits: opioid manufacturers and distributors.
The result—over 3,000 state and local governments alongside Native American tribes joined In Re Opiate Litigation, a multidistrict litigation, alleging …

The First Amendment is one of the most important amendments that protects democracy. The First Amendment provides that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” The First Amendment protects pure speech (speaking and writings) and symbolic speech, which is nonverbal expression intended to communicate ideas. The Constitution protects “coarse expression as well as refined, and vulgarity no less than elegance” because “a …

Activism By Any Other Name: Stakeholder Capitalism, Esg, And Political Pushback, Kameron St Clare
Emory Business Law Review Perspectives
In recent years, Stakeholder Capitalism and ESG have become widely used terms not only in corporate board rooms, but in media commentary more generally. As their use and influence in practice have both grown, so, too, has the pushback from opponents of these values-based norms for the way the world does business. Indeed, in recent months, numerous Republican-led states, like Texas, have taken more substantive actions designed to thwart the actions and aims of ESG- and stakeholder capitalism-oriented corporations and investment funds. But what, exactly, do these terms mean? And where do these terms come from? Moreover, what’s all the …
Wild Cards In Natural Resource Planning: High Impact Surprises That Shape The Future, Dr. David Bengston
Wild Cards In Natural Resource Planning: High Impact Surprises That Shape The Future, Dr. David Bengston
Natural Resources Journal
Wild cards are improbable, high impact events. Such events, like the COVID-19 pandemic, have the ability to shape policy by upending entire systems and paradigms. Unfortunately, long-term planning and policymaking rarely account for wild card events. Instead, planning and policymaking typically assume that existing trends will continue without major disruption. Moreover, adequately planning for potential wild card events is challenging because they are inherently difficult to predict. However, planning for wild card events in natural resources and environmental policymaking is vital as global developments, such as climate change, create more extreme conditions and challenges. This review, (1) defines and characterizes …

Admissions tests have increasingly come under attack by those seeking to broaden access and reduce disparities in higher education. Meanwhile, in other sectors there is a movement towards “work-sample” or “proximal” testing. Especially for underrepresented students, the goal is to measure not just the accumulated knowledge and skills that they would bring to a new academic program, but also their ability to grow and learn through the program. The JD-Next is a fully online, noncredit, 7- to 10-week course to train potential JD students in case reading and analysis skills, prior to their first year of law school. This study …

In a more complex and simplistic sense, abuse (abnormal use) of power can be interpreted as a result of the failure of internal control. Within the banking industry itself, the prudential principle is the main benchmark in the formation and maintenance of relations between the Bank and the public. Although Directors and Commissioners bear legal responsibility with their respective portions, there are certain limitations regarding when directors and commissioners cannot be held liable for the risk of decisions or supervisory actions that they have taken. When faced with a case of alleged banking crime, the Panel of Judges can use …

Economy and Social Welfare should not be read and understood as two separate concepts separately. Human rights are rights that humans have solely because they are human. Humanity has it not because it was given to it by society or based on positive law, but solely based on its dignity as a human being. The state as the holder of the obligation to fulfil human rights has the responsibility to comply with these aspects when talking …

In The Dark: The Scapegoating Of Renewables After Grid Failures, Teddy Gonzalez, Jillian Knox
Natural Resources Journal
Renewable energy is increasingly scapegoated as the primary cause of weather-related power outages and other grid failures, despite substantial evidence to the contrary. Disinformation campaigns framing renewables as unreliable are driven by two factors: the increasing frequency of power outages and the growing pressures facing fossil fuel energy stakeholders. Over the past decade, power outages in the United States have doubled, primarily due to increased extreme weather, aging energy infrastructure, and a rapidly changing resource mix. At the same time, the energy transition is placing unprecedented competitive pressure on the coal and gas industry and on the nation’s utilities. These …

This Article acknowledges the growing trend toward practice-based lawyer norms, points out how it allows interaction between the existing place-based norms and the new practice-based norms, and compares this movement with the existing regulatory conditions outside the US. If there is movement from the world as we know it (place-based norms) to a world as it may come to be (practice-based norms), is the change tragic, inevitable, risky, in line with the rest of the global legal profession, or all of the above and more? Specifically, how would such an evolution affect the core duty of lawyer-client confidentiality?

Democratizing Abolition, Brandon Hasbrouck

When abolitionists discuss remedies for past and present injustices, they are frequently met with apparently pragmatic objections to the viability of such bold remedies in U.S. legislatures and courts held captive by reactionary forces. Previous movements have seen their lesser reforms dashed by the white supremacist capitalist order that retains its grip on power in America. While such objectors contend that abolitionists should not ask for so much justice, abolitionists should in fact demand significantly more.
Remedying our country’s history of subordination will not be complete without establishing abolition democracy. While our classical conception of a liberal republic asks us …

Most often, when law enforcement agencies or governments use a person’s DNA or genetic information, they do so in the pursuit of justice. That said, there are privacy concerns that arise when the government or police have open access to any person’s DNA or genetic information, especially through the Internet. This article attempts to present an argument for a reasonable expectation of privacy (REP) in a person’s genetic information or DNA as well as other forms of advancing technology. It begins with a history of the US Supreme Court’s interpretations of the Fourth Amendment to the US Constitution, continues with …

Under traditional common law, a plaintiff could recover damages for libel if she could prove that the defendant had published a factual statement about the plaintiff that tended to injure the plaintiff’s reputation. The plaintiff, at most, was required to show negligence to recover damages for libel. While the amount of money that any given plaintiff could recover in damages was uncertain, one thing was clear: the First Amendment would not protect libel. In 1964, in New York Times Co. v. Sullivan, the Supreme Court radically upended this received view of libel as unprotected speech. According to Sullivan, …

This term, the Supreme Court will decide Students for Fair Admissions v. President and Fellows of Harvard College (SFFA v. Harvard), a challenge to Harvard College’s race-conscious admissions program. While litigation challenging the use of race in higher education admissions spans over five decades, previous attacks on race-conscious admissions systems were brought by white plaintiffs alleging “reverse discrimination” based on the theory that a university discriminated against them by assigning a plus factor to underrepresented minority applicants. SFFA v. Harvard is distinct from these cases because the plaintiff organization, SFFA, brought a claim alleg-ing that Harvard engages in intentional discrimination …

The U.S. federal government raises tax revenue almost exclusively through income taxes, both corporate and individual, whereas its trading partners and competitors rely for their national revenue on both income taxes and “destination-based” value added taxes (VATs), which are not imposed on exports but are imposed on imports. As a result, U.S. corporations, which are subject to U.S. corporate income tax, may be at a serious trade disadvantage to competitor non-U.S. corporations with respect to both U.S. domestic sales and foreign sales, if the U.S. corporate income tax exceeds the foreign country’s income tax imposed on those competitors.

The voices of impacted people are some of the most important when trying to make improvements to social justice in a variety of contexts, including, criminal policing, housing, and health care. After all, the people with on the ground experience know what is likely to truly effectuate change in their community, and what is not. Yet, such lived experience is also often significantly lacking and undermined in law and policy. People with lived experience tend to be seen as both community experts with valuable knowledge, as well as non-experts with little valuable knowledge. This Article explores the lived experience with …
