Duty-Free Shopping: Comparing Tax-Free Travel Restrictions Of The Eu And The United States, Sarah Lerche
Cardozo International & Comparative Law Review (CICLR) Blog
If you have been to an airport, you have likely come across the heavily stocked, halogen lit, mini shopping malls just across from your departing gate. Affixed with the large “Duty-Free” logo, these tempting variety stores lure travelers in with their notorious “tax-free" goods, that “typically offer a distinct assortment of luxury goods-like alcohol, jewelry, and beauty products-to outbound international travelers.” But the question looms, whether these duty-free shops are actually saving customers money, and how countries restrict such purchases throughout international travel. This piece will explore those two questions by comparing the European Union (EU) and the United States …

98th Henry M. Campbell Moot Court Competition: Final Round, University Of Michigan Law School
Event Materials
Henry Munroe Campbell was a distinguished lawyer who served as legal counsel to the University of Michigan's Board fo Regents for several years.
Following Mr. Campbell's death in 1926, his law partners met with then University of Michigan Law School Dean Henry M. Bates to discuss a fitting memorial. They decided to establish a case club competition to foster training for law students in appellate advocacy in his honor. The first Henry M. Campbell competition was held in the 1927-28 academic year.
A trust fund to finance the competition was established in 1927 and has been periodically augmented with gifts …

Overview Of Missouri Appellate Briefing Rules And The Case Of Hicks V. Northland-Smithville, Steve Lockwood
SLU Law Journal Online
Starting with the Missouri Supreme Court's 2022 opinion in Lexow v. Boeing Co., appellate courts have put renewed emphasis on the requirements of Rule 84.04. The recent opinion by the Western District Court of Appeals, Hicks v. Northland-Smithville, and several predecessor opinions to Hicks, are a lesson and reminder to practitioners to strictly adhere to the Missouri Rules of Appellate Procedure, specifically Rule 84.04. In this article, Steve Lockwood will discuss Hicks and the implications of the opinion.

Changes In Household Recycling Behavior: Evidence From Panel Data, Joel Huber, Jason Bell, W. Kip Viscusi
Changes In Household Recycling Behavior: Evidence From Panel Data, Joel Huber, Jason Bell, W. Kip Viscusi
Vanderbilt Law School Faculty Publications
This article uses a longitudinal national U.S. dataset with 232,309 pairs of same-household observations to estimate one-year or two-year changes in recycling behavior. Most households recycled at least one material, as 83% recycle paper, cans, glass, or plastic in the past year, with an average recycling rate of 2.8 materials. Recycling habits are stable, as 68% of households do not change the number of materials recycled from the previous year. Changes in county recycling are reflected in immediate changes in household behavior but at 25% of the change in the county recycling rate. Recycling rates are greater after being newly …

Israeli Supreme Court Project At Cardozo Law Passes 10 Year Milestone, Cardozo Israeli Supreme Court Project
Cardozo News 2023
April will mark ten years for a project at Cardozo School of Law unlike any in the world. The Israeli Supreme Court Project (ISCP) has provided lawyers, judges, political scientists and historians with invaluable resources on issues that have shaped democracy in Israel. The ISCP has translated over 400 opinions of the Court into English from the original Hebrew. These translations are archived on the website Versa as a repository, where relevant articles are also published in a blog devoted to current cases on the docket. They are studied by scholars, laypeople and U.S. Supreme Court Justices, and they are …

