Mental Health In Pilots Ages 19-26: What Are The New Pilots Telling Us?, Jason T. Lorenzon, Diana Semilia
Mental Health In Pilots Ages 19-26: What Are The New Pilots Telling Us?, Jason T. Lorenzon, Diana Semilia
National Training Aircraft Symposium (NTAS)
Mental Health is stigma that reaches all professional pilots. After spending a considerable amount of money, a pilot is always afraid of losing his/her medical certification. This leads many pilots to not be honest and forthcoming about his/her own health situation or if he/she is forthcoming with any medical deficiency, the regulatory framework at the Federal Aviation Administration may put a further burden on the pilot to provide additional medical documentation, or the FAA may even amend, revoke, or suspend a pilot's medical certificate.
The Federal Aviation Administration (FAA) regulations,14 CFR Parts 61 and 67 and internal protocols creates a …
The Federalists Of The Internet? What Online Platforms Can Learn From Reddit’S Decentralized Content Moderation Scheme, Vincent Marrazzo
The Federalists Of The Internet? What Online Platforms Can Learn From Reddit’S Decentralized Content Moderation Scheme, Vincent Marrazzo
Nebraska Law Bulletin (Selected Issues)
As online platforms become the primary carriers of news and information in society, their content moderation policies will have increasing power over users’ daily lives. Centralized moderation is inappropriate and inefficient because it forces all online communities to adhere to the same (and often arbitrary) standards. Decentralized moderation, however, allows most moderation decisions to be made by users who are intimately aware of the contours of individual online communities. Such decisions are less likely to restrict content that is not violative of an online communities’ standards.
This concept of subsidiarity mirrors the arguments made in favor of federalism in which …

The Murder Of George Floyd: A Case Study Examining How The Policing Of Black Men And Grassroots Activism Influence The Will Of Black Women To Lead, Ella Gates-Mahmoud
Doctorate in Education
This study's objective investigates the viewpoints held by Black women in two urban areas of Minnesota about the social upheaval that followed the murder of George Floyd in 2020 for using a counterfeit $20 bill. In the last decade, police killings of innocent Black people in the United States have received more attention, and Floyd's death is only one example of this phenomenon. In the U.S., the likelihood of a police officer taking the life of a Black man is higher than that of a White man. Between 2013-2019 there have been 1,641 fatal shootings of defenseless Black men by …

Politics And Policy Of The Falling Birth Rate In Italy: Predictions And Concerns, Erin Lindsay
Cardozo International & Comparative Law Review (CICLR) Blog
The birth rate in Italy had been a topic of concern for the past couple decades, making it a source of conversation and debate among political parties and candidates in Italy. With the election of a new Italian government and the prediction of Giorgia Meloni being Italy’s new prime minister, how Meloni and her party have spoken of and plan to tackle the falling birth rate is a discussion occurring around the world. The falling birth rate was concerning to country leaders prior to the start of the COVID-19 pandemic, but statistics show that the Italian birth rate has fallen …

Book Review: Half American, Half Amazing: A Review Of Half American By Matthew F. Delmont And An Exploration Of Executive Action During World War Ii And Its Impact On Black Soldiers, Ainslee Johnson-Brown
ConLawNOW
This essay reviews Matthew F. Delmont’s new book, Half American: The Epic Story of African Americans Fighting World War II at Home and Abroad (2022). The book enriches the ongoing scholarship related to critical race theory and the effects of executive action on the lived experience of Black Americans. Delmont presents a well-woven narrative of the experience of Black American soldiers during World War II. Pieced together from letters, court documents, and articles published during the war, this book sheds light on accounts previously buried beneath a shield of trauma, frustration, and disbelief.
Speculative Constitutions In Ursula K. Le Guin’S Hainish Cycle And The Rights Of Nature, Ted Hamilton
Speculative Constitutions In Ursula K. Le Guin’S Hainish Cycle And The Rights Of Nature, Ted Hamilton
Faculty Journal Articles
This paper examines two speculative examinations of humanity as a unified species and agent of ecological change: Ursula K. Le Guin’s Hainish Cycle and the rights of nature movement. Le Guin’s Cycle imagines the slow interplanetary reintegration of human polities against a backdrop of cultural and environmental difference. I read the novels of the Cycle as an allegory for the rights of nature movement, which seeks to synthesize traditional and modern knowledge in a legal solution to ecological crisis. Both discourses, I argue, productively imagine a new historical understanding of humanity’s place on Earth, but they provide a weak theory …

Building Trust(S): Rethinking Asset Return In Kleptocracy Forfeitures, Michael J. Biondi
Building Trust(S): Rethinking Asset Return In Kleptocracy Forfeitures, Michael J. Biondi
Duke Law Journal
Kleptocracy, literally meaning “rule by thieves,” is a major destabilizing force in an already unstable world. Every year, corrupt government officials plunder billions of dollars rightfully belonging to their citizens and export them overseas. When these funds—often parked in luxury assets—reach the United States, federal prosecutors can seize them using a procedure known as nonconviction-based forfeiture. But after every such seizure, a question arises: How does the United States give stolen assets back to whom they belong? The United Nations Convention Against Corruption strongly encourages (or, in some circumstances, requires) forfeited assets to be returned to their state of origin …
Patent Forfeiture, Sean B. Seymore
Patent Forfeiture, Sean B. Seymore
Duke Law Journal
Patent law doesn’t look kindly on patent owners who engage in wrongdoing involving the patent. The U.S. Supreme Court and lower courts have refused to enforce patents tainted with inequitableness, fraud, or bad faith. This issue typically arises in patent litigation when an accused infringer asserts that the patent should be unenforceable if the patentee engaged in one of four proscribed activities: inequitable conduct (deliberate misrepresentations or omissions of material information from the Patent Office); patent misuse (anticompetitive licensing practices); unclean hands (business or litigation misconduct); or waiver/estoppel (a lack of candor before a standard-setting organization). This seems right—a patentee …
The Puzzle Of Procedural Originalism, Mila Sohoni
The Puzzle Of Procedural Originalism, Mila Sohoni
Duke Law Journal
On a daily basis, lawyers and judges consult and apply the rules of subject matter jurisdiction and personal jurisdiction. These doctrines—the workhorses of procedural law—ostensibly spring from the Constitution’s text, but their substance owes more to considerations of fairness, efficiency, and sound policy than it does to original meaning. Indeed, these doctrines are among the most openly and obviously nonoriginalist doctrines in constitutional law. Curiously, the originalist movement has almost totally ignored this everyday terrain. That is beginning to change. Recent overtures by Supreme Court Justices suggest that originalists are now poised to advance into the field of civil procedure. …
Token Wars: How The Sec Can Learn To Embrace Utility Tokens, Paul K. Drexler
Token Wars: How The Sec Can Learn To Embrace Utility Tokens, Paul K. Drexler
Duke Law Journal
Tired of the power that mega platforms wield over the web, a growing chorus of internet users has hailed the arrival of blockchain technology, believing it can be used to build a new internet. Called “Web 3.0” by some, the new internet would allow users to exchange goods and services—digital currencies, cloud computing power, data storage—without needing a central intermediary to validate transactions. Instead, users would transact through decentralized platforms that use consensus-based mechanisms to verify users’ exchanges. And rather than rely on fiat money, users would use the platforms’ native currencies, called “utility tokens,” as the media of exchange. …
Free Speech: A Right In Crisis As Turkish Parliament Passes New “Disinformation” Bill, Zaira A. Rojas Navarro
Free Speech: A Right In Crisis As Turkish Parliament Passes New “Disinformation” Bill, Zaira A. Rojas Navarro
Cardozo International & Comparative Law Review (CICLR) Blog
Shards of glass and plastic flew across the floor as legislator Burak Erbay, a member of the Republican People’s Party, hammered and smashed a smartphone Wednesday night while addressing the Turkish parliament in opposition to president Recep Tayyip Erdoğan proposed Disinformation Bill. Erbay argued the Bill’s clampdown on social media would make smartphones obsolete. Turkish authorities reported to the Venice Commission and the Directorate General of Human Rights and Rule of Law (DGI) of the Council of Europe that the principal goal of the new legislation is to “prevent the spread of fake, untrue, baseless, and false information designed to …