Proportionality Defenses In Frand Cases - A Comparative Assessment Of The Revised German Patent Injunction Rules And Us Case Law, Peter Georg Picht, Jorge L. Contreras
Utah Law Faculty Scholarship
A new defense against injunctions in FRAND cases has arisen in Germany, and its relationship to the Huawei defense (whether viewed as a competition or contractual matter) is largely unexplo-red. In August 2021, the “Second Act for the Modernization of Patent Law” (Zweites Pa-tentrechtsmodernisierungsgesetz) took effect and modified the German Patent Act (GPA) in sever-al respects. Pertinent to our topic is an amendment to § 139(1) GPA which introduced an expli-cit proportionality defense against injunction claims. The new proportionality mechanism con-sists of three main elements: First, § 139(1)(3) GPA excludes the claim to an injunction in case of patent infringement …
Impacted Communities Leading Authentic Legal Mobilization: A Refugee-Led Access-To-Justice Story, Douglas Smith
Impacted Communities Leading Authentic Legal Mobilization: A Refugee-Led Access-To-Justice Story, Douglas Smith
Journal of Civil Rights and Economic Development
(Excerpt)
I have a modest proposal to begin addressing the civil access-to-justice problem in the United States: eliminate the barriers for refugees to provide legal representation. In discussions of access to civil justice, immigration and immigrant rights compel our attention—images of children as young as three facing deportation without representation and non-citizens detained because of civil immigration infractions come to mind. But we hear less about the access-to-justice challenges of immigrants fighting for their rights to safe housing, public benefits, education for their children, or often-contingent or under-the-table jobs. The cries of immigrant communities about informal and formal threats from …
A Better Way: Uncoupling The Right To Counsel With The Threat Of Deportation For Unaccompanied Immigrant Children And Beyond, Laura Barrera
A Better Way: Uncoupling The Right To Counsel With The Threat Of Deportation For Unaccompanied Immigrant Children And Beyond, Laura Barrera
Journal of Civil Rights and Economic Development
(Excerpt)
The stakes could not be higher in immigration court—families are separated; people are banished from their communities with little hope of ever legally returning; judges relegate individuals to seemingly arbitrary and indefinite detention in remote locations. Each of these hardships—and more—flow from the threat of deportation. As the Supreme Court noted in 1922, deportation “may result . . . in . . . all that makes life worth living.”
As has been the unfortunate norm in civil proceedings, many individuals face these trials without an attorney by their side because while the law states that respondents in immigration court …

Expanding The Right To Counsel In Eviction Cases: Arguments For And Limitations Of "Civil Gideon" Laws In A Post-Covid 19 World, Jennifer S. Prusak
Journal of Civil Rights and Economic Development
(Excerpt)
With the cost of housing rising nationwide and incomes largely failing to keep pace with this increase, the United States is in the midst of interrelated affordable housing and eviction crises. The housing affordability metric that has long been the bedrock of American housing policy is that households should spend no more than thirty percent of their income on housing. This is no longer an attainable goal for many Americans. By 2017, forty-eight percent of renter households were “rent burdened”—they paid more than thirty percent of their income in rent. Over a quarter of American renters, or 11 million …
Patching The Patchwork: Moving The Civil Right To Counsel Forward With Key Data, Maria Roumiantseva
Patching The Patchwork: Moving The Civil Right To Counsel Forward With Key Data, Maria Roumiantseva
Journal of Civil Rights and Economic Development
(Excerpt)
While the pandemic has exposed many long-standing realities about the United States, the destructive everyday crisis of eviction is top of mind as moratoria have now expired and rental assistance funds dissipate with no anticipated replenishment. Therefore, though this piece addresses legal representation in civil legal proceedings more broadly, we will start with an eviction story.
It can be taken as fact that not too far from where you are reading this piece, a tenant is facing an eviction unrepresented. She cannot afford a private attorney. She is income eligible for legal aid, but the office near her home …

Do Adolescent Patients Have A Right To Be Informed About Fertility Preservation Options By Virtue Of The Conventions On The Rights Of The Child?, Giulia Adele Dinicola
Graduate Student Research Symposium
The 1989 United Nations Convention on the Rights of the Child not only states that children should be heard in matters of their concern according to their age and maturity, but also that children should have a right to have access to information. However, when it comes to medical indications, a consensus has not been reached on whether parents should disclose healthcare complications to their adolescent child. Adolescent disclosure becomes even more controversial when related to non-lifesaving procedures. In the United States, one child in 285 children is diagnosed with cancer every year, but thanks to improvements in medicine, the …

Managing Misinformation On Social Media: Targeted Newsfeed Interventions And Freedom Of Thought, Richard Mackenzie-Gray Scott
Northwestern Journal of Human Rights
Whether it is being told a particular politician consumes children, or drinking cow urine will cure your disease, or that Jimi Hendrix is alive and well living the good life in Drumnadrochit, misinformation affects societies in myriad ways. Its spread online via social media platforms raises questions concerning how it can be addressed. This article engages with a related problem: Can the use of targeted behavioral interventions on social media newsfeeds to reduce the spread of misinformation be reconciled with the human right to freedom of thought?
